PC83-183 A RESOLUTION OF THE ANAHEIM CITY PLANNING COi9MISSION 'i''iAT PETITION FOR CONDITIONAL USE PEP.MIT N0. 2494 BE GRANTED wHEREAS, the A.~aheim City Planning Commission did receive a verified Petition for Conditianal Use Permit from CHING-CHU KAO LEE, 920 South Beach Bculevard, Anaheim, C~,lifornia 92804, owner, and WILLIAM WEI I,IN, 920 South Beach Boulevard, Anat,eim, California 92804, agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as: THE WEST 464.20 FEET MEASURED A:.ONG THE SOUTH LINE OF THE SOUTY HALF OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 13~ TOWNSHIp 4 SOUTH, RANGE 11 WEST, IN RANCHO LOS COYOTES, AS PER MAP RECORDED IN BOOK 51, PAGE 11 OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE COONTY RECORDER OP SAID COUNTY. EXCEPTING T'c~EREFROM THE SOUTEiERLY 235.52 AND THE: NORTH 329.52 FEET THEREOF. ALSO EXCEPTING THEREFROM THE EAST 142 FFET THEREOF. ALSO EXCEPTING THAT PORTION DESCRIBED IN THE DEED TO 2HE STATE OF CALIFORNIA, RECORDED AUGUST 23, 1951 IN BOOK 2220~ PAGE 426 OF OFFICIAL RECORDS. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on October 3, 1983, at 1:30 p.m., notice of said pubiic hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and again~t said proposed conditional use permit and to investigate and make £indings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study mad^ by itself and in its behalf, and aftez due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.44.J50.160 to wit: to permit a 10-unit addition to an axisting 22-unit motel. 2. That the proposed ~~e will not adversely affect the adjoining land uses and the yrowth and development of the area in which it is proposed to be located. 3. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detcimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. ~0057r PC83-183 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citizens of the ~ity of Anaheim. 5. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 6. That no one '_ndicated their presence at said public hearing in opposition; and that no corcespondence was received in opposition to the subject petition. ENVIRONMENTAL :MPACT FINDING: That the Anaheim Cit~ Planning Commission has reviewed the proposal to permit a 10-unit add~~i ~~ to an existing 22-unit motel on a rectangularly-shaped parcel of land cc :isting of appcoximately 0.50 acre, having a fronta9e of approximately 95 feet on the east side of Beach Boulevard, and further described as Q20 South Beach Boulevard (Travel Inn Motel!; and does hereby approve the Negative DecYaration upon finding that it has con~idered the Negative Declaration together with any comments received during the public zEView process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a si.gnificant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Co~nission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subi?c~ property in ordet to preserve the safety and general welfare of tne Citizens of the City of Anaheim: 1. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit rios, 1 through 3; provi~e@, however, ~hat kitchen efficiency units may be installed in no more than twenty-five percent (258) of the motel units, with a maximum of 6-cubic foot refrigerators, two-burner stoves excluding oven and baking facilities, and single compartment sinks, except that the manager's unit will be allowed to have full kitchen facilities. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such conditions, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein containad, shall be deemed null and void.
