A RESOLUTZON OF THE ANAHEIM CITY PI,ANNING COMMISSION
THAT PETITION FOR CONDITiONAL USE PERMIT N0. 2443 BE GA,ANTED
WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit from SHIRISHBABU H. PATEL, ET AL., 2145
South Harbor Boulevard, Anaheim, California 92802, owners of certain real
property situated in the City of Anaheim, County of Orange, State of
California, described as:
PARCEL 1:
THE SOUTH 100 FEET OF THE NORTHEAST QUARTER OF THE NORTHEAST
QUARTER OF THE SOUTHWEST QUARTER OF SECTION 27, TOWNSHIP 4
SOUTH~ RANGE 10 WEST, IN THE RANCHO SAN JUAN CAJON DE SANTA
ANA AND RANCHO LAS BOLSAS, AS SHOWN ON A MAP RECORDED IN BOOK

EXCEPTING THEREFROM THE WEST 330 FEET.
WHEREAS, the City Planning Commission did hol~? a public hearing at
the Civic Center in the City of Anaheim on June 1, 19A:S, at 1:30 p.m., notice
of said public hearing having been duly given as required by law and in
accordance with the pcovisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use
permit and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
following facts:
1. That the proposed use is properly one for which a conditional
use permit is authorized by Anaheim Municipal Code Section 13.44.050.160 to
wit: to permit expansion of an existing motel with waiver of:
SECTION 18.06.050.024 - Minimum number of parking spaces.
AND 18.44.066.050 (43 s aces required; 41 spaces proposed)
2. That the requested waiver is hereby granted on the basi~ that
the parking variance is minimal amounting to less than a 58 deviance from Code.
3. That the proposed use will not adversely affect the adjoining
land uses and the growth and development of the area in which it is proposed
to be located.
4. That the size and shape of the site proposed ior the use is
adequate to allow the full development of the proposed ~ise in a manner not
detrimental to the particular area nor to the peace, health, safety a.~d
general welfare of the Citizens of the City of Anaheim.

5. That the ~ranting of the Conditional Use Permit under the
conditions imposed, if any, will not be detrimental to the peace, health,
safety and general welfare of the Citizens of the City of Anaheim.
6. That the tiaffic generated by the proposed use will not impose
an undue burden upon the streets and highways designed and improved to carry
the traffic in the area.
7. That th? variance will not cause an increase in traffic
congestion in the immediate vicinity nor adversely affect any adjoining land
uses.
8. That the granting of the variance under the conditions imposed,
if any, will not be detrimental to the peace, health, safety or general
welfare of the citizens of the ~ity of Anaheim.
9. That one person indicated their presence at said public hearEng
in opposition; and that no correspondence was received in opposition to the
subject petition.
ENVIRONMENTAL IMPACT EINDING: That the Anaheim City Planning
Commission has reviewed th~ proposal to expand an existing motel with waiver
of mini~:um number of parking spaces on a rectangularly-shaped parcel of land
consi: ing of approximately 0.7 acre, having a frontage of approsimately 100
feet on the west side oi Harbor Boulevard, approximately 600 feet south of the
centerline of Orangewood Avenue and further described as 2145 South Harbor
Boulevard (Modernaire Motel); and does hereby approve the Negative Declaration
from the requirement to prepare an environ~ental imoact report on the basis
that there wauld be no significant individual or cumulative adverse
environmental impact due to the approva~ of this Negative Declaration since
the Anaheim General Plan designates the subject proper*_y for general
commercial land uses commensurates with the proposal; that no sensitive
enviconmental impacts are involved in the pruposal; that the Initial Study
submitted by the petitioner indicates no significant individual or cumulative
adverse environmental impacts; and ci~at ti~e tleyative Declaration
substantiating the foregoing findings is on file in the City uf Anaheim
Planning Department.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby grant subject Petition for Conditional Use Permit, upon
the following conditions Nhich are hereby found to be a necessary prerequisite
to the proposed use of the subject property in order to preserve the safety
and general ~aelfarE of the Citizens of the City of Anaheim:
1. That subject property sh ' be developed substantially in accordance
with plans and specifications on file with the City of Anaheim marked
Exhibit Nos. 1 through 4; provided, however, that kitchen efficiency
units may be installed in no ~ore than twenty-five percent (258) of
the motel units, with a maximum of 6-cubic foot refrigerators,
two-burner stoves excludin9 oven and bakin9 facilities, and single
compartment sinks, except that the manager's unit wi12 be allowed to
have full kitchen facilicies.
2. That prior to final building and zoning inspections, Condition No. 1,
above-mentioned, shall be complied with.

BE IT FURTNER RESOLVED that the Anaheim City Planning Commission doe3
hereby find and determine that adoption of this Resolution is exoressly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such conditions, or any part thereof, be
declared invalid or unenforceable by the final judgment of any court ef
aompetent jurisdiction, then this Resolu*_ion, and any approvals herein
contained, shall be deemed null and void.
THE FUREGOIN~ RESOLUTION is signed and approved by me this lst day of
