A RESOLUTZON OF THE ANAHEIM CITX PLANNING COMMISSION
THAT PE;TITION FOR CONDITIONAL USE PERMIT N0. 2645 BE GRANTED
WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Uee Permit from F,NGELO CASSLLA AND ROSE MARY CASELLA
ULIVI, 2124 East Valley Glen Lane, Orange, California 92667, owners, and
CHRISTOPHER STELLA, 3093 Miraloma Avenue, Anaheim, California 92806, agent for
certain real proper.ty situated in the City of Anaheim, County oE Orange, State
of CaliEornia, described as:
A PORTION OF LOT 7, BLOCK 5, OF THE GOLDEN STATE TRACT~ SHOWN
AS PARCEL 4, OP PAR(:EL MAPS~ BOOK 50, PAGE 17~ OFFICIAL
RECORDS OF ORANGE COUNTY, CAI~IFORNIA.
WHEREAS, the City Planning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on January 7, 1985, at 1:30 p.m,,
notice oE said public hearing having been duly given as required by law, and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use
permit and to investigate and make findings and recommendations in connection
therewith; and
TAHEREAS, said Commission, after due inspection, investigation and
study made by itself and in ir_s behalf, and after due consideration of all
evidence and reports ofEered at said hearing, does find and determine the
following facts:
1. That L•he proposed use is propeely one Eor which a conditional
use permit is authorized by Anaheim Municipal Code Section 15.61.050.070 to
wit: to retain an automobile repair facility in a service scation in the ML
(Industrial, Limited) Zone.
Z• That the proposed use is hereby granted for a period of t~vo (2)
years, to expire January 7, 1987,
3. That the proposed use will r.ot aoversely affect the adjoining
land uses and the growth and development of the area in which it is proposed
to be located.
4. That the size and shape of the site proposed tor the use is
adequate L-o allow the full development of the proposed use in a manner not
detrimental to the particular area nor to the peace, health, safety and
general welfare of the Citi2ens of the City of Anaheim.
5. That the granting of the Conditional Use Permit under the
conditions imposed, i£ any, will not be detrimental to the peace, health,
safety and geaecal welfare of the Citizens of the City of Anaheim.
6. That the traffic generated by the proposed use will not impose
an undue burden upon the stceets and highways designed and improved to carry
the traffic in the area.

7. That no one ~_ndicated their presence at said public hearing in
eppositi.c,n; and that no correspondence was received in opposition to the
~subject petiticn.
ENVIRON[9ENTAL IMPACT FINDING: That ttie Anaheim City Planning
Commission has reviewed the proposal to retain an automobile repair facility
in a service station in the ML (Industrial, Limited) ZonP on a
rectangul~rly-shaped parcel of .land consisting of approximately 0.6 acre
located at the northwesk corner of t~Iiraloma Avenue and Kraemer Boulevard, and
further described as 3053 East Miraloma Avenu2; and does hereby approve the
Negative Declaration upon finding that it has considered the Negative
Declacation together with any comments received during the Fublic revie~r
process and further finding on the basis of the initial study and any comments
received :.hat there is no subctantial evidence that the project will have a
significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Ar.aheim City Planning
Commission doec hereby grant subject Petition for Cor.ditional. Use P?rmit, upon
the Eollowing conditions orhich are hereby found to be a necessary prerequisite
to the propose~ use of the subject property in order to preserve the safety
and yeneral welfare of the Citizens of the City of Anaheim:
1. That trash storage aeeas shall be providea and maintained in
accordance with approved plans on Eile with the Street Maintenance
an~ Sanitation llivision.
2. That all work on vehicles be done inside the building.
3. That all vel~icle storage be limitec] to the "holding area" as
identified on Exhibit No. 1.
4. That all outdoor storage areas shall be screened minimally by a
6-foot high chair. l;nk fence with cedwood slats as identified on
Exhibit No. 1.
5. That a minimum of seven (7) customer and employee parking spaces be
striped and permanencly maintained.
6. ;nat subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim
marked Exhibit No. 1.
7. That Condition Nos. 1, 2, 3, 4, 5 and 6, above-mentioned, shall be
complated within a peri~d of nineL-y (90) days from the date of this
re~olution.
8. That this use oermit is gtanted for a period of two (2) yeats, to
expice January 7, 1987.
BE IT ~URTHER RESOLVED that the Anaheim City Planning Commission
does hereby find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
k~ereinabove set forth. Should any such conditions, or any part thereof, be
declared invalid or unenforceable by the final judgment of any court of
competent jurisdiction, then this Resolution, and anp appr.ovals herein
contained, shall be deemed null and void.
