A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR CONDITIONAL USE PERMIT NO. 2512 BE GRANTED
WHEREAS, the Anaheim City Plar,ning Commission did ceceive a verified
Petition for Conditional Use Permit from THOMAS P. WALKEP,, ET AL., 2855 East
Coast Highway, Corona Del Mar, California 92625, owner, and DENNY'S
RESTAURANTS, 16700 Valley View Avenue, La Mirada, California 90637, ATTN:
FRANK F. GHALILI, agent of certain real property situated in the City of
Anaheim, County of Oran9e, State of California, described as:
PARCEL 1, IN THE CITY OF ANAHEIM, COUNTY Or ORANGE, STATE OP
CALIFORNIA, AS SHOWN ON A MAP RECORDED IN 400K 3 PAGE 42~ OF
PARCEL MAPS.
WHERGAS, the City Planning Commissian d'3 hold a public hearing at
the Civic Centec in the City of Anaheim on November 14, 1983, at 1:30 p.m.,
notice of said public hearing having been duly given as required by law and in
accordance wilh the provisions of the Anaheim Municipal Code, Chapter 18.03,
to haar and consider evidence for and a9ainst said proposed conditional us?
permit and to investigate and make findinys and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
foliowing facts:
1. That the proposed use is properly one for which a conditional
use permit is authorized by Anaheim Municipal Code Section 18.61.050.390 &
18.06.080 to wit: to permit on-sale beer and wine in an existing restaurant
with waiver oL-:
SECTIONS 18.06.050~0232 - Minimum number of parkin spaces
AND 18.61.066.050 (77 spaces required; 66 spaces existing)
2. That the above-requested waiver is liereby granEed on the basis
that the parking variance will not cause an increase in traffic congestion in
the immediate vicinity nor adversely affect any adjoining land uses; and that
the granting oE the parking variance under. the conditions irnposed, iE ar~y,
will not be detrimental to the peace, health, saEety or general welfare of the
citizens of the Ciryo uf Anaheim.
3. That the proposed use will not adversely affect the adjoining
land uses and tne growth and development of the area in which it is proposed
to be located.
4. That the size and shape oE the site proposed for the use is
adequate to allow the full development of the proposed use in a manner not
detrimental to the particular area nor to the peace, health, safety and
general welfare of the Citizens of the City of Anaheim.

7. That no aie indicated their presence at said public hearing in
opposition; and that no correspondence was receivad in opposition to the
subject petition.
ENVIRONMENTAL IMPACT FINU:[~G: That the Anaheim City Planning
Commission has reviewed the oroposal to perrnit no-sale beer and wine in an
existing restaurant with waiver of minimum number of parking spaces on an
irregularly-shaped parcel of land consisting of approximately 0.82 acre,
located south an~ east of the soutneast corner oE Via Aurton Street and State
College Boulevard; and does hereby approve the Negative Declaration upon
finding that it has considered the Negative Declaration together with any
comments received during the public review process and furtner Einding on tha
basis of the initial study and an}~ co~n~nents r.eceived that r_here is no
substantial evidence that tne pcoject will have a significant effect on the
environment.
NOW, THEREFORE, BE IT RFSOI.VF,D that L-he Anaheim City Planling
Commission does hereby granl• s~it~ject Pe~ition Eor Conditional Dse Per.mit, upon
the Eollowiny conditions which are hereby found to be a necessary prerequisite
to khe proposed use of the subject property in order to preserve the safe~y
and general welfare oF the Citizens uE the City of. Anaheim:
1. That sidewalks shall be installed along State Colleye Boulevacd as
required by the City Engineer and in accordance with standard plans
and specifications on Eile in the OEEice of the City Engineec.
~• That sui~ject propecty shall be developed substantially in accor~lance
with plans and specifications on file with the City of Anaheim
marked Exhib.it Nos. 1 through 3.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission
does hereby Eind and d?termine that ado~tion of this Resolution is ?xoressly
predica~ed upon applicant's compliance with each and all of the conditions
hereinabove set torth. Should any such conditions, or any part thF:reoE, be
:clared invalid or unenEorceable by the [inal judgment of any court of
competent jurisdiction, then this Resolution, and any approval~ herein
contained, shall be deemed null and void.
THE POREGOING RESOLUTION is siyned and approved by me this 14th day
