3. That there are exceptional or extraordina•ry circumstances or
conditions applicable to the property involved or to the intended use of the
property that do not apply generally to the property or class of use in the
same vicinity and zone.
4. That the requested variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other property in the
same vicinit~ and zone, and denied to the property in question.
5. That the requested variance will not be mate;:ially detrimental to the
public welfare or injurious to the property or improvements ir. such vicinity
and zone in which the property is located.
6. That no one indicated their presence at said public hearing in
opposition; and that no correspondence was received in opposition to subject
petition.
ENVIRONMENTAT, IMPACT FINDING: That the Anaheim City Planning Commission
has reviewed the proposal construct an addition to a single-family residence
with waivers of maximum lot coverage, minimum sideyard setback, minimum rear
yard setback and required type of parking spaces on a zectanqularly-shaped
parcel of land consisting of app.roximately i945 square feet, having a frontage
of approximately 35 feet on the east side of Claudina Street, and further
described as 942 North Claudina Street; and does hereby approve the Negative
Declaration from the requirement to prepare an environmental impact report on
the basis that there would be no significant individual or cumulative adverse
environmental impact due to the approval of this Negative Declaration since
the Anaheim General Plan designates the subject property for medium-density
land uses commensurate with the proposal; that that Initial Study submitted by
the petitioner indicates no significant individual or cumulative adverse
environmental impacts; and that the Negative Declaration substantiating the
foregoing findings is on file in the City of Anaheim Planning Department.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Variance, upon the following condit3ons
which are hereby found to be a necessary prerequisite to the proposed use of
the subject property in order to preserve the safety and general welfare of
the Citizens of the City oE Anaheim:
1. That subject property shall be developed substantially in accordarce
with plans and specifications on file with the City of Anaheim marked
Exhibit No. 1.
2. That the existing structure shall be brought up to the minimum
standards of the City of Anaheim, including the Uniform Suilding,
Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted
by the City of Anaheim.
3. That Condition Nos. 1 and 2, above-mentioned, sha~l be complied with
prior to final building a~d zoning inspections.
4. That the existing and proposed sewer tie-in shall comply with the
applicable City Code.

BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does
hereby find and determine that adopt.ion of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such condition, or any part thereof, be
declared invalid or unenforceable by the final judgment of any court of
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is signed and approved by me this Ju2y 26, 1982.
