THAT PETZTION FOR CONDITIONAT, USE PERMIT NO. 2360 BE GRANTED
WHEREAS, the Anaheim City Planning Commission did recei~~e a verified
Petition for Conditional Use Permit from RCGER A. AND HARBARA A. SEVERSON,
P. O. Hox 2058, Huntington Beach, California 92647, ow~ners, and JEAN SPRINGER,
2821 White Star "J", Anaheim, California ~2806, agent, of cerCain real
property situated in the City of Anahei.m, County of Oranga, State of

WHEREAS, the City Planning Couanission did hold a publi~ hearinq at the
City Hall in the City of Anaheim on July 26, 1982, at 1:30 p.m., notice of
said public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed canditional use
permit and to invectigate and maY.e findings and recommendations in connectlon
therewith; and

made by itself and in its behalf, and after due consideratic~i of all evidence
and reports offered at said hearing, does find ar.d determine tt~e Foliowing
facts:
:l. ThaL the proposed use is properly one for which a con3itional use
permit is authorize3 by Anaheim Munfcipal Code Section 18.61.050.390 to wit:
to permit on-sale beer and wine in an existing sandwich shop.
2. That the pr~~posed use will not adversely affect the adjoining land
uses and tha growth and development of the area in which it is proposed to be
located.
3. That the size and shape of the site propoaed for the use is adequate
to allow the full development of the proposed use in a manner not detrimental
to tk:e particular area nor to the peace, health, safety and yeneral welfare of
the Citizens of the City of Anaheim.
4. That the granting of the Conditional Use Permit under the conditions
imposed, if any, will not be detrimental to the pe~ce, hcalth, safety and
general welfare of the Citizens of the City of Anaheim.

5. That the traffic generated by the proposed u~e will not impose an
undue burden upon the strects and highways de~igned and improved to carry the
tr~ff-ic in the area.
6. Th~t no one indicated their pre~ence at said public hearing in
opposition; and that no correspondence was received in opposition to the
subject petitiori.
ENVIRONMENTAL ZMPACT FZNDING: That the Planning Director or liis authorized
representative has determined that the proposed project falls within the
definition of Categorical Exemptions, Cla~c 1, as defined in the State EIR
Guidelines and is, therePore, categorfcally exempt from the requirement to
prepare an EIR,
NOW, THEREFORE, SE IT RESOLVED that the Anaheiu~ City Planninq Commission
daes hereby qrant sub;ect Petition for Conditionsl Use Pem.it, up~n the
following conditions which are hereby found to be a necessary prerequfsite to
the proposed use of the subject property in order to prerequisite to the
pcoposed use of the 3ubject property in order to preserve the safety and
general welfare of the Citizens of the Ci~y of Anaheic~:
1. That sidewalks shall be installed along Blue Gum Street and White
Star Avenue as required by thr. Ci~v Enginpar an~ in accerd$rtce x±!h
standard plans and sYecifications on file in the office of the City
Engineer.
2. That subject property shall be developed sub3tantially fn accordance
with plans and specifica*_ion~ on file with the City of Anaheim marked
Exhibit Noc. 1 and 2.
3. That Condition No. 3., abote-aentioned, Eha11 be corrpleted within a
perfod of ninet5• (9U) days from the dnte herein.
4. That Condition No. 2, above-mention~ad, shall ba coraplied with prior
r~ final building and zoning inspections.
SE ST FURTHER RESOL~7ED that the Anahein City Planning Commi~ssion does
hereby f3nd and determine that adoption of this Resolution is expreasly
predicated upor~ appticant's compliance with each and all of the conditionrs
hereinabove set forth. Should any such condition, oz any part thereof, be
declared invalid or unenforceable Uy the final iudgment of any court of
competent jurisdiction, then this Resolutiort, and any approvals herein
contained, shall be deemed null and ~~~i~.
