A RE$OLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR RECLASSIFICATION NO. 82-83-3 BE DENIED
WHEREAS, the Anaheim City Planning Commission did receive a verified
netition for Reclassification from STANLEY F. & SYLVIA C. WONG, 1906 East
South Street, Anaheim, California 92805, owner, of certain real property
situated in the City of Anaheim, County of Orange, State of California,
described as follows~
THAT PORTION OF LOT 16 OF 1,N.~([EIM EXTENSION, AS SHOWN ON A MAP OF
SURVEY MADE BY WILLIAM HAMEL AND FILED IN THE OFFICE OF THE COUNTY
RECORDER OF LOS ANGELES COUNTY, CALIFORNIA, A COPY OF WHICH IS SHOWN
IN BOOK 3 PAGE 163 ET SLQ. ENTITLED "LOS ANGELES COUNTY MAPS" IN THE

SAID LAND IS INCLUDED WITHIN THE AREA SHOWN ON A MAP FILED IN BOOK 20
PAGE 28 OF RECORD OF SURVEYS, IN THE OFFICE OF THE COUNTY RECORDER OF
SAID COUNTY.
WHEREAS, the City Planning Commission did hold a public hearing at the
Civic Center in the City of Anaheim on July 26, 19B2 at 1:30 p.m., notice of
said public hearing havinq been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed reclassification
ar.d to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and study
made by itself and in its behalf, and after due consideration of all evidence
and reports offered at said hearing, does find and determine the following
facts:

1. That the petitioner proposes reclassification of subject property from
the RS-A-43,Od0 (Residential/Agricultural) Zone to the CL (Commercial,
Limited) Zone.
2. That the Anaheim General Plan designates subject property for general
commercial land uses.
3. That the proposed r.eclassification of. subje~t property is not
necessary nor desirable for the orderly and proper development of the
commtxnity.
4. That the proposed reclassiiication of suUject property does not
properly relate to the zones and their permitted uses locally established in
close prox.imity to subject property and to the zones and their permitted uses
generally established throughout the community.
5. That the proposed reclassification is denied on the basis that the
adjacent commercial property, facing State College Boulevard, is leased but
not owned by the same property owner as subject property which faces South
Street; and that reclassificatiou of subject property would be considered
"spot zoning" in the single-iamily residential area located to the north and
west and also taking access from South Street.
6. That rwo pecsons indicated their presence at said public h2aring in
opposition; and that a petition containing approximately 19 signatures was
received in opposition to subjec*_ petition.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Cc.:nmission
has reviewed the proposal to reclassify subject property from the RS-A-43,000
(Residential/Agricultural) Zone to the CL (Commercial, Limited) Zone to permit
the coaunercial use of a residential structure with waivers of minimum number
of parking spaces, required location of parking spaces, and required site
screening on a rectangularly-shaped parcel of land consisting ^f approximately
0.4 acre, havinq a frontage of approximately 112 ~'eet on the south side of
South, and further described as 190E ~ast South Street; and does hereby
approve the Negative Declaration from the requirement to prepare an
environmental impact report on the basis that there would be no significant
individual or cumulative adverse environmental impact due to the approval of
this Negative Declaration since the Anaheim General Plan designates the
subject property for general conmercial land uses comznensurate with the
proposal; that no sensitive environmental impacts are involved in the
proposal; that the Initial Study submitted by the petitioner indicates no
significant individual or cumulative adverse environmental impacts; and that
the Negative Declaration substantiating the foregoing findings is on file in
the City of Anaheim Planning Department.
NOW, THEREFOF2~., BE IT ItESOLVED that the Anaheim City Planninq Commission
does hereby deny Petition ior Reclassification on the basis of the
aforementioned findings.
