Wf1EREAS, the City Ptanning Commission did hold a puhlic heartng at the City
Hall in the City of Anaheim on April 5, 1982, at 1:30 p.m., notice of said public
hearing having been duly given as required by law and in accordance with the
provisions of the Anaheim Municipal Code, Chapter 18,03, to hear and consider
evidence for and against said proposed conditional use permit and to investigate and
make findings and recommendations in connection therewith; and
4JIIEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and afiter due consideration of all evidence and reports
offered at said hcaring, does find and determine the followtng facts:

1. That the proposed use is properly one for which a conditional use
permit is authorized by Ar~aheim t1unicipal Code Section 1i.44,050,010 to s~it: to
permit on-salr_ beer and roine in an existing restaurant.
2. That tlie proposed use wiil not adversely affect the adjoinin9 land uses
and the growth and development of the area in which it is proposed to be located.
3. That the size and shape of the site proposed for the use is adequate .`.o
allow the full development of the proposed use in a manner not detrimental to the
particular area nor to the peace, health, safety, and general welfare of the Citizens
of the City of Anaheim.
4. That tlie granting of the Conditiorzal Use Permit under the conditions
imposed, if any, ~oill not be detrimental to the peace, health, safety and general
welfare of ttie Citizens of the City of Anaheim,
5. Tliat the traffic generated by tfie proposed use ~•~i 11 not impose an undue
burden upon the streets and highways designed and improved Yo carry the traffic in
the area.
6. That no one indicated their presence at said public hearing in
opp~sition; and that no correspondence was received in opposition to the subject
petition.
ENVIRONt~ENTAL IPiPACT PIPlDIIJG: The Planning Director or his authorized
representative has determined that the proposed project falls a~ithin the definition
of Categorical Exemptions, Class 1, as defined in the State EIR Guidelines and is,
therefore, categorically exempt from the requirement to prepare an EIR,
NOW, TIiEREFORE, E3E IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Conditiona) Use Permit, upon the following
conditions which are f,ereby found to be a necessary prerequisite to the proposed use
of the subject property in order to preserve the safety and general welfare of the
Citizens of the City of Anaheim:
1. That subject property shall be developee+ substantially in accordance with
plans and specifications on file with the City of Anaheim marked cxhibit
IJos. 1 and 2.
[3~ IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby
find and determine that adoption of this Resalutic~n is expressly predicated upon
applicant's compliance with each and all of the conditions heretnabove set forth.
Should any such condition, or any part thereof, be declared invalid or unenforceable
by the final judgment of any court of competent jurisdiction, then this Resolution,
and any approvals herein contained, shall be deemed null and void.
THE FOREGOItJG RESOLUTION is signed and approved by me this 5th day of April,
