R RESOLUTION OF THE ANAHF,IM CITY PLANNZNG COMMISSION
THAT PETITION FOR RECLASSIFICATION NO. 82-83-2 BE GRANTED
WHEREP.S, the Anaheim City Planning Commission did receive a verified
petition for Reclassification from PABLO V. AND LAURA KNOWLTON DOMINGUEZ, 1523
East Santa Ana Street, Anaheim, California 92:J05, own~rs, and J.B. BIRD, ~11
North Broukhurst Street, Anaheim, California 92803, agent, of certain real
property situated in the City of Anaheim, County of Orange, State of
California, described as follows:

CITY OF ANAHEIM, COUNTY OF ORANGE, STATE UF CALIFORNIA, AS PER MAP
RECORDED IN BOOK 51 PAGE 10, OF DIISCELLANEOUS MAPS, IN THE OFFICE OF
THE COUNTY RECORDER OF SAID COUNTY.
WHEREAS, the City Planning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on August 9, 1982 at 1:30 p.m., notice
of said public hearing having been duly given as required by law and in
accordance with the provi~ions of the Anaheim Municipal Code. Chapter 18.03,
to hear and consider evidence £or and against said proposed reclassification
and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports nffered at said hearing, does find and determine the
following facts:
1. That the petitioner proposes reclassification of subject
property from the RS-A-43,000 (ResidPntial, Agricultural) zone to the CL
(Coaunercial, Limited) zone.
2. That the Anaheim General Plan designates subject property for
general commercial land uses.
3. That the proposed reclassification of subject property is
necessary and/or desirable for the orderly and proper development of the
community.
4. That the proposed reclassification of subject property does
properly relate to the zones and their permitted uses locally established in
close proximity to subject property and to the zones and their permitted uses
generally established throughout the community.
5. That the proposed reclassification of subject property requires
the improvement of abutting streets in accordance with the Circulation Element
of the General ~lan, due to the anticipated increase in traffic which will be
generated by the intensitication of land use.

6. That no one indicated their presence at said publi.c hearing in
opposition; and that no correspondence was received in opposit'.on to subject
petition.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning
Commission has r.eviewed the proposal to reclassify subject property from the
RS-A-43,000 (Residential/Agricultural) zone to the CL (Commercial, Limited)
zone to permit two signs mounted on a gasoline pump island canopy with waivers
of maximum number of freestanding si.gns and minimum distance between
freestanding signs on a rectangularly-shaped parcel of land consistinq of
approximately 0.5 acre located at the southeast corner of Ball Road and State
College Boulevard, and further described as 1200 South State College Boulevard
(Shell Service Station); and does hereby approve the Negative Declaration from
the requirement to prepare an environmental impact report on the basis that
there would be no significant in3ividual or cumulative adverse environmental
impact due to the approval of this Negative Declaration since the Anaheim
General Plan designates the subject property for gener.al commercial land uses
commensurate with the proposal; that no sensitive environmental impacts are
involved in the proposal; that the initial Study submitted by the petitianer
indicates no significant individual or cumulative adverse environmental
impacts; and that the Negative Declaration substantiating the foregoing
findings is on file in the City of Anaheim Planning Department.
NOW, THEREFORE, BE 2T RESOL\lED that the Anaheim City Planning
Commission does hereby grant subject Petition for Reclassification anu, by so
doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to
exclude the above-described property from RS-A-43,000
(P.esidential/Agricultural) zone to the CL (Conmercial, Limited) zone upon the
following conP.itions which are hereby found to be a necessary prerequisite to
the proposed use of subject property in order to preserve the safety and
general welfare of the Citizens of the City of Anaheim:
1. That appropriate water assessment fees as determined by the Office of
Utilities General Manager shall be paid to the City of Anaheim prior
to adoption of an ordinance rezoning subject property.
2. That the owner(s) o.f subject property shall pay to the City of
Anaheim a fee, in an amount as determined by the City Council, for
tree planting purposes along Ball Road and State College Boulevard.
3. That subject property shall be ~leveloped substantially in accordance
with plans and specifications on file with the City of Anaheim marked
Exhibit Nos. 1 and 2.
4. That prior to the introducti~n of 3n ordinance rezoning suSject
property, C~ndition Nos. 1 and 2, above-mentioned, shall be
completed. The provisio~~s or rights granted by this resolution ehall
become null and void bp action of the Planning Commission unless said
conditions are conplied with within one year Erom the date hereof, or
such further time as the Planning Comcc;ission may grant.
5. That Condition No. 3, above-mentioned, sliall be complied with prior
to final building and zoning inspections.

BE IT FURTHER REgOLVED that the Anaheim City Planning Commission does
hereby find and determine that adoption of this Resolution
predicated upon applicant's compliance with each and all of iy expressly
hereinabove set forth. Should any such condit_on, or an the conditions
declared invalid or unenforceable by the final judgemnt of rt thereof, be
competent jurisdiction, then this Resolution anY court of
