A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR VARIANCE NO. 3312 SE GRANTED
WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Variance from LOUIS & MANUEL WF_.TER CO., ET AI,,, 9350 Wilshire
Boulevard, Snite 212, Hever2y Hills, California 90212, owner, and STOVALL
PROPERTIES, 1110 West Katella Avenue, Anaheim, California 92802, agent of
certain real property situated in the City of Anaheim, County of Orange, State
of California described as:
PARCEL 1 AS SHOWN BY THAT CERTAIN PARCEL MAP RECORDED IN
BOpK 22, PAGE 13 OF PARCEL MpPg, ggCORDS OF ORANGE COUNTY,
CALIFORNIA.
WHEREAS, the City Planning Commission did hold a public hearing at
the City Hall in the City of. Anaheim on December 13, 1982, at 1:30 p.m,,
notice of said public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 1B.03,
to hear and consider evidence for and against said proposed variance and to
investigate and make flndings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and
atudy made by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
fol'.~~ring £acts:
1• That the petitioner proposes waivers of the following to expand
an existing ~otel:
~a) SECTION 18.06.060.0243 - Minimum number of parking spaces
and 18.48.066.050 (300 spaces required; 221 s

proposed)
~b) SECTION 18.48.062.011 - Maximum structural hei ht
(25 1/2 feet permitted 51 feet from
single-family residential zoning; 26 1/2
feet proposed).
2• That the above-mentioned waivers are hereby granted on the basis
that at the public hearing the petitioner stipulated to: (1) eliminate four
units or. the third floor of Huildings A and B, (2) eliminate the balconies at
the southern end of Buildings A and B, (3) provide a 10-foot landscaped strip
adjacent to the residences to the ~outh, (4) provide an 8-foot block wall
along the southern property line, and (5) provide a master television antenna
system to improve reception to the residences to the south if the proposed
construction interferes with said reception.
3• That there are :xceptional or extraordinary circumstances or
conditions applicable to the property involved or to the intended use of the
property that do not apply generally to the groperty or class of uce in the
same vicinity and zone.

4• That the requested variance is necessary for the preservation
and enjoyment of a substantial property right possessed by other property in
the same vicinity and zone, and denied to the property in question.
5• That the requested variance will not be materially detrimental
to the public welfare or injurious to the prcperty or improvements in such
vicinity and zone in which the property is located.
6• That 5 persons indicated their presence at said public hearing
in opposition; and that no correspondence was rer_eived in opposition to
subject petition.
ENVIRONMENTAL ZMPACT FINDING: That the Ar.aheim City Planning
Commission has reviewed the proposal to expand an existing motel with waivers
of minimum number o: parking spaces and maximum structural height on a
rectangularly-shaped parcel of land consisting of approximately 4.0 acres
located at the southwest corner of Katells Avenue and West Street, having
approximate frontages of 268 feet on the south side of Katella Avenue and 575
feet on the west side of West Street and further described as 1110 West
Katella Avenue (Inn of Tomorrow); and does hereby approve the Neqative
Declaration from the requirement to prepare an environmental impact report on
the basis that there would be no significant individual or cumulative adverse
environmental impact due to the approval of this Negative Declaration since
the Anaheim General Plan designates the subject property for co~mnercial
recreatiott land uses commenaurate with the proposal; that that Initial Study
submitted by the petitioner indicates no significant individual or cumulative
adverse environmental impacts; and that the Negative Declaration
substantiating the foregoing findings is on file in the City of Anaheim
Planning Department.
NOF1. THEREFORE, HE IT RESOLVED that the Anaheim City Planning
Commissian does hereby grant subject Petition for Variance, upon the following
conditions which are hereby ffluZa ~Q be a n~cessary prerequisite to the
proposed use of the subject property in order to preserve the safety and
general welfare of the Citizens of the City of Anaheim:
1. That the existing unused driveway on West Street at the most
southerly end of the subject property shall be removed and replaced
with e standard curb, qutter and sidewalk.
2. That tzash storage areas shall be provided in accordance with
aPprove.i plans on file with the Office of the Executive Director of
public Works.
3. That the westerly drivew.:y on Katella Avenue shall be relocated and
the southerly driveway on Weat Street shall be redeaigned as required
bY tho City Traffic Engineer.
4. That the existing handicapped parking stalls shall be relocated
closer to the existing buildings as required by the City Traffic
Engineer.

5. That subject property shall be developed substantially in accordance
with plans and sperifications on file with the City of Anaheim marked
Exhibit Nus. 1 through 6; provided, however, that the pe*.itioner
shall (a) eliminate four units on the third floor :,f Buildings A and
B~ (b) eliminate the balconies at the southern end of Buil.dings A and
B, (c) provide a 10 foot wide lan3scaped strip aiijacent to the
residences to the south, (d) provide an 8-foot block wall along the
southern property line, and (e) provide a master television antenna
system.
6. That Condition Nos. 1, 2, 3, 4, 5 and 6, above-mentioned, shall be
complied with prior to final buildinq and zoning inspec~iotts.
BE IT FURTHER R~SOLVED that the r:iaheim City Planning ~ommission does
hereby find and determine that adoptirn of this Resolution is er.pressly
predicated upon applicant's compliance with eaah and all of the conditions
hereinabove set forth. Should any such condition, or any part thereof, be
declared invalid or unenforceable by the final judgment of any court of
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is signed and approved by me this 13th day of
December, 1982.
