WHER~AS, the petitioner submitted a requ~st f~r amendmenl• to waiv~er
;b) and to Condition :Jo. 21 contained in Planning Cqmmission Re~olutian No.
PC84-147 adopted in connection with Conditi~nal Use Permit No. 2599, whicl~ was
granted, in part, by the Planning Com.mission on July~ 23, 1984 to per.mik a
7-story, 212-room hotel camplex and restaurants with on--sale alcoh~lic
beverages and with waive~s of. (~) minimum number of parking spaces and (b)
maximum ytructural height adjacent to sin~le-f.amily r~sidential zuning, on
pro~erty consisting of approximat2ly 6.34 acres located at the southeast
corner of Frontera Si.reet and Glas~ell Street.
WHEHFAS, tne petitioner has submitted a revi:ec~ plan marked Revision
No. 1 of Exhibit No. 12, ~roposing a 29-feot hic~h industrial stoxage building
instead of a 2Q-foot high industrial builcling as originally shown on Exhibit
No. 12; and
WH~REAS, the pet.itioner therefore proposes Lhat waiver (b) contaired
in the above-ref2rred t~ resolution be amended to read as follows:
"SECTIOiV5 1~.61.p62.017. - Maximum struc;:ural heiaht adiacent to
AND 18.61.063.020 ,,~1~-familv zonin~
(0 to 30 fect permiEted; 29 and 66 feet
proposed)"; and '
WHEREAS, L•he pekitioner furthermore proposes that Condition No. 21
container] in said resolution be amended to read a~ follows;
"That subject property ahall be develo~,ed substantially in ~ccordance
with plans and speciFications on file wi~h the City cf Anaheim marked Exh.ibik
Nos. 1 through 1.1 and ~tevision No. 1 of Fxhibit No. 12, excludxng the
free-s'.anding restaurant"; and
WHEREAS, the City Planning Commission did hold a public hearing at
the Civic Cenker in the City of Anaheim on October 29, 1984 at 1:30 p.m.,
notice of said public hearing having been ~uly given as req~iired by 1aw and in
accordance with thc~ pro~isions of the Anaheim Mur~icipal Cade, Chapte.r 18.03~
to hear and consider evidec~ce £or and against said pr~po~al to amend the
waivers and c~nditior-s of appraval of Conditional Ilse Permit No. 2599, and to
inves~igatp and make ffndings and recommendat.ions in connection therewith;
safd publi.c hearing havxng been continued to the ~lanning Commission meetf.ng
of November 14, 1984; and
WHEREAS, said Commission, after due inspection, inveytigation tlnd
study made by itself and in its behalf, and after due consi~eration o:~ a11
evidence and reports oFfer~d at said hearing, DOES HERF,HY F'IND:
1. That no one indicated their presence al• said public heariny i.n
opposicion; and that no correspondencP was received in op~osition to the
subject petition.

2• That the ~lanning Commissa.on could ~~ot finc! justification to
amend i.t~e waivers or canditions of a~proval on the basis that the petitioner
was unwilling to sti~ul~te that the proposPd industri.al storage building would
be uspc~ only in connecL•ion with kr,e hotel and restaur~nts which wi11 be the
primary u;es on the ~roperty, and not rer~tecl, leased or atherwise used by
other businesses or individuals.
ENVIRONM,:NTAI, IMPACT FINDING; That a Negative Declaratian was
previously approved on July 23, 1984, and no further acticn is necES~ary.
NOW, THEREb'ORF, BE IT I2ESOLVED that the Anaheim City Planning
Commission does hereby deny subject amendment of Resolukion No. PC84-147, and
the waivers and conditions remain as a part oi L•he resolution and n.ust be
complied with.
