WHERGAS, said Commission, after due inspection, investigation and

1. That the proposed use is properly one for which a conditional
use permit is authorized by Anaheim Municipal Code Section 18.06.080 &
- 18.41.050.100 to wit: to expand an existing hospital facility with waiver of:

2. That the requested waiver is hereby granted on the basis that
the petitioner stipulated to record a covonant providing that if in the
future, the City of Anaheim conducts a traffic study and determines that
existing off-street parking is not adequate, the owner of the property shall
construct a parking structure or provide additional narking spaces in the
numbec and form as determined to be necessary by the City Traffic Engineer;
and that a faithful performance bond or other guarantee acceptable to the City
shall be posted in an amount as determined by the City Traffic ::ngineer to
guarantee installation of said parking facilities.
3. That the variance will not cause an increase in traffic
congestion in the immediate vicinity nor adversely affect any adjoining land
uses.
4. That the granting of the variance under the conditions imposcd,
if any, will not be detrimental to the peace, health, safety or 9eneral
welfare of the citizens of the City of Anaheim.
5. That the proposed use will not adversely affect the adjoining
land uses and the gruwth and deveiupwenL uC ti,c area ir, which it i~ propo~ed
to be located.
6. That the size and shape of the site proposed for the use is
adequate to ~llow the full development oE the proposed use in a mannet not
detrimental to the particular area nor to the peace, health, safety and
general welfare of the Citizens of the City of Anaheim.
7. That the qranting of the Conditional Use Permit under the
conditions imposed, i£ any, will not be detri~aental to the peace, health,
safety and general welfare of the Citizens of the City of Anaheim.
8, That the ttaffic generated by the pcoposed use will not impose
an undue burden upon the streets and highways designed and improved to carry
the traffic in the area.
9. That no one indicated their presence at said public heariri9 in
opposition; and that no correspondence was received in opposition to the
subject petition.

`;.>1 ENVIRONMENTAL IMPACT FINDING: That the Anaheim ~it
t:~.1 Commission has reviewed the proposal to expand an existing hospital facility
~' with waiver of minimum number of parking spaces on a irregularly-shaped parcel
~ of land con~istinq of appcoximately 9.2 acres located at the northwest corner
;,;j of Grange Avenue and Beach Boulevard, and further described as 3033 West
, Orange Avenue (West Anaheim Community Hospital); and does hereby approve the
Negative Declaration from the requirement to prepare an enviconmental impact
~`~ report on the basis that there would be no significant individual or
;' cumulative adverse environmental impact due to the approval of this Negative
;i
Declaration since the Anaheim General Plan des.ignates the subje~t property for
general commercial land uses commensurate with the proposal; that no sensitive
-? environmental impacts ace involved in the proposal; that the initial Study
z~ submitted by the petitioner indicates ao significant individual or cumulative
a.~ adverse environmental impacts; and that the Negative Declaration
substantiating the fcregoing findings is on file in the City of Anaheim
~F~ Planning Department.
NOW, THEREFORE, BE ZT RESOLVEP that the Anaheim City Planning
Commission does hereby grant subject Petition for Conditional Use Permit, upon
the following conditions which are hereby found to be a necessary prerequisite
to the proposed use of the subject property in order to preserve the safety
and general welfare of t~e Citizens of the City of Anaheim:
1. That prior to issuance of a building permit, the appropriate traffic
signal assessment fee shall be paid to the City of Anaheim in an
amount as detecmined by the City Council for new commercial
buildings.
Z• That prior to issuance of building permits, the owner(s) of subject
property shall submit evidence of a recorded reciprocal parking
agreement in a form as approved by the City Attorney, providing for
equal access to all parkin9 spaces on both the north and south sides
of Orange Avenue for the hospital and medical office uses.
3. ~rhat subject properl-y shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim
marked Exhibit Nos. 1 through 5.
4• That prior to final building and zoning inspections, Condition No.
3, above-mentioned, shall be complied with.
5• That prior to issuance of building pertnits, the owner of subject
property shall record a covenant in a form as approved by the City
Attorney providing that if ii: the future the City of Anaheim
conducts a traffic study and determines that existing off-street
parking is not adequate, the owner of the property shall construct a
parking structure or provide additional parking spaces in the number
and form as determined to be necessary by the City Traffic Engineer;
and that a faithful performance bond or a letter of credit or other
guarantee acceptable to the City shail be posted in an amount as
determined by the City Traffic Engineer to guarantee installation of
said parking facilities.

BE IT FURTHER RESOLVED that the A,~aheim City Planning Commission
does hereby find and determine thar_ adoption of thi~ Resolution is expressly
l•redicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such conditions, or any part thereof, be
declared invalid or unenforceable by the final judgment of any court of
competent jurisdiction, then this Resolution, and any approvals herein
containe~, shall be deemed null and void.
