A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR CONDITIONAL USE PERMIT N0. 2650 BE GRANTED
WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit from AZRPORT SERVICES, INC., 851 East
Cerritos Avenue, Anaheim, California 92805, ATTN: D. W. BOYLES, otiner, and
RONALD ROGERS, C%0 [9AGIC CARPET A[9BULETTE CORPORATION, 310 North Tustin,
Orange, California 92667, agent for certain real property situated in the City
of Anaheim, County of Urange, State of CaliEornia, described as:

WHEREA5, the City Planning Commission did hold a public hearing at
the Civic Center in the City ot Anaheim on Januacy 7, 1985, at 1:30 p.m.,
notice of said public hearing having been duly given as required by law a.^.d in
accordance with the provisions of the Anaheim t•tunicipal Code, Chapter 18.03,
to hear and consider evidence for and aqainst said proposed conditional use
permit and to investi9ate and make findings and recommendations in connection
therewith; and
WHEREt,s, said Commissir,n, aEter due inspection, investigation and
stiidy rtiade by itself and in its behalf, and after due consideration of all
evidence and reports offered at said heacing, does Eind and detecmine the
following facts:
1. That the proposed use is properly one for which a conditional
use permit is au~horized by Anaheim Municipal Code Section 18.61.050.514 to
wit: to permit ar. outdoor non-emergency amb~lance storage and maintenance
facility with waivers of the following:
(a) SECTZON 1II.01.130 - Required lot frontage. (pll lots requiced
to abut a public street or alley; one lot
without frontage prooosed)
(b) SECTION 18.06.030 - Required imqrovement of oarkinq areas
(FUllv paved parking areas required;
oil gravel proposed)
2. That the proposed use is hereby granted for a period of one (1)
year to expire January 7, 1986.
3. That the requested waiver (a) is hereby grarited on the basis
that there are special circumstances applicable to the property such as size,
shape, topography, location and surroundings which do not apply to othec
identicalll zoned property in Lhe same vicinity; and that strict application
of the Zoning Code deprives the pcoperty of privileges enjoyed by other
properties in the identical zone and classification in the vicinity and
subject to Interdepartmental Committee recommendations.

4. That the requested waiv?r (b) is heceby 9ranr_ed on the basis
that the parking variance will not cause an increase in tcaffic congestion in
tl~e immediate vicinity nor adversely affect any adjoining land uses; and that
the gcanting of ti~e parkinq variance under the conditions imgosed, if any,
will not be detrimen~al to the peace, health, safety or generai welfare of the
citi2ens of the City uf Anaheim.
5. That the proposed use will not adversely affect the adjoining
land uses and the growth and development of the area in which it is proposed
to be located.
G. 'Phat the size and shape of the site proposed for the use is
adequate to allow the full development oi the proposed use in a manner not
detrimental to the particular acea nor to the peace, health, safety and
genecal welfare of the Citizens o~'. the City of Anaheim.
7. That the grantiny of the Conditional Use Pecmit under the
conditions imposed, if any, will no~ be detrirtiental to the peace, health,
safety and general welfare of tt~e Citi2ens of the City of Anaheim.
8. That the traffic generated by the pcoposed use will not impose
an undue bu~den uro~~ the sl-reets and highvays designed and i~,nproved to carry
the traffic in the area.
9. That no one indicated their presence at said public hearing in
oppositior; and that no correspondence was received in opposition to the
subject petition.
ENVIRONb1ENTAL IhfPACT FINDZNG: That the Anaheim City Planning
Commission has reviewed the proposal to pe~mit an outdoor non-emergency
ambulance storage and maintenance facility with waivers of required lot
Erontage and required improvement of par!:i~ig areas on an ircegularly-shaped
parcel of land consisting of approximately 3.6 acres, having approximate
frontages of 50 feet un the east side of Allec Street, and further described
as 1920 South Allec Steeet; and does hereby approve the Negative Declaration
upon finding that it has considered the Negative Declaration together with any
comments received during the public review process and furkher. finding on the
basis oL ti~e inilial sLudy ~nd .:c;s conments recei~~ed th~t kherA is no
substantial evidence that the project will have a significant effect on the
environment.
NOW, THEREFORE, BE IT R~SOLVGD that the Anaheir~ City Planning
Commission does hereby grant subject Petition for Conditional Use Permit, upon
the following conditions which are hereby found to be a necessary precequisite
to the proposed use of the subject property in order to preserve the safety
and gene~al wel£a[e of the Citizens of the City oE Anaheim:
1. That prior to issuance of , building permit, the appcopriate traffic
signal assessment fee shall be paid to the City of Anaheim in an
amount as determined by r.he City Council for new industcial
buildings and open space.
2, That drainage of subject property shall be disposed :,f in a manner
satisfactory to the City Engineer.

