A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSIUN
THAT PETI'PION FOR ~ONDITIONAL USE PERMIT NO. 2453 BE GRANTED
WHEREAS, the Anaheim City Planninq Conmission did receive a verified
Petitioa for Conditional Use Permit from MARCEL G. AND EDNA V. MAYER, 4550
Flowing Wells Road, #175, Tuscon, Arizona 85705, owners of certain real
property situated in the City of Anaheim, County of Orange, State o`
California, described as:
THE EAST 65 FEET OF THE WEST 130 FEET OF THE NORTH 250 EEET
OF LOT 5~ SECTION 4 TC~WNSHIP 4 SOUTH, RANGE 10 WEST, AS
SHOWN nN A RECORD EILED IN BOOK 1, PAGE 55 OF OFFICIAL
RECORDS OF SAID COUNTY.
WHEREAS, the City Planning Commission did hold a public hearir.g at
the Civic Center in the City of Anaheim on June 13, 1983, at 1:30 p.m., notice
of said pu~lic hearing having been duly given as required by law ar.@ in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and ccnsider evidence foc and against said proposed conditional use
petmit and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspPCtion, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
following facts:
1. That the proposed use is pcoperly one for wh~ch a conditional
use permit is authosized by Government Code Section 65852.1 l-o wit: to retain
a second-family (granny) unit.
2. That the prooosed use will nut adversely affect the adjoininq
land uses and the gro~rth and development of the area in which it is proposed
to be located.
3. That the size and shape of the site proposed for the use is
adequate *_o allow the full development of the proposed use in a manner not
detrimental to the particular area nor to the peace, health, safety and
general welfare of the Citizens of the City of Anaheim.
4. That the granting of the Conditional Use Permit under rhe
conditions imposed, if any, will not be detrimental to the peace, health,
safety and general welfare of the Citizens of the City of Anaheim.
.. That the traffic generatad by the proposed use will not impose
an undue burden upon the streets and highways designed and improved to carr~
the traffic in the area.
6. That one person indicated their presence at said public hearing
in opposition; and that no correspondence was received in opposition to tt,e
~ubject petitiun.

ENVIRONMENTAL I19pACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to retain a second-family (granny) urit
on a rectangularly-shaped ~arcel of ]and consisting of approximately 9,744
square feet, located at the southwest corner of Romneya Drive and Cherry Way,
and further described as 1232 West Romneya Drive; and does hereby approve the
Negative Declaration from the requirement to prepare an environmental impact
report on the basis that there would be no significant i~dividual or
cumulative adverse environmental impact due to the approval of this Negative
Declaration since the Anaheim General Flan designates the subject property for
med:um density residential .Land uses commensurates with the proposal; that no
sensitive environmental impacts are involved in the propo~al; that the Initial
Study submitted by the petitioner indicates no significant individual or
cumulative adverse environmental impacts; and that the Negative Declaration
substantiating the foregoing findii~js is on file in the City of Anaheim
Planning Department.
NOW, THEREFORE, BE ZT RESOLVED that the Anaheim City Planning
Commission does hereby grant subject Pet_ition for Conditional Use Permit, upon
the following conditions which zre hereby found to be a necessary prerequisite
to the proposed use of the su~ject property in order ko preserve the safety
and general welfare of the Citizens of the City of Anaheim:
1. That the exi~ting structur? shall be brought up to the minimum
standards of the City of Anaheim, incJuding the Uniform Building,
Plumbing, Electrical, Housing, Mechanical und Fire Codes as adopted
by the City of Anaheim.
2. That appropciate water assessment fees shall be paid to the City of
Anaheim, in an amount as determined by the Gffice of the Utilities
General Manaqer.
3. That the occupancy of the granny unit shall be limited to une or two
adults both of whom are sixty (60) years of age or older.
4. That the ownec(s) of subject property shall record a covenant against
the pcoFerty cestricting the occupancy of the granny unit to one or
two adults sixty (60) years of age or older. Said ccvenant shall be
submitted to the Planning Department for transmittal to the City
Attorney's Office for review and approval prior to recordation.
5. That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim marked
Exhibit Nos. 1 and 2.
6. That Condition Nos. 1, 2, 4 and 5, above-mentioned, shall be
completed withi~i a period of 90 days from the date c: this resolution.
BE IT FURTAER RESOLVED that the Anaheim City Planning Commission does
hereby find and determine that adoption of this Resolution ia exFressly
predicated upon applicant's complian~e with each and all of the conditions
hereinabove set forth. Should any such conditions, or any part thereof, be
declared invalid or unenforceable by the final ju3qment of any c~urt of
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
