A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOF VARIANCE N0. 3287 BE GR2INTED
WHEREAS, the Anaheim Cit~~ Planning Commission did receive a verified
Petition for Variance from MIKE AND SUSAN BUCKLEY, 3501 East La Palma Avenue,
Anaheim, California 92806, owners of certain real property situated in the
City of Anaheim, County of Orange, State of California described as:
PARCEI, 2, IN THE CITY OP ANAHEIM, COUNTY OF ORANGE,
STATE OF CALIFORNIA, AS SHOWN ON A PARCEL MAP FILED IN
BOOK 67 PAGE 38 OF PARCEL MAPS, IN THJE OFFICE OF THE
COUNTY RECORDER OF SAID COUNTY.
WHEREAS, the City Planning Coa~ission did hold a public hearing at
the City Hall in the City of Anaheim on September 20, 1982, at 1:30 p.m.,
notice of said public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed variance Znd to
investigate and make findings and recommendations in connection therewith~ and
WHEREAS, said Com:c;ission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports ~~ffered at said hearing, does find and determine the
following facts:
1. That the petitioner proposes waivers of the following to permit
a self-storage facility with caretaker's unit:
(a) SECTION 18..OE.060.038 - Minimum number of parking spaces
and 18.61.066.050 (68 spaces required; 14 spaces
propo=ed)
(b) SECTION 18.04.045.032 - Maximum i'ence height
and 18.61.064.020 (30 inches permitted in front
10 feet setback; 6 feet proposed)
2. That the above-menti~~ned waiver {a) is hereby granted on the
basis that the petitioner demonstrated that a hardship exists in that the
proposed use is a mini-warehouse which would only have two employees on-site
and that the proposed parking would therefore be adequate.
3. That the requested waiver (b) is hereby qranted on the basis
that the petitioner demonstrated a hardship exists due to the proposed use and
the need for security, and denial would deprive subject property of a
orivilege enjoyed by other properties in the same zone and vicinity.

4. That there are exceptional or extraordinary circumstances or
conditions applicable to the property involved or to the intended use of the
property that do not apply generally to the pro.perty or class of use in the
saine vicinity and zone.
5• That the requested variance is necessary for the preservation
and enjoyment of a substantial property right possessed by other property in
the same vicinity and zone, and denied to the property in question.
6. That the requested variance will not be materially detrimental
to the public welfare or injurious to the property or improvements in such
vicinity and zone in which the property is located.
7• That no one indicated their presence a~t said public hearing in
opposition; and that no correspondence was receiv~d in opposition to subject
petition.
ENVIRONM~,'NTAL IMPACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to permit a self-storage facility with
caretaker's unit with waivers of mi.nimum number of parking spaces and maxiaium
fence height on a rectangularly-shaped parcel of land consistinq of
approximately 3.5 acres having a frontage of approximately 340 feet on the
south side of La Palma Avenue; and further described as 4800 East La Palma
Avenue; and does hereby approve the Negative Declaration from the requirement
to prepare an environmental impact report on the basis that there would be no
significant individual or cumulative adverse environmental impact due to the
approval of this Negative Declaration since the Anaheim General Plan
designates the subject property for general industrial land uses commensurate
with the proposal; that that Initial Study submitted by the petitioner
indicates no significant individual or cumulative adverse environ~tental
impacts; and that the Negative Declaration substantiatina the foregoing
findings is on °iZe in the City ~f Tinanei.m Planning Department.
NOW, THEREFORE, BE T_T RESOLVED that the Anaheim City Planning
Commission does hereby grant subject Petition for Variance, upon the follotvinq
conditions which are hereby found to be a necessary prerequisite to the
proposed use of the subject groperty in order t~ preserve the safety and
general welfare of the Citizens of the City of Anaheim:
1. That sidewalks ~hall be insta~led along La Pslma Avenue as required
bY the City Engineer and in accordance with standard plans and
sgecifications on file in the oEfice of the City Engineer.
2• That trash storage areas shall be provided in accordance with
approved plans on file with the Office of the Executive Director of
Public Works.
3. That fire hydrants shall be instailed and cliarged as required and
determined to be necessary by the Chief of the Fire Department prior
to commencement of structural framing.
4. That drainage of subject property shall be disposed of in a manner
satisfactory to the City Engineer.

5. That the owner(s) of subject property shall pay appropriate drainage
assessment fees to the City of Anaheim as determined by the City
Engineer prior to issuance of a building permit.
6. That the owner(s) of subjact property shall pay the traffic signal
assessment fee (Ordinance No. 3896), in an amount as determined by
the City Council, for industrial buildings prior to the is~uance of a
building permit.
7• That the owner(s) of subject property shall pay to the City of
Anaheim a fee, in an amount as determined by the City Council, for
street lighting along La Palma Avenue.
8• That appropriate water assessment fees as determined by the Office of
Utilities General Manager shall be Aaid to the City of Anaheim prior
to the issuance of a building permit.
9• That no outdoor storage of any kind shall be permitted.
10. That all proposed driveway locations shall be subject to review and
approval of the City Traffic Engineer prior to the issuance of
building pernits.
11. That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim marked
Exhibit No. 1.
12. That Condition No. 7, above-mentioned, shall be complied with prior
to the commencement of the activity authorized under this resolution,
or prior to the time that the buiiding permit is issued, or within a
period of one year from date hereof, whichever occurs first, or such
further ti.me as the Planning Commission may grant.
13. That Condition Nos. 1, 2, 4 and 11, above-mentioned, shall be
complied with prior to final building and zoning inspections.
HE IT FUP.THER RESOLVED that the Anaheim City Planning Coa¢nission does
hereby find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such condition, or any part thereof, b~
declared invalid or unenforceable by the final judgment of any court of
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is signed and approved by me this 20th day of
