A RESOLUTION OE THE ANAHEIM CITY PLANNING COt4MISSION
AMENDING RESOLUT70N N0. PC82-].62 GRANTING COtdDITIONAL USE PERMIT
NO. 2366~ IN PART AND AMENDING CONDITIONS OF APPROVAL
WE~EREAS, oi~ September 8, 1982, the Planning Commis~ion granted
Corditional Use Permit No. 2366, Resolution No. PC82-162, to permit retention
of the contractors' storage yards with waiver ~f required lot frontage subject
to certain conditions being complied with on a rectangularly-shaped parcel of
land consisting of appruximately 1.5 acres, having a frontage of approximately
150 feet on the east side of Red Gum Straet, and further described as 1450
North Red Gum Street; and
WHEREAS, visual inspection of subject property on December !0, 1982,
by the Code Enforcement staff revealed that the conditions of approval were
not being complied with; and
WHEREAS, ti~e Anaheim City Planning Commission did '~ld a public
hearing at the Civic Center in the City of Anaheim on npril S, 1983, at 1:30
p.m. to consider revocation of Conditional Use Permit No. 2366, notice of said
public hearing having been duly given as required by la;~ a!id in accordance
with the provisions of the Anaheim Municipal Code, to hear and consider
evidence for and against said proposal to revoke Conditional Use Permit No.
2366, and to investigate and make findings and recommendations in connection
therewith; said public hearing was cor.tinued to the Pla,.ning Commission
meeting of July 25. 1983; and
WHEREAS, said Commission, after due inspection, i:~vestigation and
study made by itself and in its 6ehalf, and after due consideration of all
evidence and reports offered at said hearing, does hereby find:

er.clude the westerly oortion of subject property consisting of
0.5 acre, having a fruntage of 150 feet o~ the ea:;t side of Red
Gum Street.
2. :hat the ].egal description for Condition~al Use Permit No. 2366
shall be modified to covet only the easterly one (1) acre of
subject property as described in Exhibit A, attached.
3. That Condition Nos. 1, 5 and 6 shall be deleted because they do
not pertain to the parcel described in Exhibit A.
4. That Condition Nos. B, 9 and 12 shall be modified to cover the
easterly portion of the property only.
ENVIRONMENTAL IMPACT FINDING: That a Negative Declaration was
previously approved on Septembec 8, 1982, and no further action is necessary.
NOW, THEREFORE, BE IT kE50LVED that the Anaheim City Planning
Commission does heceby amend Resolution No. PC82-152 as follows:
1. That Lhe legal description for Conditional Uce Permit No. 2366
sha11 be modiEied to cover the easterly one (1) acre of subject
property descrzbed in Exhibit A attached.

2. That Condition Nos. 1, 5 and 6 ahall be delete9.
3. That r_ondition Nos. 8, 9 and i2 shall be modified to read ss
follows:
"8. That the owner of subject property st~all pay the traffic
signa] asse.ssment fee (Urdinance No. 3896) in an amount as
determined by the City Council for the easterly one tl)
acre of subject p:operty."
"9. That subject p~operl-y shall be developed sub~tantially in
conformance with plans and specifications on file with the
City of Anaheim marked Exhibit H~. 1, excluding, however,
the westerly 0.5 acre thereof."
"5. That ~undition Nos. 2, 3, 4, 7, 8, 9, 10 and 11 shall be
completed within a period of ninety (90) days from the
date hecein.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission
does hereby find 3nd determine that adoption of tnis Resolution is expcessly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such conditions, or any gart thereaf, be
declared invalid or unenforceable by the finai judgment of any court of
competent juris9iction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
THE FOREGOING RESOLUT;ON is signed and approved by me this 25th day
of July, 1983.
