PC 82-181 RESOLUTION NU• PC82-181 A RESOLUTION OF THE ANAHEIM CITY PLANNING COI•LNISSION THAT PETZTION FOR CONDITIOI~AL USS PERMIT NO. 2377 BE CENIED WHEREAS, tne Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit from DUNN PROPERTIES, 28 Brookhollow Drive, Santa Ana, California 92702, owner, and FLOYD L. FARANO, 2555 East Chapman, Suite 415, Fullerton, California 92631, agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as: PARCELS 29 TQ 36, BOTH INCLUSIVE~ AND THE SOUTHERLY 53 FEET OF PARCEL 37, MEASURED ALONG TIiE EASTERLY LINE THEREOF, OF A MAP FILED IN BOOK 154, PAGES 35 TO 41, BOTA INCLUSIVE OF PARCEL MAPS, RECORDS OF ORANGE COUNTY, CALIFORN?A. WHEREAS, the Ci~y Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on September 20, 1982 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, im~estigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Sectior_ 18.61.050.400 to wit: *o permit a Planned Unit Industrial Service Center including sales and servicing of new and used automobiles. 2. That the proposed use is hereby denied on the basis that an automobile agency would be a commercial intrusion into the industrial a~ea, it would bring conflicting retail traffic into the industrial area and would set an undesirable precedent. 3. That the proposed use will adversely affect the adjoining 2and uses and the growth and development of the area in which it is pror~sed to be located. 4. That the size and shape of the site proposed for the use is not adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 5. That the granting of the Conditional Use Permit under the conditions imposed, if any, will be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. #0230I PC82-181 6. PPosition to the EN~IRONMENTAI, I1~ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit a Planned Unit Industrial Service Center including sales and servicing of new and use automobiles on a rectangularly-shaped parcel of land consisting of approxtmately 5.2 acres 1~cated at the northea~t corner of La Palma Avenue and Brasher Street and a rectangularly-shaped parcel o£ land consisting of approximately 1.1 acres located at the northwest corner of La Palma Avenue and Brasher Street; and does hereby approve the Negative Declaration from the requirement to prepar~z an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental ;mpact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for general industrial land uses commensurates with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Department. NOjJ, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Conmission does hereby deny subject Petition for Conditional Uee Permit, on the basis of the aforementioned find~nqs.
