RES-2022-012RESOLUTION NO.2 0 2 2 - 012 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM REQUESTING THAT THE CALIFORNIA STATE LEGISLATURE REFORM TRANSITIONAL AND SUPPORTIVE HOUSING LAWS TO PROTECT NEIGHBORHOODS WHEREAS, the City of Anaheim ("CITY") has a long standing history of acknowledging the importance of Transitional and Supportive Housing to combat homelessness and providing needed housing for the most vulnerable in our community; and WHEREAS, the CITY has, and continues to be, recognized throughout the County of Orange and State of California as a leader in the fight against homelessness, spending over $50 million dollars in the last three years establishing temporary emergency shelters; partnering with non -profits in creating and supportive innovative outreach and engagement models such as the Community Care Response Team (CCRT) Program and Be Well OC; facilitating and supporting The Salvation Army in the construction of the Center of Hope, an innovative comprehensive campus combining permanent supportive housing, emergency shelter operations, medical and dental care, and a drug and alcohol rehabilitation center; and funding and building several permanent supportive housing projects; and WHEREAS, the CITY has a proven track record of entitling and supporting Transitional and Supportive Housing projects, including approval of approximately seven conditional use permits for large Transitional and Supportive Housing projects with seven or more residents in the last decade; and WHEREAS, State Law recognizes that large Residential Care Facilities with seven or more residents can impact residential neighborhoods, based on the high number of residents and operational characteristics of the facility, and thereby allows cities discretionary review of large facilities through the conditional use permit process; and WHEREAS, State Law recognizes that Residential Care Facilities can impact the character and livability of neighborhoods, and thereby includes minimum distances between licensed facilities to avoid an over -concentration of facilities in any given neighborhood; and WHEREAS, Transitional and Supportive Housing share substantially similar operational characteristics to Residential Care Facilities, including commercial characteristics such as high resident turn -over rates, on -site staffing, transportation services, mental health and medical services, and social programming, that are not commonly associated with typical residential uses, and that have substantially similar impacts on the character and livability of neighborhoods which can impact both those living in those neighborhoods as well as those residing in Transitional and Supportive Housing facilities; and WHEREAS, Transitional and Supportive Housing, when cumulatively considered along with other quasi -residential uses, such as Residential Care Facilities, can result in the over - concentration of quasi -residential uses in any given neighborhood that may have detrimental 1 impacts on the quality, character, and livability of the affected neighborhood as well as on the facilities themselves; and WHEREAS, over -concentration of quasi -residential uses in neighborhoods is a critical issue that cities all over Orange County and the State are trying to navigate without clear and consistent regulatory enforcement or direction from state agencies, arising from an underlying lack of clear legislative intent which has led to the promulgation of vague and ambiguous regulations and/or inconsistent regulatory actions, which usurp local control with a "one -size fits all" approach. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Anaheim respectfully requests that the California State Legislature urgently consider clarifying reform legislation to address the severe impacts associated with the over -concentration of Transitional and Supportive Housing in residential neighborhoods, and the unintended consequences caused by existing state regulations concerning such facilities, as follows: 1. Clarify that local jurisdictions may regulate Transitional and Supportive Housing with seven or more residents by way of a conditional use permit in the same manner in which state law allows local jurisdictions to regulate Residential Care Facilities. 2. Establish a reasonable and objective distance requirement that must exist between a Transitional and Supportive Housing use to any other existing neighborhood Transitional and Supportive Housing use, as well as a distance requirement between any neighborhood Transitional and Supportive Housing use to any other Residential Care Facility or Sober Living Home in order to preclude an over -concentration of such quasi -residential uses in residential neighborhoods. BE IT FURTHER RESOLVED THAT, the City urges state officials promulgating rules affecting Transitional and Supportive Housing and Residential Care Facilities and corresponding regulatory actions, if any, to work collaboratively at the local level with impacted cities to ensure that there is not an over -concentration of such uses in residential neighborhoods and/or other unintended consequences.
