A RESOLUTION OF THE ANAHEIM CITY PLAY7NING COMNiISSION
THAT PETITION FOR CONDITIONAL US1: PERMIT Np. 2382 BE DENIED
WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit from ATLANTIC RICHF7ELD COMPANY, 300 West
Glenoaks Soulevard, Glendale, C:lifornia Q1202, owner of -ertain real property
situated in the City of Anaheim, County of Orange, State of California,
described as:

RANGE 10 41EST, IN THE RANCHO SAN JUAN CAJON DE SANTA

CALIFORNIA, AS PER MAP RECORDED IN BOOK 51 PAGE 10 OF
MISCELLANEOUS MAPS~ IN THE OFFICE OF THE COUNTY
RECORDER OF SAID COUNTY.
SAID LAND IS INCLUDED WITHIN THE AREA SH04IN ON A MAP
FILED IN SOOK 81 PAGE 15 OF RECORD OF SURVEYS, IN THE
OFFICE OF SAZD COUNTY RECORDER.
WHEREAS, the City Planning Commission did hold a public hearing at
the City Hall in the City of Anaheim on October 18, 1982 at 1:3Q p.m., notice
of said public hearing having been du~y given as required by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use
permit and to investigate and ma!ce findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after du2 inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidPnce and reports offered at said hearing, does find and determine the
following facts:
1. That the proposed use is properly one for which a conditional
use permit is authorized by Anaheim Municipal Code Section 18.03.030.010 to
wit: to permit a convenience market with gasoline sales.
2. That the proposed use is hereby denied on the basis that service
stations sites were orginally granted special privileges not granted to other
commercial properties by permitting the structures to be located closer ':o the
street to service the traveling public; that approval of the proposal would
allow a dual use on a small site which was developed for a single-purpose use
and therefore approval would be granting additional privileges not granted
other properties as well as adversely impacting on and off-site traffic
circulation; and that approval would be grantinq an additional privilege not
qranted to existing nearby markets which were developed in accordance with
Code requirements.
3. That the proposed use will adversely affect the adjoining land
uses and the growth and development of the area in which it .is proposed to be
located.

4. That the size and shape of the site proposed for the use is not
adequate to allow the fiill development of the proposed use in a manner not
detrimental to the particular area nor to the peace, health, safety and
general welEare of the Citizens of the City of Anaheim.
5. That the granting of the Conditional Use Permit will be
detrimental to the peace, health, safety and general welfare of the Citizens
of the City of. Anaheim.
6. That the traffic generated by the proposed use will impose an
undue burden upon the streets and highways designed and .'mproved to carry the
traffic in the area.
7. That no one indicated their Fresence at said public hearing in
opposition; and that no correspondence was received in opposition to the
subject petition.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to permit a convenience market with
gasoline sales on a rectangularly-shaped parcel of land consisting oi
approximately 0.47 acre located at the southeast corner of South Street and
State College Boulevard, and further described as 700 South State College
Boulevard (Rrco Service Station); and does hereby approve the Negative
Declaration from the requirement to prepare an environmental impact report on
the basis that there would be no significant individual or cumulative adverse
environmental impact due to the approval of this Negative Declaration since
the Anaheim General Plan designates the subject property for general
commercial land uses commensurates with the proposal; that no sensitive
environmental impacts are involved in the proposal; that the Initial Study
submitted by the petitioner indicates no significant individual or cumulative
adverse environmental impacts; and that the Negative Declaration
substantiating the foregoing findings is on file in the City of Anaheim
Planning Departlnent.
NOW, THEREFORE, HE IT RESOLV~D that the Anaheim City Planning
Coaunission does hereby deny subject Petition for Conditional Use Permit, on
the basis of the aforementioned findings.
THE FOREGOING RESOLUTION is signed and approved by me this 18th day
of October, 1982.
