RESOLUTION NO. PC83-146
A RESOLUTION OF THE AIdAHEIM CITY LANNING COMMISSION
THAT PETITION FOR CONDITIONAL USE PERMIT NO. 2480 BE GRANTED
WHEREAS, the Anaheim City Plannin5 Commission did receive a verified
Petition for Condit?onai Use Permit from OAK GARDENS RECREATION ASSOCIATION,
P. 0. Box 8156, Anaheim, California 92802, owner, and TIMOTHY M. JOHNSTON,
P. 0. Box 10008, Anaheim, California 92802, agent of certain real property
situated in the City of Anaheim, County of Oranye, State of California,
described as:
LOTS 1 THROUGH 19 OF TRACT NO. 5053, IN THE CITY OF ANAHEIM~
AS PER MAP RECORDED IN BOOK 6636, PAGE 640 OF MAPS, IN THE
OFFICF, OF THE COUNTY RECORDER OF SAID COUNTY.
WHERERS, the City Planning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on August 22, 1983, at 1:30 p.m.,
notice of said pitblic heacing having been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hea: and consider evidence for and against said proposed conditional use
permit and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
following fact~:
1. That the proposed use is properly one for which a conditional
use permit is authorized by Anaheim Municipal Code Section 18.03.030.Q10 to
wit: to convert an existing recreation building to a security guard residence.
2. That the proposed use will not adversely affect the adjoining
land uees and the growth ar.d d>velopment of the area in tirhic@ it is proposed
to be located.
3. That the size and shape of the site proposed for the use is
adequate to allow the full development of the proposed use in a manner not
detrimental to the particular area nor co the peace, health, safety and
general welfare of the Citizens of the City of Anaheim.
4. That the granting of the Conditional Use Permit under the
conditions imposed, if a~•• will not be detrimenta2 to the peace, health,
safety and 9ener~l welfare. ~f the Citizens of the City of Anaaeim.
5. That the traff-ic generated by the proposed use will not impose
an undue burden upon the streets and highways designed and improved to carry
the traffic in the area.
6. That na one indicated their presence at said public hearing in
opposition; and that no correspondence was received in opposition to the
subject petition.

ENVIRONMENTAL ZMPAC'C FINDING: That the Anaheim City Planning
Commiasion has reviewed the proposal to convert an existing recreation
building to a security guard residence on an irregularly-shaped parcel of land
consisting of approximately 3.4 acres lucated at the southeast corner of
Alameda Avenue and Brookhurst Street, further described as 2176 West Alameda
Avenue; and does hereby appr~ve the Negative Declaration from the requirement
to prepare an environmental zmpact report on the basis that there would be no
significant individual or ciimulative adverse environmental impact ~ue to the
approval of this Negative Declaration since the Anaheim General Plan
designates the subject property for medium density residential land uses
commensurate with the proposal; that no sensitive environmental impacts are
involved in the proposal; that the Initial Study submitted by the petitioner
indicates no significant individual or cumulative adverse environmental
impacts; and that the Negative Declararion substantiating the foregoing
findings is on file in the City of Anaheim Planning Department.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim Cit_y Planning
Commission does hereby grant subject Petition for Conditional Use Permit, upon
the following conditions which are hereby found to be a necessary prerequisite
to the proposed use of the subject property in order to preserve the safety
and general welfare of the Citizens of the City of Anaheim:
1. That plans shall be submitted to the Buildin9 Division showing
compliance with the minimum standards of the City of Anaheim,
includin9 the Uniform Building, Plumbing, Electrical, Housing,
Mechanical and Fire Codes as adopted by the City of Anaheim. The
appropriate permits shall be obtained for any necessary work.
2. That the existing structure shall be brought up to the minimum
standards of the City of Anaheim, including the Uniform Building,
Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted
by the City of Anaheim.
3. That prior to final building and zoning inspections, Condition Nos.
1 and 2, above-mentioned, shall be complie~ with.
4. That the existing recteation building shall be occupied exclusively
by the secur.ity guard for the surrounding residential complex.
BE IT FURTHER RESOL~ED that the Anaheim City Planning Commission
does hereby find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such conditions, or any part thereof, be
declaced invalid or unenfurceable by the final judgment of any court of
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is signed and approved by me this 22nd day
of August, 1983.
