A RESOLU'PION OF THE ANAHEIM CITY PLANNING COMMISSION
DELETING CONDITION N0. ]. OF R£.SOLUTION NO PC83-89
PERTAINING TO STREET LIGHTING FEES IN CONNECTION WITH
CONDITIONAL USE PERMIT NO. 2436
WHEREAS, the petitioner submitted a request for deletion of
Ccxidition ~, ] containe~ in P]anninq Commission Resolution No. PC83-89
adopted in connection with Conditional Use Permit ho. 2436 permitting on-sale
b eer anA wine in an existinq restaurant with waiver of minimum number of
parking spaces on an rectangularly-shapeA parcel of land consisring of
a pproximately 0.6 acre, havinq a frontage of approximate]y 200 feet on the
north side of La Palma Avenue, being locate6 approximately 350 feet west of
the center]ine of FUCIid Street and further Aescrihed as 1739 West Ia Pa1ma
Avenue; and
W HEREAS, the Anaheim City Planning Commission ~id ho7~ a public
hearing at the Civic Center in the City of Anaheim on July 25, 1983, at 1;30
p.m., notice of saiA public hearing having hePn Auly given as required by 7aw
and in accordance with the provisions of the Anaheim Municipal Code, to hear
an~ consider evi~ence for an~ against said proposa7 to amend the conditions of
approva Z of Conditiona 1 Use Permi t No . 2436 , an8 t o investigat e and mak e
finrlinqs anA recommenrlations in connec*ion therewith; and
WHERE4S, said Commission, afte r du e inspection, investigation and

evidence and reports offered at said hearing, does hereby find:
That ConAition No. 1 shall he AeleteA on the hasis thac the street
lighting fee should be deferr~d unti 1 such time as the property

redevelops the center. At that time, the owner will be required to
instal7 street liqhting along Ia Palma Avenue.
ENVIRONMENTAL IMPACT FINDING; Th e Plannin g Director or his
authorized representative has determined tha t th e proposed project falls
within the definition of Cateqorical F~cemptions, Class ?.1, as define~l in the
State EIR Guidelines and is, therefore, categ~rically exempt from the
re4uirement to prepare an FIR.
NfW, THEREFORE BE TT RESOLVED that the Anaheim Citv Planning
Commission does hereby delete Condition No. 1.
BE Im FURTHF,R RESOLVE'D that the Anaheim City Planning Commission
does hereby finc~ and determine that adoption of this Resolution is expressly
p re~icate~ upon applicant's compliance with each and all oF ti~e cond.itions
h~reinabove set forth. Should any such .unditions, or anv part thereof, be
~3eclared invalid or unenforceable hy the final iudgment of anv court of
competent jurisdiction, then this Resolution, and any approvalc herein
contained, sha]] be ~leeme~7 nul] and voiA.
