WHEREAS, the City Planning Commission did hold a public hearing at the Civic Centec in the City of Anaheim on April 18, 1983, at 1:30 p.m., notice of said public hearing having ~een duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make Lindings and recommendations in connection therewith; and -Z PC83-84 ~;~~,y'~+ ~~~ ~ ,.., .w~.. ' WHEREAS, said Commi~sion, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.44.OS0.130 & 18.06.080 to wit: to permit church facility with offices and a rectory in the CL (Commercial, Limited) zone with waiver of: SECTIONS 18.06.050.0212 - Minimum number of parking spaces 18.06.050.0266 (175 spaces required; 150 spaces proposed) AND 18.44.066.050 2. That the requested waiver is hereby granted on the basis of the unusual shape of subject prog?rty and on the basis that the parking demand seldom reaches 100$ because of the variety of uses on the property. 3. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 4. That the si2e and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 5. That tt~e granting of the Conditional Use Permit undec the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 6. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 7. That no one indicated their presence at said ~ublic hearing in opposition; and that no correspondence was received in opposition to the subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit a church facility with offices and rectory in the CL (COmmercial, Limited) zone with waiver of minimum number of parking spaces on an irregu]arly-shaped parcel of land consisting of approximately 1.84 acres, having a frontage of approximately 335 feet on the south side of Vermont Avenue, beinq located approximately 190 feet west of the centerline of Citron Street, and further described ~ss 808-820 West Vermont Avenue; and does hereby approve the Negative Declarakion from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmer.tai impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for commercial rec;reation land uses commensucates with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicalas no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planring Department. -3- PC83-84 ~ NOW, THEREFORE, BE IT RESOLV~D that the Anaheim City PLanning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following cunditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and qeneral welfare of the Citizens of the City of Anaheim: 1. That drainage of subject property shall be disposed of in a ma~ner satisfactory to the City Engineer. 2. That subject property shall be served by underground utilities. 3. That prior. to commencement of structural framing, fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department. 4. That trash storage areas shall be provided in accordance with approved plans on file with the Street Maintenance and Sanitation Division. 5. That prior to issuance of a building permit, appropriate water assessment fees shall be paid to the City of Anaheim, in an amount as determined by the Office of the Utilities General Manager. 6. That the owner of subject property shall pay to the City of Anaheim a fee for tree planting purposes along Vermont Avenue in an amount as determined by the City Council. 7. That the owner of subject propecty shall pay to the City of Anaheim a fee for street lighting along the westerly 210 feet of Vermont Avenue in an amount as determined by the City Council. 8. That prior to issuance of a building permit, the appropriate traffic signal assessment f~e shall be paid to the City of P.naheim in an amount as determined by the City Council for new commercial buildings. 9. That fire sprinklecs shall be installed in the bttildings as required by the City of Anaheim Fire Department. 10. That subject property shall be developed substantially in accordance with plans and specifications on fi.le with the City of Anaheim marked Exhibit No. 1. 11. That prior to the commencement of the activity authorized under this resolution, or prior to the time that a building permit is issued, or within a period of one year from the date of this resolution, whichever occurs first, Condition Nos. 6 and ~, above-mentioned, shall be complied with. Extensions for furthec time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 12. That prior to final building and zoning inspections, Condition Nos. 1, 2, 4, 9 a-:d 10, above-mentioned, shall be complied with. -4- PC83-84 BE IT FURTHER RESOLVED that the Anaheim City Planninq Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth.
