PARCEL C: THAT PORTION OF THE LEANDRO SERRANO ALLOTMENT OF THE RANCHO SANTIAGO DE SANTA ANA~ A3 PER MAP FI:.ED IN CASE N0. 1192 OF THE DISTRICT COURT OF THE FIRST JUDICIAL DISTRICT, LOS ANGELES COUNTY, CALIFORNIA, AND THAT PORTION OE LOT 6 OF THE JONATHAN WaTSON TRACT, AS PER MAP RECORDED IN BOOK 2, pAGE Z6-1/2 OF THE R~~•RD OF SURVEYS IN THE OFFICE OF THE COUNTY RECORDER OF ORANGE COUNTY, CALIFORNIA~ DESCRIBED AS FOLLOWS: P1+RCEL 4 AS SHOf3N ON A MAP FILED IN BOOK 37, PAGE 45 OF PARCEL MAPS IN THE OFFICE OF THE COUNTY RECORDER OF ORANGE COUNTY, CALIFORNIA. $0082r PC63-210 ~.:;s ~-, WHEREAS, the City Planning Commission did hold a public hear?ng at the Civic Center in the City of Anaheim on October 31, 1983, at 1:30 p.m,, notice of said pub].ic hearing having been duly given as required by law and in accordance with the provisions of thP A~aheim Municipal Code, Chapter 18.03, to hear and consider evidence fnz and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; said public hearing having been continued to the Pla;ining Commission meeting of Novemb~r 14, 1983; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration o.° all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is groperly one for which a conditional use permit is authorized by Anaheim Municipal Code Sections 18.06.080, 18.21.050.180, 18.41.050.100 and 18.44.050.170 to permit expansion of an existing hospital wit.h waiver of: SECTIONS 18.06.050.0261 - Minimum number of oarkina spaces. 18.06.050.0267 (1,562 soaces required; 18.21.066.010 9_50 spaces proposed) 18.41.066.050 AND 18.44.066.050 2. That the progosed building expansion does not increase the number of patient beds (242). 3. That the parking variance will not cause an increase in ~raffic a~ngestion in the immediate vicinity nor adversely affect any adjoining land uses; and that the granting of the parking variance will not be detrimental to the peac2, health, safety or general welfare of the citizens of the City of Anaheim; and also on ~he basis that the petitioner agreed at the public hearing to record a covenant in a form as approved by the City Attorney providing that if within five (5) years, the City of Anaheim conducts a traffic study and determines that existing off-street parking is not adequate, the owner of the property shall construct a parking stru;.ture or provide additional parking in the number and form as determined to be necessary by the City Traffic Engineer. 4. That the proposed use will not adversely affect the adjoini.ng land uses and the growth and development of the area in which it is proposed to be located. 5. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 6. That the grantin9 of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 7• That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. -2- _~«..,_ ,.,,...,,.. P'' 83 -210 8. That no one indicated their presence at said public hearing in onposition; and that no correspondence was received in opposition to the subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commissiun has reviewed the proposal to expand an existing hospital with ~aiver uf minimum number oE parking spaces on an irregularly-shaped parcel of land consisting of approximately 9.6 acres located at the northwest corner of Riverdale Avenue and Lakeview Avenue, and further described as 441 North Lakeview Avenue (Kaiser Foundation Hospital); and does hereby apnrove the Negative Declaration upon finding that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the bas:s of the Initial Study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Pecmit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That the owner of subject property shall execute and record a covenant, in a form as approved by the City Attorney, against the property obligating the property owner to provide and maintain employee parking spaces in the existing hospital parking lot located to the east across Lakeview Avenue. 2. That the owners of subject property shall provide a minimum of 864 parking spaces for the hospital facility. 3. That the owner of subject property shall submit a letter to the Planning Department requesting termination pf Conditional Use Permit Np. 1445. 4. That subject property shall be developed substantially in accordaace with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 4; prov~ded, however, that a Fire Department apgroved vehicular turn-around area be constructed at the northwest corner of subject property adjacent to the hospital building. 5. That the owner of subject property shall record a covenant, in a form as approved by the City Attorney, providing that if within five (5) years the City of Anaheim conducts a traffic study and determines that existing off-street parking is not adequate, the owner of the property shall construct a parking structure or provide additional parking spaces in the number and form as determined to be necessary by the City Traffic Engineer. 6. That prior to the commencement of the activity authorized under this resolution, or prior to the time that a building permit is issued, or within a period of one year from the date of this resolution, whichever occurs first, Condition Nos. 1, 3 and 5, above-mentioned, shall be complied w?th. That prior to final building and zoning inspections, Condition No. 4, above-mention?d, shall be complied with. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all oE the conditions herainabove set forth. Should any such conditions, or any part thereof, be declared inval:d or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein containeu, shall be deemed null and void.
