A RESOLUTION OE THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR VARIANCE NO. 3343 BE DENIED
WHEREAS, the Anahe=m City Planning Commission did receive a verified
Petition for Variance from ALAN J. KOREN AND CARMEN A. KOREN, 6000 Avenida
Arbol, Anaheim, California 92807, owners, and RIK ZYBER, 212 Renoak, Anaheim,
California 92804, agent of certain real property situated in the City of
Anaheim, County of Orange, State of Ca.lifornia described as:
LOT 115 OF TRACT NO. 7419, AS SHOWN ON A MAP RECORDED IN
BOOK 343~ PAGES 27 TO 31, BOTH INCLUSIVE, OF MISCELLANEOUS
MAPS, RECORDS OF ORANGE COUNTY~ CALIFORNIA.
WHEREAS, the City Planning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on August 8, 1983, at 1:30 p.m.,
notice of said public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed variance and to
investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
following facts:
1. That the petitioner proposes waivers of the following to retain
a second-story addition to an existing single-family residence:
SECTION 18.27.062.021 - Maximum number of bedrooms.
(maximum 3 bedrooms permitted on a
5505 sq, ft. lot; 4 bedrooms
constructed)
2. That the above-mentioned waiver is hereby denied on the basis
that the petitioner did not demonstrate that a hardship exists due to the
size, shape, topogzaphy or surroundings of subject property.
3. That there are no exceptional or extraordinary circumstances or
conditions applicable to the property involved or to the intended use of the
property that do not apply generally to the property or class of use i.~ the
same vicinity and zone.
4. That the cequested variance is not necessary for the
preservation and enjoyment of a substantial property right possessed by other
pcoperty in the same vicinity and zone, and denied to the property in question.
5. That the requested variance will be materially detrimental to
the public welfare or injurious to L-he property or improvements in such
vicinity and zone in which the property is located.
6. That one person indicated her presence at said public hearing in
opposition; and that no correspondence was received in opposition to subject
petition.

ENVIRONMENTAL ItqPACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to retain a second-story addition to an
existing single-family residence with waiver of maximum number of bedrooms on
an irregularly-shaped parcel of land consisting of approximately 5,505 square
feet, having a frontage of appcoximately 58 feet on the south side of Avenida
Arbol, and further described as 6000 Avenida Arbol; and does hereby approve
the Negative Declaration fram the requirement to prepare an environmental
impact report on the basis that there would be no significant individual cr
cumulative adverse environmental impact due to the approval of this Negative
Declaration since the Anaheim General Flan designates the subject property for
hillside low-medium density residential land uses commensurate with the
proposal; that no sEnsitive environmental impacts are involved in the
proposal; that the Initial Study submitted by the petitioner indicates no
significant individual or cumulative adverse environmental impacts; and that
the Negative Declaraticn substantiating the foregoing findings is on file in
the City of Anaheim Planning Department.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby deny subject Petition for Variance on the basis of the
aforementioned findings.
