A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETIiION FOR RECLASSIFICATION N0. 82-83-34 BE GRANTED
WHEREAS, the Anaheim City Planning Commission did receive a verified
petition for Reclassification from WILL D. AND LUCILLE C. PICXEREL, 2752 West
Ball Road, Anaheim, California 92804, ownecs, and ALVIN A. SUGARMAN, 8071
Slater Avenue, Suite 210, Huntington eeach, California 92647, agent of certain
teal property situated in the City of Anaheim, Cuunty of Orange, State of
California, described as follows:

WH~REAS, the City Planning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on June 13, 1983 at 1:30 p.m., notice
of said public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code. Chapter 18.03,
to hear and consider evidence for and against said proposed reclassification
and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, anc' after due consideration of all
evidence and reports offered at said hearing, does find and determine the
foZlowing facts:
1. That the petitioner proposes reclassification of subject
property from the RS-A-43,000 (Residential, Agricultural) Zone to the RM-1200
(Residential, Multiple-Family) Zone to construct a 22-unit apartment compl.ex.
2. That the Anaheim General Plan designates subject property for
medium density residential land uses.
3. That the proposed reclassification of subject property is
ner.essary and/or desirable for the orderly and proper development of the
community.
4. That the proposed reclassification of subject pr.operty does
properly relate to the zones and their permitted uses locally established in
close proximity to subject property and to the zones and their permitted uses
generally established throughout the community.
5. That the proposed reclassification of subject property requires
the improvement of abutting streets in accordance with the Circulation Element
of the General Plan, due to the anticipated increase in traffic which will be
generated by the intensification of land use.

6. That no one indicated their presence at said public hearing in
opposition; and that no correspon~Jence was received in opposition to subject
petition.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to reclassify subject property from the
RS-A-43,000 (Residential, Agricultural) Zone to the RM-1200 (Residential,
Multiple-Family) Zone to construct a 22-unit apartment complex on a
rectangularly-shaped par~~l of land consistiny of approxi.mately 0.8 acre
located at the southeast corner of Ball Road and Sharon Circle, and further
described as 2752 West Ball Road; and does hereby approve the Negative
Declacation from the requisement to prepare an enviconmental impact report on
the basis that there would be no significant individual or cumulative adverse
environmental impact due to the approval of this Negative Declaration since
the Anaheim Genecal Plan designates the subject property for medium-density
residential land uses commensurate with the proposal; ttiat no sensitive
environmental impacts are involved in the proposal; that the Initial Study
submitted by the petitioner indicates no significant individual or cumulative
adverse environmental impacts; and that the Negative Declaration
substantiating the foregoing findings is on file in the City of Anaheim
Planning Department.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby grant subject Petition for Reclassificatian and, by so
doin9, that Title 18-ZOning of the anaheim Municipal Code be amended to
exclude the above-described property from the RS-A-43,000 (Residential,
Agricultural) Zone and to incorporate said desccibed property into the RM-120D
(Residential, Multiple-Family) Zone upon the following conditions which are
hereby found to be a necessary prerequisite to the proposed use of subject
property in order to preserve the safety and general welfare of the Citizens
of the City of Anaheim:
1. That the owner of subject property shall pay to the City of Anaheim a
fee for street lighting alonq Ball xoad and Sharon Circle in an
amount as determined by the City Council.
2. That the owner of subject property shall pay to the City of Anaheim a
fee for tree planting ourposes along Ball Road and Sharon Circle in
an amount as determined by the City Ceuncil.
3. That prior to issuance oP a building permit, appropriate water
assessment fees shall be paid to the City of Anaheim, in an amount as
determined by the Office of the Utilities General Manager.
4. That prior to issuance of a building permit, appropriate park and
recreation in-lieu fees shall be paid to the City oF Anaheim in an
amount as determined by *.he City Council.
5. That prior to issuance of a building permit, the appropriate traffic
signal assessment fee shall be paid to the City of Anaheim in an
amount as determined by the City Co~ncil for eacii new dwellin9 unit.
6. That the owner of subject property shall recor9 an irrevocable offer
of dedication to the City of Anaheim for a strip oi land 53 feet in
width from the centerline of tiie street along Ball Road and 30 feet
in width from the centerline of the street alon~ Sharon Circle for
street widening nurposes.

7. That drainage of subject property shall be disposed of in a manner
satisfactory to the City Engineer.
8. That subject property shall be served by underground utilities.
9. That prior to commencement of structural framing, fire hydrants shall
be installed and charged as required and determined to be necessary
by the Chief of the I'ire Department.
10. That trash Storage areas shall be provided in accordance with
approved plans on file with the Street Mai~tenanre and Sanitation
Division.
11. That sidewalks shall be installed along Sharon Circle as required by
the City Engineer and in accordance with standard plans and
specifications on file in the Office of the City Engineer.
12. That prior to the issuance of building permits, the design and width
of all ariveways shall be reviewed and approved by the City Traffic
Engineer.
13. That gates shall not be installed across any driveway or private
street in a manner which may adversely affect vehicular traffic in
the adjacent public streets. Installation of any gates within a
distance of forty (40) feet from said public street rights-of-way
shall be subject to the review and approval of the City Traffic
Engineer.
14. That prior to issuance of building pecmits, the applicant shall
present evidence satisfactory to the Chief Building Inspector that
the proposed project is in conformance with Council Policy Number 542
"SOUnd Attenuakion in Residential Projects".
15. That sutject property shall be developed substantially in accordance
wiEh plans and specifications on file with the City of Anaheim marked
Exhibit Nos. 1 and 2.
16. That prior to the introduction of an ordinance rezoning subject
property, Condition Nos. 1, 2 and 6, above-mentioned, stiall be
completed. The provisions or rights granted by this resolution shall
become null and void by action of the Planning Commission unless said
conditions are complied with within one year from the date of this
resolution, or such further time as the Planning Commission may grant.
17. That prior to final building and zoning inspections, Condition Nos.
7, 8, 10, 11 and 15, above-mentioned, shall be complio~l with.
BE IT FURTHER RESOLVED that the Anaheim City tlanning C~_..imission does
hereby find and determine that adoption of this Reso.lution is expressly
predicated upen applicant's compliance with each and '1 of the conditions
hereinabove set forth. Should any such condition, o: iy part thereof, be
~eclared invalid or unenforceable by tne final judgemnt of any court of
competent jurisdiction, then this Resolution, anc any approvals herein
contained, shall be deemed null and void.
