WHEREAS~ the City Planning Cortmissian did hold a pub)Ic h~aring at the ~ity
Fla11 Fn [1~e Cit-y of Anaheim on March 22, 1932~ at 1:3~ p.m.~ notice of said public
hearing having been duly given as required by la~a anri in accordance with the
provisions of the Anaheim Muntcipal Code, Chapter 13.03. to hear and consider
evidence for and against said proposed condttional use permit and to investtgate and
make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigatic~ and study made
by itself and in its behalf, and after c!ue consideration of ali evldence and reports
offered at said heartng~ does find and determine the following facts:
1. That the proposed use is proper)y one for which a conditional use

denial would deprivc subject property of a privilege en.joyed hy other property in the
same zoning classification.

3. That the requested waiver (b) is hereby grante~l on the basis tliat the
minimum landscaped setbacl< shall be eight (8)feet ~~ide and tliat all parking areas
shall be densely landscaped witii mature trees and shrubs to adequately screen the
parking from ad_jacent streets and residential areas.
4. That the proposed use will not adversely affect the adJoining land uses
and the growth and development of the area in which it is pro~osed to be located.
5. That the size and shape of the site proposed for the use is adequate to
ailow tlie full development of the proposed use in a manner not detrimental to the
particular area nor to the peace, health, safety, and general welfare of the Citizens
of the City of Anaheim.
6. That the granting of the Conditional Use Permit under the conditions
imposed, if any, wi11 not be detrimental to the peace, he~lth, safety and general
welfare of the Citizens of the City of AnaPieim.
7. That tlie traffic generated by the proposed use will not impose an undue
burden upon the streets and highways designed and improved to carry the traffic in
the area.
£3. That 3 persons indicated their presence at saii public hearing in
opposition; and t5at no correspondence ~aas received in opposition to the subject
petition.

previously certified by the City Council on ~larch 16, 1g82, in conjunction with
General Plan Amendment ldo. 163.
fJOIJ, THEREFORE, BE IT RESOLVED tfiat the An~heim City Planning Commission
does hereby grant subject Petition for Conditional Use Permit, upon the foilowing
conditions which are hereby found to be a necessary prerequisite to the proposed usa
of the subject property in order to preserve the safety and general weifare of the
Citizens of the City of Anaheim:
1. That this Conditional Use Permit is granted subject to the completion of
Reclassification IJo, f31-32-16, rto~~r pending.
2. That subject property shall be developed substantially in accordance with
plans and specifications on fiie with The City of l~naheim marked Exhibit
Nos. 1 through 13,
BE IT FURTHER RE50LVED that the Anaheim City Planning Commisston does hereby
find and determine that the adoption of this ~esolution is expressly predicated uoon
applicant's compliance witli each and a)i of the conditions hereinabove set forth.
Should any condition or any part thereof, be declared invalid or unenforceable by the
final judgment of any court of competent jurisdiction, then this Resolution, and any
approvals herein contained, shall be deemed null and void.
