A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMI.4SION
THAT PETITION FOR CONDITIONAL USE PERMIT NO. 2484 BE GRANTED
W[iEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit from JAMES D. PIERCE AND HELEN M. PIERCE,
401 South Euclid Street, Anaheim, California 92802, owners ot certain real
property situated in the City of Anaheimr County of Oranqe, State of
California, described as:
LOT 72 OF TRACT N0. 2402~ AS SHOWN ON A MAP RECORDED IN BOOK
79~ PAGES 37, 38 AND 39 OF MISCELLAN~OUS MAPS~ RECORDED IN
THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY.
WHEREAS, the City Planning Commi,sion did hold a public hearing at
the Civic Center in the City of Anaheim on September 7, 1983, at 1:30 p.m.,
notice of said public hearing having been duly given as required by law and in
accordance with ti~e provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use
permit and to investigate and make findings and recommendations in connection
therewith; said public hearing having been continued to the Planning
Commission meeting of March 8, 1982; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
followinq facts:
1. That the proposed use is properly one for which a conditional
use permit is authorized by Anaheim Municipal Code Section 18.06.080 &
18.41.050.130 to wit: to permit commercial use nf a residential structural
with waiver oS::

AND 18.41.OG6.050 (8 spaces required; 6 spaces proposed)
2. That the requested waiver is hereby granted on the basis that
the parking variance will not cause an increase in traffic congestion in the
immediate vicinity nor adversely affect any adjoining land uses; and that the
granting of the parking variance under the conditions imposed, if any, will
not be detrimental to the peace, health, safety or general welfare of the
citizens of the City of Anaheim.
3. That the proposed use consisti.ng of a word processing service,
will not adversely affect the adjoining land uses and the growth and
development of the area in which it is proposed to be located.
4. That the size and shape of the site proposed for the use is
adequate to allow the full development of the proposed use in a manner not
detrimental to the particular area nor to the peace, health, safety and
general welfare of the Citizens of the City o~ Anaheim.

5. That the granting of the ~onditional Use Permit under the
conditions imposed, if any, will not be detrimental to the peace, health,
safety and general welfare of the Citizens of the City of Anaheim.
6. That the traffic generated by the proposed use will not impose
an undue burden upon the streets and highways designed and improvE:d to carry
the traffic in the area.
7. That no one indicated their presence at said public hearing in
opposition; and that no corcespondence was received in oppasition to the
subjact petition.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to reclassify subject property from the
RS-7200 (Residential, Single-Family) Zone to the CO (Commercial, Office and
Professional) Zone to permit commercial use of a residential structure with
waiver of minimum number of parking spaces on a rectangularly-shaped parcel of
land consisting of approxir~ately 6800-square feet having a frontage of
approximately 58 feet on the west side of Euclid Street, and further described
as 401 South Euclid Street; and does hereby approve the Neyative Declaration
upon finding that it has considered the Negative Declaration together with any
comments received during the public review process and further finding on the
basis of the Initial Study and any comments received that there is no
substantial evidence that the project will have a significant effect on the
environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commissiou does hereby grant subject Petition for Conditional Use Permit, upon
the following conditions which are hereby found to be a necessary prerequisite
to the proposed use of the subject property in order to preserve the safety
and general welfare of the Citizens of the City of Anaheim:
1. That this Conditional Use Permit is granted subject to the
completion of Reclassification No. 83-84-3, now pending.
2. That the use of subject property shall be limited to an office use
for word processing services only.
3. That the existing structure shall be brought up to the minimum
standards of the City of Anaheim, including the Uniform Building,
Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted
by the Citl~ of Anaheim.
4. That prior to issuance of a building permit, a traffic signa7.
assessment fee equaling the difference between the residential and
commercial assessment fees shall be paid to the City of Anaheim in
an amount as determined by the City Council.
5. That subject proFerty shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim
marked Exhibit No. 1.
6. That prior to final building and zoning inspections, Condition Nos.
3 and 5, above-mentioned, shall be complied with.

BE IT FURTFIER RESOLVED that the A~aheim City Planning Commission
doe~ hereby find and cletermine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such conditions, or any part thereof, be
declared invalid or unenforceable by the final judgment of any court of
competent jurisdiction, ther. this Resolutiori, and am~ approvals herein
contained, shall be deemed null and void.
THE EOREGOING RESOLUTION is signed and approved by me this 3rd day
