THAT PETITION FCR CONDITIONAL USE PERMIT N0. 2425 BE GRANTED
IJHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit from DAVID & ROBYN FERSZT, 116 South
Orange Drive, Los Angeles, California 90036, owners of certain real property
situated in the City of Anaheim, County of Orange, State of California,
described as:
THAT PORTION Or THE NORTHEAST QUARTER OF THE SOUTHEAST QUARTER OF
SECTION 17, TOWNSHIP 4 SOUTH, RANGE 10 WEST, IN THE RANCHO LOS
COYOTES, IN THE CITY OF ANAHEIM, AS SHOWN ON A MAP RECORDED IN BOOK

WHEREAS, the City Planning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on March 21, 1983, at 1:30 p.m,,
notice of said public hearing having been duly given as required by law and in
accordance wiCri tl;e previsiuns uf tl~e Aaaheim Municipal Code, Chapter 18.U3,
to hear and coasider evidence for and aoainst satd proposed conditional use
permit and to investigate and make findings and recommendations in coanection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
following facts:
1. That the proposed use is properly one for which a conditional
use permit is authorized by Anaheim Municipal Code Section 18.44.050,t70 to
wit: to permit expansion of an existing convalescent hospital.
2. That the proposed use will not adversely affect the ad3oining
land uses and the growth and development of ti~e area in which it is proposed
to be located.
3. That the size and shape of the site pruposed for the use is
adequate te a11ow the full development of the proposed use in a manner not
detrimental to the particular area nor to the peace, health, safety and
general welfare of the Citizens of the City of Anaheim.

ENVIRONMElJTAL IMPACT FINDING: That the Anaheim City Planning
Commission has reviewed the ro osal to
convalescent hospital on a rectangularly-shap ed it expansion of an existiag
approximately 1.6 acres, having a frontage of aParcel of land consisting og
south side of Orange Avenue, approximately 200 feetr westtofythe$c nterlinetof
Euclid Street and further described as 1720 West Or3nge Avenue; and does
hereby approve the Negative Declaration from the requirement to prepare ~n
environmental impact report o~ [he basis that there would be no significant
individual or cumulative adverse environmental impact due to the approval of
this Negative Declaration since the Anaheim General Plan designates the
sub~ect property for low density residential land uses commensurates with the
proposal; that no sensitive environmental impacts are involved in the
proposal; that the Initial Study submit[ed by the petitione: indicates no
significant individual or cumulative adverse environmental impacts; and that
the Negative Declaration substantiating the foregoing findings is on file in
the City of Anaheim Planning Departmen[.
NOW, ~~FORE, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby gran[ subject Petition for Conditior.al Use Permit, upon
the following conditions which are hereby found to be a necessary prerequisite
to the proposed use of the su6 Pct

1. That the owner of subject property shall pay [o the City of Anaheim a
fee for tree planting purposes along OranKe Avenue i~i an amount as
determined by the City Council.
2. That subject property shall be developed substantially in accordance
with plans and specifica[ions on file with the City of Anaheim marked
Exhibit Nos. 1 and 2,
3. That prior to the commencement of the activity authorized under this
resolution, or prior to the time that a building permit iF 1„-•o~i~ or
within a period of one year from the date of [his reaolution,
whichever occurs first, Condition No. 1~ above-mentioned, shall be
complied w?th. Extensions for furtlier time to complete said
conditions may be gran[ed in accordance with Section 18.03.090 of the
Anuheim Municipul Code.

BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does
hereby find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such conditions, or any part thereof, be
declared invalid or unenforceable by the final judgment of any court of
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is signed and approved by me this 21st day
of March, 1983.
