A RESOLUTZON OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR CONDITIONAL USE PERMIT N0. 2691 BE GT2ANTED
WHEREAS, the Anaheim City Planning Commission did receive a
verified Petition for Conditional Use Permit from STEWART GREEN
ASSO~IATES~ ATTN: KARL MEADER, p, p,
92806, owner of certain real Dox 6371, Anaheim, California
Couqt uL Oran e Property situated in the City of Anaheim,
Y 9, State of Calif.ornia, described as EXNIBIT 1(ATTACHED);
WHEREAS, the City Planning Commission did hold a public hearing
at the Civic Center in the City of Anaheim on May 29, 1985, at 1:30 p,m,~
notice of said public hearing having been duly given as required by law
a~,~ and in accordance with the proeisions of the
(; Chapter 18.C3, to hear and consider evidence Anaheim Municipal Code,
proposed conditional use for and against said
reco permit and to investigate and make findings and
, mmendations in connection therewith; and
~' WHEREAS,- sai.d Commission, after due inspection, investigation
'- and study made by itself and in its behalf, and after due consideration
~ of all evidence and reports offered at said hearing, does find and
determine the following facts:
1. That the proposed us•a is properly one f~r which a
~onditional use permit is authorized by Anaheim Flunicipal Code Section
' 1~-U3.030.U1U to wit: to permit an automotive repair facility.
2. That the proposed use is hereby granted subject to the
Petitionec's stipulations at the public heariny as follows:
a• That muffler repair shop customers' vehicles wai:ing
to be repaiced or waiting to be picked up after
repair shall be parked in designated parking spaces
to the south of tr.e ex.istiny p~st OfPice and that no
customer vehicles shall be parked to the west of the
Proposed facility for ~onger than 15 minutes waiting
for information, ~astimates, or re~airs.
b• That the curbs adjacent to the first lane of parking
spaces located in front of the restaurant and shops
on the west side of Buildings D, ti and F, as shown o^
Exhibit No. 1, shall be painted red; and that "No
Parking - Tow-away Zone" signs sha.ll be posted in
that same area.
~• That a11 employees oF the mufFler repair shop and
Post Office shall be instructed to park in the spaces
to the south of the existing Post qffice.
d• That the existing drop-off mail box island shall be
relocated subject to the approval of the City Traffic
Engineer.

3. That the proposed use will not adversely affect the
adjoining land uses and the groWkh and development of the area in which
it is proPosed to be located.
4. That the size and shape of the site proposed for the use
is adequate to allow the full development of the proposed use in a manner
not detrimental to the particular area noc to the peace, health, safety
and genecal welfare of the Citizens of the City of Anaheim.
5. That the granting of the Conditional Use Permit under the
conditions imposed, if any, will not be detri.mental to *::e peace, health,
safety and general welfare of the Citizens of the City of Anaheim.
6. That the traffic generated by the proposed use will not
impose ar. undue t~cden upon the streets and highways designed and
improved to carry the traffic in the area.
7. That no one indicated their presence at said public
hearing in opposition; and that no corresponde-~e was received in
opposition to the subject petition.
ENVIRUNMENTAL Z6IPACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to permit an automotive repair
facility on an irregularly-shaped parcel of land consisting of
appzoximately 27.11 acres located at the southeast corner of Lincoln
Avanue and State Collegc Boulevard, and further described as 2312 East
Lincoln Avenue (Midas N,uffler); and does hereby approve the Negative
Declaration upon finding that it has considered the Negative Declaration
together with any comments ceceived during tne public review process and
further finding on the basis of the initial study and any comments
received that there is no substantial evidence that the project will have
a significant effect on the enviconment.
t~~.W, THEREFOR~, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby grant subject Petition for Conditional Use Permit,
u~on th~ followina conditions which are hereby found *o b~ a necessary
pcerequisite to tt~e proposed use of the s~bject propertv in order to
preserve the safety and general welface of the Citizens of the City of
Anaheim:
1, That prior to issuan.~e of a building permit, the appcopriate
tcaf:ic signal assessment fee shall be paid to the City of
Anaheim in an amount as determined by the City Council for new
commercial buildings.
2, That subject building shall be served by underground utilities.
3, That prior to commencement of structural framing, fire hydrants
shall be installed and charged as required and determined to be
necessaxy by the Chief of the Fire Department.
4, That fice spcinklers shall be instal:ed as required by the City
t'ire blarshall.

5, :hat trash storaye aceas shall be p~ovided and maintained in
accordance with approved plans on file with the S'treet
Maintenance and Sanitation Division.
6. That all air conditioning facilities and otlier roof and ground
mounted equipnent shall be properly shielded from view, and the
sound buffeced from adjacent residential propecties.
~, That the proposal shall comply with all signing requirements of
the CL Zone, unless a vatiance allowing sign waivers is
approved by the Plann.ing Commission or City Council.
g, That no outdoor storage of or work on vehicl.es or vehicular
parts shall be pecmitted.
q, That subject property ~haJ.l be deve'loped substantially in ac:ordance
with plans and specifications on file with the City of Anaheim
marked Exhibit Nos. 1 throuqh 4.
10. That prior to the commencement of the activity authorized under this
resoluticn, or prior to issusnce of a building permit, or within a
period of one year from the date of this resolution, whichever
cccurs first, Condition No. 1, above-mentioned, ~hall be complied
with. Extensions for further time to complete said conditions may
be granted in acco:dance with Section 18.03.090 of the Ananeim
t4unicipal Code.

BE IT FURTHER RESOLVED that the Anaheim City Planning Commission
does hereby find and determine that adoption of this Resolution is expressly
pr.edicated upon applicant's compliance with each and all of the conditions
heceinabove set forth. Should any such conditions, or any part thereof, be
declared invalid or unenforceable by the final judgment of any couct of
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
