WHEREAS, the City Planning Commission did hold a puhlic hearing at
the Civic Center in L-he City of Anaheim on Apri.l 15, 1985 at 1:30 p.m., notice
of said public hearing having been duly given as requi~ed by law and in
accocdance with the provisions of the Anaheim Municipal Code. Chapter 18.03,
to hear and coneider evidence for and against said proposed reclassification
and to investigate and make findings and recommendations in connection
therewith; said public hearing having been continued to the Planning
Commission meeting of May 13, 1985; and
WtIEREA5, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after d~e consideration of all
evidence and reports offered at said hearing, does find and determine the
fo'llowing facts:
7,, That the petitioner proposes reclassification of subject
propezty from The RS-A-43,OOG (R?sidential, Agricultural) to the CL
(Commetcial, Limited) Zone.
Z, That the Anaheim General Plan designates subject property for
9eneral commercial and medium-density residential land uses.
3. That the oroposed reclassification of subject propertj is
necessary and/or desirable ~or the orderly and proper development of the
community.
4. That tne proposed reclassification of subject property does
prcYerly relate to the zones and thair permitted uses locally established in
close proximity to subject property and to the zones and their permitted uses
9enerally established rhroughout rhe community.
;, That the proposed reclassification of subject property requires
thE improvement of abutting streets in accordance with the Circulation Element
of the General Flan, d~ae to the anticipated increase in traffic which witl be
generated by the intcnsification of land use.
6. That 10 persons inzicated thcir presence at the April 15, 1985
meetin9 and b persons indicated tneir p~esence at che hlay 13, 15&5 puulic
hearing in opposition; and that no correspondence was received in opposition
to subject petition.
ENVZRONMENTAL IMPACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to reclas:=~fy subject property from the
RS-A-43,OOU (Residential, A9ricultural) to the CL (Commercial, Limited) Zone
to permit a 71-unit, 3-stocy motel on an irre9ularly-shaped parcel of land
consisting of approximately 0.92 acre, having a frontage of approximately 112
feet on the west side of Beach Boulevard, and further described as 705 South
Beach Boulevard; aad does hereby approve the Negal•ive Declar.ation upon finding
that it has considered the Negative Declaration together with any comments
reCeived during the public review process and further finding on the basis of
the initial study and any comments received that there is no substantial
evidence that the project will have a significant effect on the envir.onment.

NOW, THEREFURE, BE IT RESOLVED that the Anaheim City Planning
Commission does heceby grant subject Petition for Reclassification and, by so
doing, that Title 18-ZOning of the Anaheim Municipal Code be amended to
exclude the above-desc~ibed property frorn RS-A-43,000 (Residential,
Ayricultural) and to incorporate said described property into the CL
(Industrial, Limited) Zone upon the following conditions which are hereby
found to be a necessary prerequisite to the proposed use of subject property
in order to preserve the safety and general welfare of the Citizens of the
City of Anaheim:
1. That street lzghting facilities along Beach Boulevard shall be
installed as required by the Utilities Ger.eral Manayer in accordance
with specifications on :ile in the Office of Utilities General
;fanager, and that security in the form of a bond, certificate of
depcsit, letter of credit, or cash, in an amount and form
satisfactory to the City of Anaheim, shall be posted with the City
to guarantee the satisfactory completion of the above-mentioned
improvements. Said security shall be posted with the City of
Anaheim prior to the inr.r~:fuction of an ordinance rezoning subject
property. The a[,:ve-:equired improvements shall be ins=alled prior
to occupancy.
2. That prior to the introduction of an ordinance rezuning ~ubject
pcoperty, Condition No. 1, above-mentioned, shall be cor~pleted. The
provision~ ar rights granted by this resolution shall become null
and void by action of the Planning Commission unless said conditions
are complied with within one year Lrom l-he date of this resolution,
or such Eurther time as the Planniny Commission may grant.
BE IT FURTHER RESOLVED that tfie Anaheim City Planning Commission
dces hereby find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set focth. Should any such condition, or any part thereof, be
declared invalid or unenforceable by the Einal judgment of an.r court of
competent jurisdiction, then this Resc?ution, and any approvals herein
contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is signed and approved by me this 13th day
