THAT PEiITION FOR RECLASSZFZCATIOCi NO. 82-83-6 BE GRANTED
WHEREAS, the Anaheim City Planning Commission did receive a verified
petition for Reclaasification from JOSEPli B. EDWARDS, ET AL., 1237 South
Euclid Avenue, Anaheim, California 92802, owner and ROBERT AND DAPNNE WEISS,
1G~tl auena Vista, Anaheim, California 92802, aqent, of certain real property
cituated in the City of Anaheim, Covnty of Orange, State of California,
described as follows:
LOT 1B OF TRACT NO. 2177, IN THE CITY OF ANAf{EIM, COUNTY OF
ORANGE, ~TATE OF CALIFOPNIA, AS PER MAP RECOR~ED IN BOOK 59
PAGES 36 AND 37 OF ~~ISCELLANEOUS MAPS, iN THE OFFICE OF THE
COUNTY RECORDER OF SAID COUNTY.
WHEREAS, the C<_ty Planning Coaunission did hold a public hearing at
the Civic Center in the City of Anaheic~ on August 23, 1982 at 1:30 p.m,,
notice of said public hearinq havin3 been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code. Chapter 16.03,
to hear and conaider evidence for and ~gainst ~aid progoseii reclassification
and to investiqate and make findings ar.~i recoumendations in connection
therewith; and
WHEREAS, said Conmission, after dur_ inspection, investiyation and
atudy ciade by itself and in its behalf, and after due consideratio~, of all
evidence and reports ~ffered at said hearinq, does find and deiermine the
followin~ f~ct:::
~• That the petitioner proposes reclassificatian of suhject
P~^P!"'t} frcm t~;c RS-72GG (Residential, Single-Family) zone to the CL
(Commercial, Limited) zone.
2• That the Anaheim General Plan designates subject property for
general commercial land uses.
3• That the proposed reclassificatioa of subject property is
necessary and/or desirable for the orderly and proper development of the
c~tnunity.

properly relate to the zones and their per~itted uaea locally establiahed in
close proxiu~ity to subject property und to the zortes and their permitted uses

~WIRONMENTAL II~ACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to reclassify subject property from the
RS-7200 (Residential, Single-Family) zone to the CL (Commercial, Limited) Zone
to permit the commercial use of a residPntial structure wit.ti waivers of
minimum nu.~nber of parkina spaces and require3 location of parking spaces on a
rectangularly-shaped parcel of land consisting of approximately 6000 square
feet located at the southeast corner of Sumac Lane and Euclid Street (1694
West Sumac Lane); and does hereby approve the Negative Declaration from the
requirement to prepare an environmental impact report on the basis that there
would be no significant individual or cumulative adverse environmental impact
due to the approval of this Negative Declaration since the Anaheim General
Plan designates the subject property for general commercial land uses
commensurate with the proposal; that no sensitive environmental impacts are
ir.volved in the proposal; that the Initial Study submitted by the petitioner
indicates no significant individual or cumulative adverse environmental
impacts; and that the Negative Declaration substantiating the foregoing
findings is on file in the City of Anaheim Planning Department.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby grant subject Petition for Reclassification and, by so
doing, that Title 18-Zoning of the Anaheim MLnicipal Code be amended to
exclude the above-described property from the RS-7200 (Residential,
Single-Family) zone to the CL (Commercial, Limited) 7,one upon the following
conditions which are hereby found to be a necessary prerequisite to the
proposed use of subject property in order to preserve the safety and yeneral
welfare of the Citizens of the City of Anaheim:
1. That the owner(s) of subject property shall deed to the City of
Anaheim a strip oE land 53 feet in width from the centerline of the
street along Euclid Street £or street widening purposes.
2. That street l:.ghting facilities along Euclid Street and Sumac Lane
shall be installed as required by the Office of Utilities General
yanager, and in accordance with specifications on £ile in the Office
of the Office of Utilities General Manager and that security in the
form of a bond, certificate of deposit, letter cf credit, or cash, in
a}~ amount and form satisfactory to the City o.f Anaheim, shall be
posted with the City to guarantee the satisfactory completion of the
above-mentioned improvements. Said security shall be posted with the
City within 30 days. The above-required improvements shall be
installed prior to final reading of the ordinance rezoning subject
property.
3. That the owner(s) of subject property shall. pay to the City of
Anaheim a fee, in an amount as determined by the City Council, for
tree planting purposes along Sumac Lane.
4. That the vehicular access rights, except at street and/or alley
opznings, to Euclid Street shall be dedicated to the City of Anaheim.
5. That siden•alks shall be installed alung Sumac Lane as required by the
City Engineer anA in accordance with standard plans and
specifications on file in the office of the City Engineer.

6. That the existing struct;.ire shall be brought up to the minimum
standards oi the City o£ Anaheim, including the Uniform Building,
Plumbing, Electrical, Mechanical and Fire Codes as adopted by the
City of Anaheim.
7• That completion of these reclassification proceedings is contingent
upon the granting of Conditional Use Permit No. 2363.
8• That the owner(s) of subject property shall pay the traffic signal
assessment fee (Ordinance No. 3896), in aa amount as determined by
the City Council, for commercial buildings ~:rior to the issuance of a
building per.mit.
9• That trash storage areas shall be provided in accordance with
approved plans on file with the Gffice of the Executive Director of
Public Works.
10. That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim marked
Exhibit Nos. 1 through 3.
11. That prior to the introduction of an ordinance rezoning subject
property, Condition Nos. 1,2,3 and 4, above-mentioned, shall be
completed. The provisions or rights granted by this resolution shall
become null and void by action of the Planning Commission unless said
conditions are complied with within one year from the date hereof, ~r
such further time as the Planning Commission may grant.
12• That Condition Nos. 5, 6, 9 and 10, above-mentioned, shall be
complied with prior to final building and zoning inspections.
BE IT FURTHER RESOLVED that ihe Anaheim Cit,y.Planning Commission does
hereby find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the con~iitions
he~einabove set forth. Should any such condition, or anp part thereof, be
declared invalid or unenforceable by the finaZ judgemnt of any court of
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is signed and approved by me this 23rd day
