THAT PETITION FOR CONDITZONAL USE PERMIT NO. 2516 BE GRANTED
WE?^•.REAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit from GENERAL ELECTRIC COMPANY, One River
Road, Schenectady, New York 12345, owner, and PAUL C. SCHATZ, 1390 South Main
Street, Walnut Creek, California 34596, agent of certain real property
situated in the City of Anaheim, ~ounty of Orange, State of California,
described as:

WHEREAS, the City Planning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on Novembec 28, 1983, at 1:30 p.m.,
notice of said public heacing having been duly given as required by law and in
accordance with the pcovisions of the Anaheiin Municipal Code, Chapter 18.03,
to hear and consider evidence for and a9ainst said proposed co~ditional use
permit and to investigate and make findings and recommendations in connection
therewith; said public hearing havir,g been continued to the Planning
Commission meeting of Decembec 12, 1983; and
WHEREAS, said Commission, after due inspection, investigation and
study tnade by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
followiny facts:
1. That the proposed use is proper.ly one for which a conditional
use permit is authorized by Anaheim Municipal Code Section 18.03.030.010 to
wit: to permit the accessory indoor storage of pulychlorinated biphenyl (PCB)
in an existing industrial building.
2. That the proposed use is heceby granted for a period of two (2)
years, subject to ceview at the end of one (1) year in order for staff
(Planning and Fira Departments), to review the use and determine whether or
not the petitioner is complying with all applicable federal, s~ate, county and
city xegulal•ions regarding the storage of hazardous materials; and that said
permit shall expire on December 12, 1985 at which time another conditional use
permit may be sought.
3. That the proposed use will not adversely affec~ the adjoining
land uses and the growth and development of the area in which it is proposed
to be located.
4. That the size and shape of the site proposed for the use is
adequate to allow the full development of the proposed use in a manner not
detrimental to the pactic~lar area nor to the peace, health, safety and
general welfare of the Citizens of the City of Anaheim.
5. That the granting of the Conditional Use Permit under the
conditions imposed, if any, will not be detrimental to the peace, health,
safety and general welfare of the Citizens of the City of Anaheim.
6. That the traffic generated by the proposed use will not impose
an undue burden upon the streets and highways desiqned and improved to carry
the traffic in the area.
7. That no one indicated their presence at said public hearing in
opposition; and that n~ correspondence was received in opposition to the
subject petition.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning
~ommission has reviewed the proposal to permit the accessory indoor storage of
polychlorinated biphenyl (PCB) in an existing industrial building on an
irregularly-shaped paccel of land consisting of approximacely 6.33 acres,
having s frontage of approximately 370 feet on the north side of La Palma
Avenuer and further described as 3601 East La Palma Avenue (General Electric
Company Anaheim service shop): and does hereby approve the Negative

Declaration uonn finding ctiat it has considered the Negative Declaration
together with any comment~ received during the public review process and
further finding on the ba~is of the initial study and any comments received
that there is no substantial evidence that the project will have a significant
effect on the environmen;..
NOW, THEREFORE, BE IT RESOLVEU that the Anaheim City Planning
Commission does hereby grant subject Petition for Conditional Use Permit, upon
the following conditions which are hereby found to be a necessary prere;risite
to the proposed use of the subject property in order to preserve the safety
and general welfare of the Citizens of the City of Anaheim:
1. That prior to issuance of a building permit, appropriate water
assessment fees shall be paid to the City of Anaheim, in ari amount
as det?rmined by the Office of the Utilities General Manager.
2. That sidewalks shall be installed along I,a Palma Avenue as required
by the City Engineer and in accordance with standard plans and
specifications on file in the Office of the City Engineer.
3. That subject property owner shall obtain a Hazardous Waste
Facilities Permit, as required by the State of Califocnia Department
of Health Services; Permits, Surveillance and Enforcement Section;
Hazardous Waste Management.
4. That regular inspections shall be conducted by the County of Orange
Health Care Agency-Waste Management Section (by agceement with the
State of Cal:fornia Department of Health Services).
5. That subject property owner shall comply with all app.licable Federal
tegulations, including but not lim~ted to the following as specifted
in 40 CFR 761.42 pertaining to storage for disposal:
(a) An adequate roof and walls to prevent rain water from reaching
the stored PCBs and PCB item3;
(b) An adequate floor which has continuous curbing with a minimum
height of six inches. The floor and curbing must prov~de a
containment volume equal to at least two times the interval
volume of the largest PCB Article oc PCB Container stored
therein oc 25 peccent of the total internal volume of all PCB
Articles or PCB Containers stored therein, whichever is greater;
(c) No drain valves, floor drains, expansion joints, sewer lines,
or other openings that would permit liquids to flow Erom the
cucbed acea;
(d) Floors and curbing constructed of continuous smooth and
impervious materials, such as Poctland cement ^oncrete or
steel, to prevent or minimize penetration of PCes; and
(e) Not to be located at a site that is below the 100-year flood
water elevatior.. All PCB containers in storage will be checked
for leaks at least once evnry 30 days per Federal cegulations.

