A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR RECLASSIFICATION NO. 82-83-5 BE GRAI~TED
WHEREAS, the Anaheim City Planning Commission did receive a verified
petition for Reclassification from AUTOMOBILE CLUB OF SOUTHERN CALIFORNIA,
2601 South Fiqueroa, Los Angeles, California 90007, owner, and PAUI J.
TURIGLIATTO, 2601 South Figueroa, Los Angeles, California 90007, agent, of
certain real property situated in the City of Anaheim, County of Orange, State
of California, described as follows:
PARCEL 2 AS SHOWN ON A MAP PILED IN HUOK 110, PAGES 12 AND 13 OF
PARCEL MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SA_D COUNTY.
WHEREAS, the City Planning Commission d:Ld hold a public hearing at
the Civic Center in the City of Anaheim on August 9, 1982 at 1:30 p.m., notice
of said public hearing having been duly given as required ~y law and in
accordance with the provisions of the Anaheim Municipal Code. Chapter 18.03,
to hear and consider evidence for and against said proposed reclassification
and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study ntade by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
following facts:
1. That the petitioner proposes reclassificatior. of subject
- property from the RS-A-43,000(SC) (Residential/Agriculture-Scenic Corridor
Overlay) zone to the CL(SC) (Commercial, Li.mited-Scenic Corridor Overlay) zone
to construct a two-story office building and bank.
2. That the Anaheim General Plan designates subject pr~per.t1 for
general commercial and/or hillside low density residential land uses.
3. That the proposed reclassification of subject property is
necessary and/or desirable for the orderly and proper devel~~pment of the
community.
4. That the proposed reclassification of subject property does
properly relate to the zones and their permitted uses locally established in
close proximity to subject property and to the zones and their ~ermitted uses
generally established throughout the community.
5. That the proposed reclassification of subject property requires
the improvement of abutting streets in accordance with the Circulation Element
of the General Plan, due to the anticipated increace in traffic which will be
generated by the intensification of land use.
6. That no one indicated their presence at ~aid public hearing in
opposition; and that no correspondence was received in opposition to subject
petition.

`~~'' ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to reclassify subject property from the
RS-A-43,000(SC) (Residential/Agricultural-Scenic Corridor Overlay) zone to the
CL(SC) (~o~ercial, Limited-Scenic Corridor Overlay) zone to construct a
• two-story affice building and bank on an irregular.ly-shaped parcel of land
j. consisting of approximately 3.0 acres located at the southwest corner of Santa
' Ana Canyon Road and Avenida Margarita; and does hereby approve the Negative
;; Declaration from the requirement to prepare an environmental impact report on
a the basis that there would be no significant individual or cumulative adverse
~' environmental impact due to the approval of this Negative Declaration since
~~~ the Anaheim General Plan designates the subject property for general
'-,•~ commercial/hillside low-density residential land uses commensurate with the

F"' proposal; that no sensi'-.ive environmental impacts are involved in the
~:, proposal; that the .Lnitial. Study submitted by the petitioner indicates no
'~`• significant individual or cumulative adverse environmental impacts; and that
~` the Negative Declaration substantiating the foregoing findings is on file in
the City of Anaheim Planning Department.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does herPby grant subject Petition for Reclassification and, by so
doing, that Title 18-Zoninq of the Anaheim Munir_ipal Code be amended to
exclude the above-described property from RS-A-43,000(SC)
(Residential/Agricultural-Scenic Corridor Overlay) zone to the CL(SC)
(Commercial, Limited-Scenic Corridor Overlay) Zone upon the following
conditions which are hereby found to be a necessary prerequisite to the
proposed use of subject property in order to preserve the safety and general
we~fare of the Citizens of the City of Anaheim:
1. That street lighting facilities along Avenida Margarita shall be
installed as required by the Office of Utilities General Manager, and
in accordance with specifications on file in the Office of the Office
of Utilities General Manager and/or that security in the form of a
bond, certificate of deposit, letter of credit or cash, in an amount
~nd forcn satisiacLOry to the City of Anaheim shall be posted with the
City to guarantee the satisfactory installation of the
above-mentioned improvements. Said security shall be posted with the
City prior L-o approval of buildinq permits. The above-required
improvements shall be installed prior to occupancy.
'-• That the owner(s) o£ subject property shall pay to the City of
Anaheim a fee, in an amount as determined by the City Council, for
tree planting purposes along Avenida Margarita.
3. That trash storage areas shall be pro~ided in accordance with
approved plans on file with the Office o£ the Executive Director of
Public Works; said trash area locations to be approved by the Public
~4orks and Planning Departments.

determined to be necessary by the Chief of the Fire DE~artment prior
to commencement of structural framing.

18. That the owner(s) of subject property shall dedicate and improve a
1~-foot wide equestrian and hiking trail as shown on the Equestrian
and Hiking Trails Component of the Anaheim General Plan; and that
improvement plans, in accordance with standard plans and
specifications on file in the Office of the City Engineer, shall be
submitted in conjunction aith the grading plan; and/or that a bond in
an amount and °orm satisfactory to the City of Anaheim shall be
posted with the City to guarantee the installation of the
above-mentioned requirements prior to occupancy.
19. That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim marked
Exhibit Nos. 1 through 6.
20. That prior to the introduction of an ordinance rezoning ~ubject
property, Condition Nos. 1, 2, 12 and 18, above-mentioned, shall be
completed. The provisions or rights granted by this resolution shall
become null and ~~oid by action of the Planning Commission unless said
conditions are complied with within one year from the date hereof, or
such further time as the Planning Commission may grant.
21. That Condition Nos. 3, 5, 6, 7, 8, 13, 14, 15, 15, 17, and 19,
above-mentianed, shall be complied +rith prior to final buildinq and
zoning inspections.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commissiun does
hereby find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such condition, or any part thereof, be
declared invalid or unenforceable by the final judgemnt of any ceurt of
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed nu1.1 and void.
THE FOREGOING RESOLUTION is siqned and approved by me this 9th day of
