WIIEREAS, the Anaheim City Planning Commission did receive a verified

South Rosewood, Santa Ana, California 927'~7, agent, of certain real property
situated in tlie City of Anaheim, County of Orange, State of California,

WFIEREAS~ the City Planning Commission did hold a public hearing aC the City
Hall in the City of Anaheim on July 12, 1932, at 1:30 p,m., notice of said public
hearing having been duly given as required by la~r a~d in accordance with the
provisions of tfie Anaheim Plunicipal Code, Chapter 1£3.03, to hear and consider
evidence for and against said proposed conditional use permit and to investigate and
rnake findings and recommendations in connection ti~erewith; and
IJNEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing, does find and determine the following facts:
1. That the proposed use is properly one for which a conditional use
permit is authorized by Anaheim Municipal Code Section 13.44.050.010 to tivit to permit
a cocl.tail lounge in the CL (Commercial, Limited) zone with waiver of;
SECTIOW 18.06.060.0232 and 13 44 066,050 - Minimum number of
parking spaces.
(54 spaces required; 50 spaces existing)
2. That the requested waiver is hereby denied on the basis that there is
an existing parking problem in the area and granting of this ti•~aiver would compound
the proble~n,
3. That the proposed use is liereby denied on the basis that suEject
property is located in close proximity to an adJacent residential area to the north
across a public alley, and ttiat the increased noise, parking and traffic will cause
substanttal dis;urbances to the residents,
4. That the proposed use will adversely affect thr_ ad,joining land uses and
the grrnvth and development of the area in which it is propos~d to be located.
5. That tlie size and shape of the site pr~~osed for the use is not
adcquate to allow the ful' development of the proposed use in a manner not
detrimental to the particular area nor to tlie peace, fiealth, safety, and general
welfare of tlie Citizens of the City of Anaheim,

the peace, health, safety and general ~~ielfare of the Citizens of the City of Anaheim.
7. That the traffic generated by the proposed use o-rill impose an undue
burden ~~pon tl~e streets and highways designed and improved to carry the trarfic in
the area.
8. That 4 persons indicated their presence at said public hearing in
opposition; and tliat one letter and a petition containing approximately 38 signatures
were received in opposition to the subject petition.
ENVIROWMEIJTAL IhiPACT FINDING: That the Analieim Cit;~ Planning Cammission has
reviewed the proposal to permit a cocktail lounge in the CL (Commercial, Limited)
zone with waiver of minimum number of parking spaces on a rectangularly-shaped parcel
of land consisting of approximately 0.6 acre, located on the north side of La Palma
Avenue (1731-1739 West La Palrna Avenue); and does hereby disanprove the Negative
Declaration from the requirement to prepare an environmental impact report on the
basis that there would be significant individual or cumulative adverse environmental
impact due to the approval of this Negative Declaration; that sensitive
environmental impacts are involved in the proposal; that the Initial Study submitted
by the petitioner inuicates significant individual or cumulative adverse
environmental impacts.
r~Old, TfiEREFORE~ BE IT P,ESOLVED that the Anaheim City Planning Commissicn
does hereby deny subject Petition for Conditional Use Permit on the basis of the
aforementioned findings.