3. That subject property shall be served by undecground utilities.
4. That prior to commencement oi structural framing, fire hydrants
shall be installed and charyed as required and determined to be
necessary by the Ct~ief of the Fire Department.
5. That trash storage areas shall be provided and maintained in
accordance with approved plans on file with the Street Maintenance
and Sanitation Division.
6. That in the event subject property is to be divided for the purpose
of sale, lease, or financing, a parcel map to record the approved
division of subject pcopetty shall be submitted to and approved by
the City of Anaheim and then be recorded in the Office ef the Orange
County Recor~er.
7. That prior to issuance of a building permit for Phase I, primary
water main fees shall be paid to the City of Anaheim, in an amount
as determined by the Office of the Utilities General Manager.
8. That prioc to commencement oE the activity authorized under this
resolution, or pri~r to the time that a building permit is issued,
oc within a period of ninety (90) days from the date of this
resolution, wt~ichever o~~curs first, the owner(s) of subject prorerty
shall execute and record a covenant in a form approved by the City
Attorney's Office wherein such owner(s) agree not to contest the
formation ot any assessment district(s) which may hereafter be
Eormed pursuant to the provisions of Development Agreement No. 83-01
between the City of Anaheim ar.d Anaheim Stadium Associates, which
district(s) could include such ownee's property. Failuce to comply
with this condition within the specified time shall deem this
conditional use permit null and void.
9. That all outdoor storage areas shall be screened minimally by a
6-foot high chain link fence with redwood slatting along the
easterly, soutti, westecly and noctheascerly proFerty lines.
10. That the petitioner shall obtain approval for temporary use of the
trailer lorated on thP property in conEormance with Counr_il Policy
No. 529, within a period oE sixty (60) days from the date of this
resolution.
11. That prior to issuance oP Luilding permits for Phase I, a reciprocal
access agreement, in a form as reviewed an~ approved by the City
Attorney's Office, shall be recorded guaranteeing a minimum 25-foot
wide access easement across property loca~?d to the west and tEi
Allec Street. Said agreement shall be recorded with the Lfice of
the Orange County Recorder and proof of recordation shall he
furnished tu the Planning Dzpartment.
12. That prior to issuance of a building permit foc Phase i, pla: :iall
be submitted to the Building Division for any appl~:uble
improvements showing compliance with the minimum standards of the
City of. Anaheim, including the uniform Plumbing, Electrical,
Mechanical and Fire Code as adopted by the City of Anaheim. The
appropriate permits shall be obtained for any necessary work.

~ 13. That prior to issuance cf a building permit for Phase I, a bond
! sha11 be posted with tt,e City of Anaheim guaranteeing that paving
shall be insta:iPd fer s.il outdou~ sEorage areas as required by the
City of Anaheim within a period of one (1) year from the date of
this resolution.
14. That subject property shall be developed substanciall}• in accordance
with plans and specifications on file with the City of A~iaheim
marked Exhibit Nos. 1 and 2.
15. That prior to final building and zoning inspections or prior t.~
commencement of the activity herein approved, whichever occurs
first, Condition Nos. 2, 3, 5, 9 and 12, above-mentioned, shall be
complied with.
16. That this use perrnit shall expire in one (1) year, on January 7,
1986.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission
does hereb,y find and determine that adoption of this Resolution is expressly
predicated upon app].icant's compiiance with each and all =f the conditions
}iereinabove set forrh. Should aciy such conditions, or any part thereof, bA
declared invalid ~r unenforceable by the final judgment of any court of
competent jurisdiction, then ttiis Resolution, and any appr~vals herein
contained, s},all be deemed null and void.
THE FOREGOING RESOLUTION is sign2d and approved by me this 7th day
