WHEREAS, the Anaheim City Planning Commission did receive a verified
petition for Reclassification from ROLAND COVEY, 5405 Garden Grove, ~134,
Wpstminster, California 92683, owner, and HUDSON OIL COMPANY, P. 0. Box 907,
Kansas City, Missouri 64141, agent of certain real property situated in the
City of Anaheim, County of Oran9e, State of California, described as follows:

W[iEREAS, the City Planning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on October 3, 1983 at 1:30 p.m.,
notice of said public hearing having been duly qiven as required by law and in
accordance with the provi.sions of the Anaheim Municipal Code. Chapter 18.03,
to hear and consider evidence for and against said proposed reclassification
and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due considecation of all
evidence and reports offered at said hearing, does find and determine the
following facts:
1. That the petiti.oner proposes reclassification of Parcel 1 of
subject property from the RS-A-43,000 {Residential, Agricultural) Zone to the
CL (Commercial, Limited) Zone and Parcel 2 from the RM-1200 (Residential,
Multiple-Family) Zone to the CL (COmmercial, Limited) 2one.
2. That the Anaheim General Plan designates subject property for
general commercial and/or medium density residential land uses.
3. That the proposed reclassification of subject property is
necessary and/or desirable for the orderly and proper dzvelopment of the
community.
4. That the prooosed reclassification of subject property does
properly relate to the zones and their permitted uses locally established in
close proximity to subject property and to the zones and their permitted uses
generally established throughout the community.
5. That the proposed reclassification of subject property requires
the improvement of abutting streets in accordance with the Circulation Element
of the General Plan, due to the anticipated increase in traffic which will be
generated by the intensification of land use.

;;~; hearing in opposition; and that no correspondence was received in opposition
to subject petition.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to reclassify Parcel 1 of subject
property from the RS-A-43,U00 (Residential, Agricultural) to the
~~ CL (COmmercial, Limited) Zone and Parcel 2 from the kM-1200 (Residential,
';i Multiple-Family) Zone to the CL (Commercial, Limited) Zone to permit
construction of a 4-story, 60-unit motel on Parcel 1, a rectangulatly-shaped
; parcel of land consisting of approximately 0.48 acre located at the southeast
-'` corner of Stonybrook Dcive and Beach Boulevard and further described as 736

:i consisting of approximatel 0.16 acre g Y-shaped parcel of land

~~ feet on the south side of Stonybrook Drive, located apptoximately 275 feet
~ east of the centerlina of Beach Boulevard and £urther described as 2966
;~ Stonybrook Drive; and does hereby approve the Neyative Declaration upon
? finding that it has considered the Negative Declaration together with any
comments received during the public review process and further finding on the
`~ basis of the initial study and any comments received that there is no
i substantial evidence that the project will have a significant effect on the
~ environment.
NOW, THEREFORE, BE IT RESOLVGD that the Anaheim City Planning
Commission does hereby grant subject Petition Por Reclassification and, by so
doing, that Title 18-ZOning of the Anaheim Municipal Code be amended to
exr,lude the above-described properties (Parcel 1) from RS-A-43,000
(Residential, Agricultural) Zone and Parcel 2, from the RM-1200 (Residential,
Multiple-Family) Zone and to incorporate said described preperties into the CL
(Commercial~ Limited) Zone upon the following conditions which are hereby
inuorder to a necessary prereguisite to the proposed use of subject property
preserve the safety and general welfare of the Citizens of the
City of Anaheim:
1• That street lighting facilities along Stonybrook Drive shall be
installed as required by the Utilities General Manager in accordance
with specifications on file in the Office of Utilities General
Manager, and that security in the form of a bond, certificate of
deposit, letter of credit, or cash, in an amount and form
satisfactory to the City of Anaheim, Nhall be posted with the City
to guarantee the satisfactory completion of the above-mentioned
improvements, Said security shall be posted with the City of
Anaheim prior to introduction of an ordinance rezoning the
property. The above-required improvements shall b~ installed prior
to occupancy.
Z• That the owner of subject property shall pay to the City of Anaheim
a fee for tree planting pucposes along Beach Boulevard in an amount
as determined by the City Council.
3. That completion of these recl~ssification pcoceedings is contingent
upon the granting of Conditional Use Permit No. 2496.

4. That the owner of subject property shall submit a letter requesting
termination of Conditional Use Permit No. 379 to the Planning
Department.
5• That prior to the introduction of an ordinance re2oning subject
property, Condition Nos. 1, 2 and 4, above-mentioned, shall be
completed. The provisions or rights granted by this resolution
shall become null and void by action of the Planning Commission
unless said conditions are complied with within one year from the
date of this resolution, or such further time as the Planning
Commission may grant.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission
does hereby find and determir.e that adoption of this Resolution is expressly
predicated uoon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such condition, or any part thereof, be
declared invalid or uner.forceable by the final judgement of any court of
competent jurisdiction, then this Resolution, artd any approvals herein
contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is signed and approved by me this 3rd day
