A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR CONDITIGNAL USE PERMIT N0. 2456 BE GRANTED
WHEREAS, tl-e Anaheim City Planninq Commission did ceceive a verified
Petition fo: Conditional Use Permit from LEASE-ALL LA PALMA, P. 0. Box 4604,
Anaheim, California 92803, owner, and THE LEAVERTON COMPANY, P. 0. Box 4604,
Anaheim, CaliEor~ia 92803, agent of certain real property situated in the City
of Anaheim, County of Orange, State of California, described as:
PARCEL 2, AS SHOWN ON A PARCEL MAP FILED IN BOOK 170, PAGES
37 AND 38 OF PARCEL MAPS, IN THE OFFICE OF THE CO~NTY
RECORDER OF SAID COUNTY,

WHEREAS, the City Planning Commission did hold a public heariny at
the Civic Center in the City of Anaheim on June 27, 1983, at 1:30 p.m., notice
of said public hearing having been duly giver. as required by law and in
accordance with the pravisions of the Anaheim Municipal Code, Chapter .i8.03,
to hear and consider evidence for and against said proposed conditional use
permit and to investigate and make findings and recommendations in connection
therewith; said public hearing having been continued to the Planning
Commissiun meeting of July 11, 1983; and

WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and renorts offeced at said hearing, does find and determine the
following facts:
1. That the proposed use is properly one for which a conditional
use permit is authorized by Anaheim Municipal Cude Section 16.61.050.605 to
wit: to permit commerci.al Uses in the ML (Industrial, Limited) Zone.
2. That the proposed uses shall be limited to the specific uses
listed on "Attachment A".
3. That tne proposed uses as shown on "Attachment A", as proposed
by the petitioner, will be compatible with and primarily serve the industrial
community.
4. That the proposed use will not adversely affect the adjoining
land uses and the growth and development of the area in which it is proposed
to be located.
5. That the size and shape of the site proposed for the use is
adequate to allow the full development of the proposed use in a manner not
detrimental to the particular area nor to the peace, health, safety arid
general welfare of the Citizens of the City of Anaheim.
6. That the granting of the Conditional Use Permit under the
conditions imposed, if any, will not be detrimental to the peace, health,
safety and general welfare oi the Citizens of the City of Anahe.im.
7. That the traffic generated by the proposed use will not impose
an undue burden upon the streets and highways designed and improved to carry
the traffic in the area.
8. That no one indicated their presence at said public hearing in
opposition; and that no correspondence was received in opposition to the
subject petition.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to permit commercial uses in the ML
(Industrial, Limited) Zone on an irregularly-shaped parcel of land consistiag
of approximately 5.8 acres, having approximate frontages of 335 feet on the
east side of Van Buren Street and 584 feet on the north side of La Palma
Avenue, being located approximately 535 feet south of the centerline of
Leaverton Court; and further described as 1200 North Van Buren Street, and
4025, 4051, 4055, 9061 and 4065 East La Palma Avenue; and does hereby approve
the Negative Declaration from the requirement to prepare an environmental
impact report on the basis that there would be no significant individual or
cum~ilative adverse environmental impact due to the approval of this Negative
Declaration since the Anaheim General Plan designates the subject property for
general industrial land uses commensurate aith the proposal; that no sensitive
environmental impacts are involved in the proposal; that the Initial Study
submitted by the petitioner indicates no significant individual or cumulative
adverse environmental impacts; and that the Negative Declaration
~ubstantiating the foregoing findings is on file in the City of Anaheim
Planning Department.

NOW, THEREFORE, BF, IT RESOLVED that the Anaheim City Planr:ing
Commission does hereby grant subject Petition for Conditional Use Permit, upon
the following conditions which are hereby found to be a necessary prerequisite
to the proposed use of the subject property in order to preserve the safety
and general welfare of the Citizens of the City of Anaheim:
1. That prior to issuance of a building permit, appropriate water
assessment fees shall be paid to the City of Anaheim, in an amount as
determined hy the Uffice of the Utilities General Manager.
2. That prior to issuance of a building permit, a traffic signal
assessment fee equaling the difference between the industrial and
commercial assessment fees shall be paid to the City of Anaheim in an
amount as determined by the City Council.
3. That trash storage areas shall be provided in accordance with
approved plans on file with the Street Maintenance and Sanitation
Division.
4. That street lighting facilities along Van Buren Street and La Palma
Avenue shall be installed as required by the Utilities General
Manager in accordance with specifications on file in the Office of
Utilit:es General Manager, and that security in the form of a bond,
certificate of deposit, letter of credit, or cash, in an amount and
form satisfactory to the City of Anaheim, shall be posted with the
City to guarantee the satisfactory complel•ion of the above-men*_ioned
improvements. Said security shall be posted with the City of Anaheim
prior to approval of building permits. The above-required
improvements shall be installed prior to occupancy.
5. That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim marked
Exhibit Nos. 1 through 15.
6. That prior to final building and zoning inspections, Condition Nos.
3, 4 and 5, above-mentioned, shall be complied with.
7. That the commercial uses permitted on subject property shall be
limited exclusively to those uses approved by the Planning
Commission, and listed on "P.ttachment A".
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does
hereby find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such conditions, or any part thereof, be
declared invalid or unenforceable by the final judgment of any court o£
competent jurisdiction, then this .:esolution, and any approvals herein
contained, shall be deemed null and void.
