lJiiEREAS, said Commission, after dur inspection, inv~sti~ation and study made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing, does find and determine the follo~oin~ facts:
1. That tlie petitioner proposes rrclassification of subjr.ct property from
the RS-10,000 (Residential, Singlc Family) Zone to tlie P,i1-12t)0 (Residential, Multi~le
Family} Zone.
2. That the /lnaheim General Plan designates silbject property for low-
density residential land uses.
3. That tfie proposed reclassification of subjr.ct property is necessary
ar.d/or desirable for the orderly and proper development of the community.
4. That tlie proposed reclassification of subject property does properly
relate to the zones and their permitted uses locally established in close proximity
to subject property and to tlie zones and ti~cir permitted uses generally established
throughout the community.
5. That the proposed reclassification of subjr_ct property requires the
improvement of abutting streets in accordance ioith the Circulation Element of the
General Plan, due to the anticipated increase in traffic o-rhich will be generated by
the intensification of land use.
~. That no one indicated tlieir presence at said public hearing in
opposition; and that no correspondence was received in opposition to the subject
petition.
ENVIRONMENTAL 1~1PACT FIi~DIUG: That the Anaheim City Planning Commission has
reviewed tlie proposal to reclassify subject property from the RS-10,000 (Residential,
Single-Family) Zone to the RM-1200 (Residential, tlultiple-Family) Zone to permit a
100-unit senior citizens housin9 complex with waivers of maximum structura) hetght,
minimum floor area per dweliing unit and minimum number and type of parking spaces on
an irre,ularly°shaped parcel of land consisting of approximately 5,6 acres, having a
f rontage of approximately 3l~0 feet on the east side of L~ara Street, and being
located approximately 585 feet north of the centerline of North Street (730-810 IJorth
Loara Street); and does hereby approve the Negative Declaration from the requirement
to prepare an environmental impact report on the basis that there would be no
significant individual or cumulative adverse environmental impact due to the approval
of this i~egative Declaration since the Anaheim General Plan designates the subject
property for low-density residential land uses commensurate ~oith the proposal; that
no sensitive environmental impacts are involved in the proposal; that the Initial
Study submitted by the petitioner indicates no significant individu~l or cumulative
adverse environmental impacts; and that the IJegative Declaration substantiating tlie
fcregoing findings is on file in tlie City of Anaheim Plannin~ Department.
~~QW, T~IEREFORE, I3E IT RESOLVED that t?ie Anaheim City Planning Commission
does hereby grant subject Petition for Reclassification and, by so doing, that Title
13-Zoning of the Anaheim Ptunicipal Code be amended to exclude the above-described
property from the RS-10,0UU (Residential, Single-Family) Zone and to incorporate sai~
described property into the R~1-12~J0 (Residential, Multiple-Family) 7_one upon the
followiny r.onditions which are hereby found to be a necessary prerequisite to the
proposed use of subject property in order to preserve the safety and gene~al ~ael`are
of the Citizens of the City of Anaheim:

That street ligfiting facilities along Loara Strr.et shall be installed as
required by tiie Office of the Utilities General Idanager in accordance with
specifications on file in tlie Office of Utiliiies General 1lanager; and that
security in tlie form of a bond, certificate of deposit, letter of credit, or
cash, in an amount and form satisfactory to the City of Anaheim, shall be
posted with the City to guarantee the satisfactory completion of the above-
mentioned improve~ents. Said sr_curity shall be posted with the City prior
to approval of bui ding permits. Tlie above-require~i improvements shall be
installed prior to occupancy.
2. That the owner(s) of suhject property shall pay to the City of Anaheim a
fee, in an amount as determined by the City Council, for tree planting
purposes along Loara Street.
3. That trash storage areas shall be provided in accordance ~~~ith approved plans
on file with the Office of the Executive Director of Public Works.
4. That fire hydrants shall be installed and charged as required and det~rmined
to be necessary by the Chief of the Fire Department prior to commencement of
structural framing.
5. That subject property shall be served by underground utilities.
6. That drainage of subject property shall be disposed of in a manner
satisfactory to tiie City Engineer.
7. That the o~aner of subject property shall pay to the City of Anaheim the
appropriate park and recreation i~-lieu fees as detr.rmined to be app~opriate
by the City Council, said fees to be paid at the time the building permit is
issued.
$, That the owner(s) of suhject property shall p~y the traffic signat
assessment fee (Ordinance tJo. 3396) in an amount as determined by the City
Cauncil, fcr each new CiLlCJ~IR,cj unit prfor to t'ze issuanee of a buFlding
permit.
9. That completion of these reclassification proceedings is contingent upon the
granting of Conditional Use Permit No. 2361.
1U. 7hat subject property shall be developed substantially in accordance aiith
pians and specifications on file with the City of Anaheim marked Exhibit
Nos. 1 through 7 provided, ho~vever, that the minimum dwelling unit size
shall be 54~ square feet and L•he parking shall minimally consist af 50
covered and 50 open spaces.
11. That the location of any proposed security gates shall b~ subject to the
approval of the City Traffic Engineer.
12. That prior to tlie intr~duction of an ordinance rezoning subject property~
Condition No. 2, above-mentioned, shall be completed. The provisions or
rights granted by this resolution shall become null and void by action of
the Planning Commission unless said conditions are complie~l vrith a~ithin one
year from the date hereof, or such further time as the Planning Commission
may grant.

with prior to final building and zoning inspections.

find and determine tliat the adoption of this Resolution is e:cpressly predicated upon
applicant's compliance tvith eacii and al) of the conditions hereinabove set forth.
Should any condition or any part thereof, be dr_clared invalicf or unenforceabie by the
final judgment of any court of competent jurisdiction, then this Resolution, and any
approvals herein c~ntained, shall be deemed null and void,
