accordance k~ith the pcocisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence foc and against said proposed conditional use
permit and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itseli and in its behalf, and aftec due consideration of all
evidence and reports offered at said hearing, does find and determine the
following facts:
1. That the proposed use is propecly one for which a cond~tional use
permit is authocized bx Anaheim Municipal Code Section 18.44.050.010 to wit:

the basis that the parking waiver will not cause an increase in traffic
congestion in the immediate vicinity nor adversely affect any adjoining land
uses and gcanting of the packing waivec under the eonditions imposE•d, if any,
will not be detrimental to the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
3. That the pcoposed use will not adversely atfect the adjoining land
uses and the 9cowth and development of the area in which it is proposed to be
located.
4. That the size ancl sha~~e of the site proposed for the use is
adequate to allow the full develop.ment of che proposed use in a manner not
detrimental to the particular are,s nor to the peace, health, safety and
general weLfate of tne Citizens of the City of Anaheim.

subject petition.
ENVIRONMENTAL iMPACT FINDING: That the Anaheim City Planning
Commission has r.eviewed the proposal to permit on-sale beer and wine in a
proposed restaurant with waiver of minimum number o£ parking spaces on an
irregulacly-shaped parcel of land consisting of approximately 27.11 acres
located at the southeast corner of Lincoln Avenue and State College Aoulevard,
and fucthet described as 214 State College 8oulevard; and doe~

heceby approve the Negative Declaration upon findi.ng that it has considered
the Negative Declacation togethee with any comments received duriny the
public review pcoce~s and further findiny on the basis of the initial study
and any comments recPived that there is no substantial evidence that the
project will have a significant effect un the enviconment.
tJOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby grant subject Petition for Conditional Use Pecmit,
upon the following conditions which are hereby found to be a necessary
Nrerequisite to the proposed use of the subject property in order to
preserve the safety and general welfare of the Citizens ~f the City of
Anaheim:
2. That trash storage a~eas shall be provided and maintained in
accoedance with approved plans on file with the Street Maintenance
and Sanitation Di~~is.ion.
2. That the proposal shall comply with all signing requirements of the
CL Zone, unless a variance allowing sign waivers is approved by the
Ylanning Commission or City Council.
3. That all air conditioning Eacilities and other roof and 9round
mounted equipment shail be properly shielded fcom view.
4. That no alcoholic beverages, except beer and wine shall be sold or
consumed on the premises of the subject business as shown on the
approved exhibits (214 South State College Boulevard).
5. Tiiat cubject property shall be developed substantially in
accordance with plaas and specifications on file with the City of
Anaheim marked Exhibit Nos. 1 and 2.
6. That prior to final building and zoning inspections, Condition Nos.
1, 3 and 5, above-rientioned, shall be complied with.
BE IT FURTHER RESOLVED Lhat the Anaheim City Planning Commission
does hereby find antl determine L•hat adoption oE this Re.solution is

conditions hereinabove set forth. Should any such conditions, or any pact
thereof, be declared invalid or unenforceable by the final judgment of any
