WHEREAS, the City Planning Commission did hold a public hearing at the City
1~a11 in the City of Anaheim on March 22, 1982, at 1:30 p,m., notice of said public
liearing having 5een duly given as required by lav~ and in accordance a~ith the
provisions of the .4naheim Flunicipal Code, Chapter 13.03, to hear and consider
evidence for and against said proposed conditional use permit and to ~nvestigate and
make findings and recommendations in connection therewith; and
WIiFREAS. said Commission, after dur. insper.tion, invr_stigation and study made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing, dor_s find and determine the followi~9 facts:
1. Tiat the proposed use is properly one for which a conditional use
permit is autliorized by Anaheim !lunicipal Code Section 13.n3,030.p10 to tiait: To
retain the commercial use of a restdential structure.
2. That the proposed use, consisting of the stora~e of stationary supplies
and corporate records, is granted for a period of ane year with pnssih)e er.tensFons
of time if it is determined that the use has not had an adverse affect on the
surrounding residences.
3. That the proposed use will not adversely affect the adjoining )and uses
and tlie growth and development of the area in o-~hich it is proposed to be located.
'*. That the size and shape of the site proposed for the use is adequate to
allow the full development of the proposed use in a manner not detrimental to the
particular area nor to tlie peace, tiealth, ~fety, and general ~aelfare of the Citizsns
of tlie C i ty of Anahe im,
5. That the granting of the Conditional Use Permit under the conditions
imposed, if any, will not be detrimental to the peace, tiealth, safety and general
weifare of the Citizens of the City of Anaheim,
6. That the traffic generated by the proposeci use ~vill not impose an undue
burden upon the streets and highways designed and improved to carry the traffic in
the area.

7. That no one inJicated their presence at said public hearing in
opposition; and that no correspondence was received in opposition to the subject
petition.
E~JVIRQIl19E~JTAL IMPACT FItJDItdG: That t!ie Anaheim City Ptanning Commission has
~eviewed the proposal to retain the commercial use of a resi~iential structure on a
rectangularly-shaped parcel of land consisting of a~proximateiy 7,3~~ square feet,
having a frontage of approximately 71i feet on the east side of Varna Avenue,
approximately 11$ feet north of the centerline of I:atella Avenue (17~~4 South Varna
Avenue); and does herrby approve the Negative Declaration fr~m the requirement to
prepare an environmental impact report on the basis that there would be no
significant indivi.:ual or cumulative adverse environmental tnpact due to the approval
of this We9ative Declaration since the Analieim General Plan designates the subJect
Property for lo~a density residential land uses commensurate ioith the proposal; that
no sensitive environmental impacts are involved in the proposal; that the Initiai
Study submitted by the petitioner indicates no significant individual or cumulative
edverse environmental impacts; and that the Plegative Declaration substantiating the
foregoing findings is on file in the City of Anaheim Plannin~ Oepartment.
~~Ob/, TI~EREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Conditional Use Permit, upon the following
~onditions ~~~~~ch are hereby found to be a necessary prr_requisite to the proposed use
of the subject property in order to preserve the safety and g~neral welfare of tlie
Citizens of the City of Anaheim:
1. That the oam er(sj of subject pr~perty sliall pay t!ie difference between the
rnsidential and commercial traffic signal assessment fees (Ordinanee No.
333~) ~`ar an area of g06 square feet, in an amount as determined by the City
Council.
2. That the existing structure shal) be brought up to the minimum standards of
tlie City of Anaheim, including the Uniform Quilding, Plumbing, Electrical~
Mechanical and Fire Codes as adopted by the City of An~heim.
3. Tfiat subject property shall be developed substantially in accordance with
p)ans and specifications on file ~•~ith the City of Anaheim marked [xhibit No.
1.
tF, That Condition ilos. 1, 2, and 3, above-mentioned, sliall be completed within
a period of sixty ~~0) days of approval by the Planning Commissio~ or no
later tlian Apri 1 22, 1982,
5~ That the proposed commercial use, consisting of tlie storage of stationary
supplies and corporate records, stiall be granted for a period of one (1)
year ~vith, possible extensions of time if it is determined that the use has
not had an adverse affect on surrounding land uses. Requests for extensions
of time shall be made in writing to the Planning Commission.
BE IT FURTHER RESOLVEU that the Anaheim City Planning Commission does hereLy
find and determine that adoption of this Resolution is expressly predicated upon
aPplicant's ~anpliance witli each and all of the conditions hereinabove set forth.
Sliould any such condition, or any part thereof, be declared invalid or unenforceable
bY the final judgment of any court of competent jurisdiction, then this Resolution,
and any approvals herein contained, shall be deemed null and void.
