WHEREAS, the City Planning Commission did hold a public l~earing at
the Civic Center in the City of Anaheim on July 22, 1985 at 1:3U p.m., notice
of said public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use
permit and to investigate and make findings and recommendations in connection
therewith; said publir hearing having been continued to the Planning
Commission meeting of August 5, 1985; and

Wf1EREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports offered at sa.id hearing, does find and determine the
following facts:
1• That the p:oposed use is properly one for which a conditional
use permit is authorized by Anaheim Municipal Code Sections 18.05.112.020 and
18.46.050.080 to wit: to pecmil• a billboard in the CH (COmmercial, Heavy) 2one
with waivers of:
(a) SECTION 18.05.114 - Maximum displaY area.
(300 square feet permitted; 672 square
feet proposed)
(b) SECTIUN 18.OS.11o.02U - tlax.imum heiaht.
(27 faet maximum within 300 feet of any
residential zone boundarv permitt.ed;

2. That the requested waivers ace i:ereby denied on the basis that
there are no sper.ial circumstances applicable to the property such as size,
shape, topography, t.~catzun and surroundings which do not apply to other
identically zoned proE.~cty in the same vicinity; and :hat strict applir_ation
of the Zoning Code does not deprive the property of privileges enjoyed by
other propertiAs in the idcntical ~ore and cla~si[ication in the vicinity; and
on the basis that the displwy area is more than twice the size permitted by
code.
3. That the pruposed use will adversely affect the adjoininq land
uses and the 9rowth an~ developmen[ cE the area in which it is proposed to be
locatea.
4. That the size and shape of the site proposed for the use is not
adequate to allow the full development of the proposed use in a manner not

general welfare of thc Citizens of'the City of Anaheim.
5. That the grantiny of the Conditional Use Permit will be
detrimental to the peace, f~ealth, safety an~ general welfaze of the Citizens
of the City of. Anaheim.
6. That no one indicated their presence at said public hearing in
upposition; and that no correspondence was received in opposition to the
subject petition.
ENVIRONDIENTAL IMPACT FINDING: That the Anaheim City Planning
Commission ha~ reviewed the prc,posal to permit a billboard in the CH
(COmmercial, Heavp) Zone with waivers of maximum display area and maximum
height on an irregularly-shaped parcal of land consisting of approximately 3.1
acres located north and ea~t of the ~ortheast corner of Lincoln Avenue and
beach Boulevard; and does hereby approve the Negative Declaration upon finding
that it has considered the Negative Declaration together with any comments
received during the public review process and further finding on the Gasis of
the initial study and any comments received that there is no substantial
evidence that the project will have a significant effect on the environment.

NUW, THEREE'ORE, BE IT kSSOLVED that the Anaheim City Planning
Commission does hereby deny subject Petition ~or Conditional Use Permit, on
the basis of the aforementioned Eindings.
THE FOREGOING kESOLUTION is signed and approved by me this 5th day of