6. That subject property owner comply with the followina provisions
specified in Section 80.107b of the Uniform Fire Code:
(a) Highly toxic materials shall be se9regated from other chemicals
and combustible and flammable substances by storage in a room
or compartment separated from other areas by a two-hour
occupancy separation constructed as specified in the Building
Code. The storage room shall be provided with adequate
drainaqe facilities and natural or mechanical ventilation to
the outside atmosphere constructed as specifiecl in the
Mechanical Code.
(b) Legible warning signs and placards stating the nature and
location of the highly toxic materials shall be posted at all
entrances to areas where such ma~erials are stored or used.
7. That the property owner shall comply with the following
specifications, as required by the Anaheim Fire Department:
(a) The two (2) required exit doors shall be two hour doors, shall
swinq in the direction of travel exiting from the room and
shall be equipped with self closing devices.
(b) The area shall be provided with dikes which shall be calculated
to provide 258 containment of the maximum number of drums
(seventy 55-gallon drums) that may be stored within the diked
area.
(c) An impervious surface must be provided for the floor area and
the walls up to the required level of containment.
(d) The sprinkler sys*_em shall be separated from the sprinkler
system protecting the remainder of the building; provi.ded with
a separate control valve for the PCB storage area. Heads on
the PCB storage area shall be changed to a higher temperature
head to prevent inadvertent discharge of water onto the area.
(e) Provide NFPA 704 signing for all entrances into the building
and entrances to the PCB storage area.
(f) Provide sorbent materials at the site to facilitate clean up of
any spills.
(g) Apply for and receive a permit from the Anaheim Fire Degartment
for storaqe of hazardous chemicals.
(h) Provide adequate ventilation as required by the Mechanical Code.
(i) Class I, Division I electrical wiring is required within the
storage area.
(j) The separation walls between the PCII storage area and the
remaining areas in the building shall be two hour separation
walls.

8. That transportation of all PCB materials to and from the facility
shall be performed by waste haulers who have been registered by the
California Department of Health Services. Containers used for
storaye of the PCB shall comply with shipping container
specifications of the Department of Tran~portation.
9. That all personnel working in the storage area shall be trained in
the handling, storage and recordkeeping of PCB items and that
appropriate protective safety equipment shall be provided to anyone
working in the Pr_b storage area.
10. That all loading and unloading of the drums containing PCB material
be done on a concrete pad that is surrounded by a minimum 6-inch
high curbing.
11. That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim
marked Exhibit Nos. 1 and 2.
12. That Condition No. 1, above-mentioned, shall be completed within a
period of 90 days from the date of this resolution.
13. That prior to final building, zoning and fire inspections, Condition
Nos. 2, 3, 5, 6, 7, 10 at~d 11, above-mentioned, shall be complied
wi~h.
14. That the use is granted for a period of two (2) years, subject to
review at the end of one (1) year in order for staff (Planning and
Fire Departments) to review the situation and determine whether or
not the pe~itioner is complying with all applicable federal, state,
county and city regulations regarding the storage of hazardous
materialsp and that said permit shall expire on December 12, Z985,
at which time another conditional use permit may be sought.
BE TT FUP.THER RESOLVED that the Anaheim City Planning Commission
does hereby find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
heteinabove set f~rth. Should any such conditions, or any part thereof, be
declared invalid or unenforceable by the final judgment of any court of
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is signed and approved by me this 12th day
