WHEREAS, the City Planning C~mmission did hold a p~iblic hearing at the City Hall in +-he City of Anahein on March 7, 1983, at 1:30 p.m., notice of said public hearing having been duly given as requ:Lred by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed con~itional use permit and to investigate and make findings an3 recommendations in connection therewith; and WHEREAS, said Commission, after due inspect•lon, investigaCion and study made by itself and in its behalf, and after due conaideration af all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a cond.itional use permit is authorized by Anaheim Municipal Code Sections 18.61.050.606 & 18.06.080 to wit: to permit a health spa in the ML(SC) (Industrial, Limited) Scenic Corridor Overlay) Zone with waiver of the following: SECTIONS 18.61.066.010 - Minimum number of parking spaces and 18.U6.050.02555 (628 spaces required; 604 existing) 2• That the requested waiver is hereby granted on the basis that the parking study submitted by the petitioner indicated adequate parkinq will be provided; and on the basis that the parking variance will not cause an increase in traffic congestion in the immediatc vicinity nor adversely affect any adjoining land uses; an3 that the request is minimalt and ttiat the granting of the parking variance undar the condition~ imposed, if any, w!I1 not be detrimental to the peace, health, saf~ty or general welfare of the citizens of the City of Anaheim. #0525I PC~3-56 ~ ,-,~ 3. That the proposed use will not adversely af£ect the adjoining land uses and the gr.owth and development of the area in which it is propoaed to be located. 4• That the size and shape of the site proposed for the use is adequate to a12ow the full development o£ the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. ~!.' 5. ENVIRONMENT,AI, IIqpACT FINDING: That the Anaheim City Planning Commission has reviewed the propcsal to permit a health spa in the I~II,(SC) (Industrial, Limited, Scenic Corridor Overlay) Zone with waiver of minimum number of parking spaces on an irregularly-shaped parcel of land consisting of approrj,~tely 12.2 acres, having a frontage of approximately 500 feet on the north side of La Palr,ii Avenue, and being further described as 5417 East La Palma Avenue; and does hereby approve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverae em~iro.~taental im~ct ~t~P *-~ the agprcvai oF this Negative Declaration since the Anaheim General Plan designates the subj~ct property for general industrial land uses commensurates with the proposal; that no sensitive environmental impacts are involved in the proposal; that the initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the t7pgative Declaration substantiating the foregoinq findings ia on file in ihe City of Anaheim Planning Department. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planninq Commission does hereby grant subject Petitfon for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welEare of the Citizens of the City of Anaheim: 1• Ttzat sidewalks shall be installed along La Palma Avenue as required bY the City Engineer and in accardance with etandard plans and specifications on Pile in the Office of the City Enqineer. l• That parkinq 1ot security lighting 3ha11 be provided to the satisfaction of the Anaheim Police Department. I 3. That prior to issuance of a buildina permit or co~r.mencement of the activity herein approved, whichever occurs first, a traffic siqnal asaessment fee equaling the difference between the industrial and aammercial asses~sment feps shall be paid to the City of Anaheim for the entire floor area encompassed by the spa, in an amount as determined by the City C~uncil. -2- PC83-56 4. That trash storage areas shall be provided in accordance with approved plans on file with the Strer_t Maintenance and Sanitation Division. 5. That plans shall be submitted to the Huilding Division showing compliance with the minimum standards of the City of Anaheim, including the Uniform Huilding, Plumbing, ELectrical, Mechanical and Fire Codes as adopte3 by the City of Anaheim. The appropriate perm±ts shall be obtained for anf necessary work. 6• That the proposal ahall comply with all signing requirements of the NII~(SC) Zone unl:;ss otherwise approved in connection with a duly advertised pul,lic hearing. 7• That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2. 9• That prior to final building and zoning inspections, Condition Nos. 1, 2, 4 and 7, above-mentioned, shall be conplied with.
