A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR VARIANCE P]O. 3321 BE DENIED
WHERfi'AS, the Anaheim City Planning Commission did receive a verified
Petition for Variance from ROBIN HILL DEVELOPMENT COMPANY, 405 South Beverly
Drive, Beverly Hills, California 90212, owner of certain real property
situated in the City of Anaheim, County of Orange, State of California
described as:
TRACT NO 10410, AS SHOWN ON A MAP RECORDED IN BOOK 497,
PAGES 11, 12 AND 13 OI' MISCELTANEOUS MAPS, RECORDS OF
ORANGE COUNTY, CALIFORNIA.
WFiEREAS, the City Planning Commission did hold a public hearing at
the City Hall in the City of Anaheim on February 7, 1983, at 1:30 p.m., notice
of said public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed variance and to
investigate and make findings and recommendaticns in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
following facts:
1. That the petitioner proposes waivers of the following to
construct a 72-unit condominium complex:
(a) SECTTON 18.31.052.012 - Maximum structural height.
(1-story permitted tvithin 150 feet of
single-family residential zoning;
2-stories proposed)
(b) S~CTION 18.06.050.0121 - Minimum number of parking spaces
and 18.31.066.010 (180 spaces required; 178 spaces proposed)
(c) SECTION 18.31.068 - Required site screeninq
(6-foot high block wall required;
none proposed)
2. That the above-mentioned waivers are hereby denied on the basis
that petitioner did not demonstrate that a hardship exists due to the size,
shape, topography or surroundings of subject property; and on the basis that
the requested reclassification which would permit the proposed condominium was
denied, thereby, deleting the need for said waivers.
3. That there are no exceptional or extraordinary circumstances ~r
conditions applicab_e to the property involved or to the :ntended use of the
property that do not apply generally to the property or class of use in the
same vicinity and zone.

4. That the requested variance is not necessary for the preservation
and enjoyment of a substantial property right possessed by other property in
the same vicinity and zone, and denied to the property in question.
5• That the requested variance will be materially detrimental to the
public welfare or injurious to the property or improvements in such vicinity
and zone in which the property is located.
6. That 8 persons indicated their presence at said public hearing in
opposition; and that no correspondence was received in opposition to subject
petition.
ENVIRONMENTAL IMPACT FINDING: EIR NO. 218 was prepared in
conjunction with Tentative Tract Nos. 10407, 10408, 10409 and 10410 and
certified by the Planninq Commission on August 28, 1978; however, the Planning
Commission found that an update to said EIR would be required to determine the
cumulative effect of the increased density on the streets, traffic, water,
utilities, etc. of the entire area.
NOW, THEREFORE, BS IT RESOLVED that the Anaheim City P'_anning
Commission does hereby deny subject Petition for Variance on the basis of the
aforementioned findings.
THE FOREGOING ItESOLUT20N is signed and approved by me this 7th day of
