PC83-221 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOk CONDITION~L USE PERMIT N0. 2514 BE GR7+NTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit from DAVID FERS2T AND ROBYN FERS2T, 116 South Orange Drive, Los Angeles, Cali.fornia 90036, owners, and DR. CLYDE D. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on November 14, 1983, at 1:30 p.m., notice of said public hearing havin9 been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and repcrts offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 15.44.050.170 t;o wit: to expand exist•ing convales.:ent hospital. 2. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. #0092r PC83-221 3. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of L•he Citizens of the Ci.ty of Anaheim. 5. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 6. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim ~ity Planning Commission has reviewed the proposal to expand an existing convalescent hospital on a rectan9ularly-shaped parcel of land consisting of approximately 1.6 acres, having a frontage of approximately 178 feet on the south side of Orange Avenue, and further described as 1720 West Orange Avenue (Orangeview Convalescent Bospital); aad does hereby approve the Negative Declaration upon finding that it has considered the Negative Declarati.on together with any comments received during the public review process and further finding on the basis of the initial study and a,iy comments received that there is no substantial evidence that the project will have a significant effect on the environment. hOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission daes hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necassary ~rerequisite to the proposed use of ~he subject property in order to preserve the sa£ety and general welfate of the Citizens of the City of Anaheim: 1. That the owner of subject property shall pay to the City of Anaheim a fee for tree planting purposes along Orange Avenue in an amount as determined by the City Council. 2. That prior to issuance of a building permit, appropriate watet assessment fees shall be paid to the City of Anaheim, in an amount as determined by the Office of the Utilities General Manager. 3. That prior to issuance of a building permit, the appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as determined by the Citp Council for new commercial buildings. 4. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 3 and showing fifty-nine (59) beds; provided, however, that the existin9 driveway on Orange Avenue shall be widened to a minimum of 24 feet and that the curb cuts shall be reconstructed with 10 Eoot radius curb returns, as requ3red by the City Traffic Engineer. -2- PC83-221 ~•..,1~_•_.. ~ . 5. That pxior to the commencement of the activity authurized under this resclution, or prior to the time that a building permit is issued, or within a period of one year from the date of this resolution, whichever occurs first, Condition No. 1, above-mentioned, shall be complied with. Extensions for further time tc complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 6. That prior to final building and zoning inspections, Condition No. 4, above-mentioned, shall be complied with. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find artd determi.ne khat adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such conditions, or. any part thereof, be declared invalid or unenforceable by the final judgment of any court of compekent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
