A RESOLU'PION OF THE ANAHEIM CITY PLANNING COMFfISSION AMENDING
RESOLUTION N0. PCSS-49, NUP1C PRO TUNC, IN CONNECTION
WITH VARIANCE NO. 3462
WHEREAS, on Febcuary 20, 19a5, the Anaheim City Plannir.g ~ommission
granted Variance No. 3462 to permit construction of a six-story commercial
office building with waivers oF minimum number of parking space:: and maximum
structur.al height on a rectangularly-shaped parcel of land consxsting of
ap~roximately 3.8 acres located at the northwest corner of Oranuewood Avenue
and Stace College Boulevard; and
WHEP.EAS, due to a s:aff error, the minimuT number of parking spaces
required was inco~rectly shown as 397 spaces and the co[rect number of parking
spaces cequired for the proposed 126,000 gross square feet of building should
have been shown as 441 spaces; and
WEiEREAS, Condition No. 9 requires the execution and recordation of a
covenant agreeing to construct a parking structure on subject pcoperty or
otherwise provide additional off-street parking in a number not to exceed 51
additional spaces foc a total of. 397 spaces;
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby amend Resolution No. PC85-491, tiunc Pro tunc, in
connection with Varian~:e No. 3962, to amend Finding Paragraph No. 1 to read as
fellows:
'1. That the petition proposes waivers of the following to ccnstruct
a six-story commercial office building:
(a) SECTIONS 18.Ob.O50.U212, - Minimum number of parking spaces
16.06.080, 44l spaces required for 126,000
AND 18.41.066.050 gross sq. ft. of building; (346
spaces proposed)
(b) SECTION 18.41.062.011 - Maximum structural height
(57 feet permitted within 300 feet
of single-family residential
zoning; (86 feet proposed, 115 feet
fcom single-fami.ly residential
zoning to the south)•
BE IT FURTHER RESOLVED that Condition No. 9 shall be amended to read
as follows;
'9. That pcior to issuance oF a building permit, the owner(s) of
subject property shall execute and record a covenant in a form approved by the
City Attorney agreeing that if, within three (3) yeacs followin9 occupancy of
the office building, the City conducts a traffic study which indicates that the
off-street packing is inadequate for the office building, said owner shall

construct a parking structure on the subject property or sh311 otherwise
provide addit?.onal off-street parking in < number (not to exceed 95 additiona7
spaces for a total of 441 spaces as required for the proposed 126,000 gross
square feet of building and manner satisfactory to the City Engineer.
Compliance with the terms of the aEoresaid covenant is an express and
continuing condition of this permit. Additionally, prior to issuance of a
building permit for the ~ffice building, said owner(s) shall post a faithful
performance bond with the City or submit a letter of credit or other guarantee
acceptable to he City in an amount as required by the CiEy Engineer to
9uarantee installation of said additional parking, which amount shall be
deemed liquidated damages payable to the City in the event that any such
required parking is not constcucted in a timely manner."
THE F~REGOING RESOLUTION is signed and approved by me this L5th day
