WHEREAS, the City plannir.g Cor„mission did i,old a public hearing at
the Civic Center in the City of Anaheim on April 18, 1983 at 1:30 p,m., notice
of said public hearing having been duly given as required by law and in
accordance w?th the provisions o£ the Anaheim Municipal Code. Chapter 18.03,
to hear and consider e~idence for and against said proposed reclassification
and to investigate and make findings and recommendations in connection
therewith; and
WHER~AS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of ail
evidence and reports offered at said hearing, does find and determiae the
following facts:
1• That the peFitioner proposes reclassification of subject
property from the RS-A-43,000 (MHP) (Residential, Agricultural - Mobilehome
Park Overlay) 2one to the RS-A-43,000 (Residential, Agricultural) Zone.
Z• That the Anaheim General Plan designates subject property for
commercial recreational land uses.
3• That said reclassification is required by publi~ necessity and
convenience and the general welfa~e,

ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to remove the Mobilehome Park Overlay
Zone trom subject property to permit conversion of an existing mobilehome park
to another land use on an irreqularly-shaped parcel of land consisting of
approximately 19.8 acres, having approximate frontages of 100 feet on the
south side of Katella Avenue, and further described as 300 West Katella Avenue
(Riviera Mobilehome Park); and does hereby approve the Negative Declaration
ftom the requirement to prepare an environmental impact report on the basis
that there would be no significant individual or cumulative adverse
environmental impact due to the approval of this Negative Declaration since
the Anak~eim General Plan designates the subject property for commercial
recreation land uses commensurate with the proposal; that no sensitive
environmental impacts are involve~ in the pcoposal; that the Initial Study
submitted by the petitioner indicates no siqnificant individual or cumulative
adverse environmental impacts; and that the Negative Declaration
substantiating the foregoing findings is on file in the City of Anaheim
Planning Aepartment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby grant subject Petition for Reclassification and, by so
doing, that Title 18-ZOning of the Anaheim Ptunicipal Code be amended to
exclude the above-described property from the RS-A-43,000 (MHP) (Residential,
Agricultural - Mobilehome Park Overlay) and to incorporate said properties
into the RS-A-43,000 (Residential, Agricultural) Zone upon the following
conditions which are hereby found to be a ne~essary prerequisite to the
proposed use of subject pcoperty in order to preserve the safety and general
welfare of the Citizens of the City of Anaheim:
L. That prior to introduction of an ordinance reclassifying the property
from the MobilehomA park Oveclay Zone, specific development plans (or
further discretionary permits) shall be submitted to and approved by
the Planning Commission.
2. That prior to (a) termination of the tenancy of any resider.t
mobilehome owner for any reason by the park owner or mobilehome
owner; or (b) adoption of an ordinance rezoning that portion of
subject property upon which such mobilehome is located from the (MHP)
Overlay Zone, or (c) issuance of any building permits for development
of any portion of subject property, whichever occurs first, the
owners of subject oroperty shall pay to each displaced mobilehome
owner (as identified in the Conversion Impact Report) or such owner's
successors in interest, relocation benefits in accordance with
Section 18.92.060.040 of the Anaheim Flunicipal Code for the actual
cost of relocation of such mobilehome, which amount shall be not less
than the total minimum amount as set forth o:t Exhibit A, attached
hezeto, and incorporated herein by this reference, or such oCher
benefits as mutually agreed upon between the park ownec and the
mobilehome owner. Said relocation benefits shall be paid to each
displaced mobilehome owner and proof thereof submitted to the City in
a form satisfactory to the City Attorney. In the event of payment of
the minimum amount set forth on Exhibit A here~f, said park owner
shall also pay to be mobilehome owner inteiest thereon at the rate of
108 per annum, simple interest, calculated fcom the dats of this
resolution to the ~~te of payment.

BE IT EURTHER RESOLVED that the Anaheim City Planning Commission does
hereby find and determine that adoption of this Resolution is expressly
predicated upon appl.icant's compliance with each and all of the conditions
hereinabove set forth. Should any such condition, or any part thereof, be
declared invalid or unenforceable by the final judgement of any court of
competent jurisdiction, then this Resolution, and anl approvals herein
contained, shall be deemed null and void.
