A RESOLUTION OF THS ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR CONDITIONAL USE PERMIT NO. 2369 BE GRANTED
WHEFtr.AS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit from RICIiARD B. HANSON, ET AL., 1751 West
Romneya Drive, #D, Anahe3m, California 92801, owner and JOSEPH RICKMA21, 2047
Rainbow Drive, Santa Ana, California 92705, agent of certain real property
situated in the City of Anaheim, County of Orange, State of California,
described as:
LOT 26 IN BLOCK 1 OF TFIE ENTERPRISE iRACT, IN THE CITY OF
ANAHEIM~ COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP
RECORDED IN HWK 4 PAGE 89 OF MISCELLANEOUS MAPS, IN THE
OFFICE OF THE COUNTY RECORDER OE SAID COUNTY.
WHER~AS, the City Planning Commission did hold a public hearing at
the City Hall in the City of Anaheim on September 8, i9d2 at 1:30 p.m., notice
of said public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use
pErmit and to investigate and make findings and recommendations in connection
therewith; and
F7HEREAS, said Commission, after 3ue inspection, investigation and
study made by itself and in its behalf, and a£ter due consideration of all
evidence and reports offered at said hearing, does find and determine the
fol~owing facts:
1. That the proposed use is properly one for which a conditional
use permit is authorized by Anaheim Municipal Code Section 18.45.050.140 to
wit to pern~it commercial use of two residential structures with waivers of the
following:
SECTION 18.45.035.030 - Rec~xired location of parking spaces
(Parking at rear of structure required;
Parlcing at front and side groposed)
SECTION 18•45.066.050 - Required number and type of parking spaces
(2/3 of total site area devoted to public
parking area required; 1/2 of total site
area proposed)
2. That the requested waivers are hereby grante~ on the basis of
the size of subject property and on the basis that the proposed use will be
limited to an insurance office as stipulated to by the petitioner at the
public hearing, and therefore, will not generate an excessive parking need.
3. That the proposed use for the residence fronting on Harbor
Boulevard shall be limited to engineering, attorney and/or insurance offi~es;
and that the rear structure shall continue to be used for residential purposes
unt~.l such time as it is redeveloped for commercial uses.

4. That the proposed use will not adversely affect the adjoining
land uses and the growth and development of the area in which it is proposed
to be located.
5. That the size and shape ~f the site proposed for the use is
adequate to allow tY.e full development of the proposed use i.n a manner not
detrimental to the particular area nor to the peace, health, safety and
general welfare of the Citizens of the City of Anaheim.
6• That the granting of the Conditiona]. Use Permit under the
conditions imposed, iE any, will not be detrimental to the peace, health,
safety and general welfare of the Citizens of the City of Anaheim.
7• That the traffic aenerated by the proposed use will not impose
an undue burden upon the streets and highways designed and improved to carry
the traffic in the area.
8- That one person indicated their presence at said public hearing
in opposition; and that a petition containing app~oximately 15 signatures was
received in opposition to the subject petition.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to permit commercial use of two
residential structures with waivers of required location af parking spaces
and required number and type of parking spaces on a rectangul~rly-shaned
parcel of land consisting of approximate~y 5001 aquare feet located at the
northwest corner of Chestnut Street and Harbor 9oulevard, and further
described as 125 South Harbor Boulevard; and does hereby approve the Negative
Declaration from the requirement to prepare an environmental impact report on
the basis that there would be no significant individual or cumulative adversa
environmental impact due to the approval of this Negative Declaration since
the Anaheim General Plan designates the sLbject property for general
commercial land uses commensurates with the proposal; that no sensitive
environmental impacts are involved in the proposal; that the Initial Study
submitted by the petitioner indicates no significant individual or cumulative
adverse environmental impacts; and that the Negative Declaration
substantiating the foregoing findings is on file in the City of Anaheim
Planning Deparr.ment.
t70W, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby qrant subject Petition for Conditional Use Permit, upon
the following conditions which are hereby found to be a necessary prerequisite
to the proposed use of the subject property in order to preserve the safety
and general welfare of the Citizens of the City of Anaheim:
1. That the vehicular access rights, except at approved access points, '
to Harbor Boulevard shall be dedicated to the City of Anaheim.
2• That the existing structures shall be brought up to the minimum
standards of the City of Flnaheim, including the UniPorm Building,
Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted
by the Ci+:y of Anaheim.
~• That the owner(s) of subject property shall deed to the City of
Anaheim a 15-foot radius corner rer_urn at Chestnut Street and tiirbor
Boulevard.

4. That trash storage areas shall be provided in accordance with
approved plans on file with the Office of the Executive Director of
Public Works.
5. That subject property shall be developed substantially in accordance
with plans and specifications on file with tne City of Anaheim marked
Exhibit Nos. 1 and 2.
6. That Condi.tion No~. 1 and 3, above-mentioned, shall be complied with
prior to the commencement of the activity authorized un4er this
re~olution, or prior to the time that the building permit is issued,
or within a period of one year from date hereof, whichever occurs
first, or such further time as the Planning Commission may qrant.
7. That Condition Nos. 2, 4 and 5, above-mentioned, shall be compl.ied
with prior to final building and zoning inspections.
BE IT FURTHER RESOL~D that the Anaheim City Planning Commission does
hereby find and determine that adoption of this Resolution is express:!y
predicated upon applicant's compliance with each and all of the conditiors
hereinabove set forth. Should any such conditions, or any part thereof, b,~
declared ir.valid or unenforceable by the final judgment of any court oi'
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
TFIE FOREGOING RESOLUTION is signed and approved by me this 8th day of
