WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit from DUNN PROPERTIES CORPORATION, ATTN:
RAY CHER6IAK OR ANDY SCHUTZ, 2g Brookhollow Drive, Santa Ana, California 92705,
owners of certain real property situated in the City of Anaheim, County of
Orange, State of California, described as:

WHEREAS, the City Planning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on Aagust 15, 1985 at 1:3Q p,m,~
notice of said pub.lic hearing having been duly given as required by law and in
accordance with the provi.sions of the Anal~eim Muniripal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use
permit and to investigate and make findings and recommendations ~r. connection
therewith; and
WfIEREAS, aaid Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
eviaence and reports offered at said hearing, does find and determine the
following facts:

Z• That the proposed use is hereby denied on the basis that ail of
the uses on the petitioner's submitted list of potential users were not
considered to be industrially-oriented and compatit~le with industrial uses and
that each use, as proposed, should be reviewed and considered individually by
the Planning Commission to determine whether or not it would be compatible
with the industrial area.
3• That the proposed use will adversely affect the adjoining land
uses and the growth and development of the area in ~ahich it is proposed to be

5• That the granting of the Conditional Use Permit under the
conditions imposed, if any, will be detrimental to the peace, health, safet;~
and yenera.l welfare of the Citizens of the City of Anaheim.
6• That the traffic generated by the propesed use will impose an
undue burden upon the streets and highways d~signed and improved to carry the
traffic in the area.
7• That one person indicated his oresence at said public hearing in
opposition; and that no correspondence was received in opposition to the
subjeat petition.
ENVIROPJMENTAL IMPACT FINDING: That the Anaheim City Planning
Commission has reviewed the pro~c+sal to permit an industrially-related office
complex in L•he ML(SC) (?.-,dustr.ial, Limited Scenic Corridor Overlay) Zone on a
rectangularly-shaped pa:cel of land consisting of approximately 9.33 acres at
the northeast corner cf La Palma Avenue and Kellogg Drive; ar.d does hereby
approve the Negative Decla:ation upon finding that it has considered the
Negative Dec.laratio:i together with any comments received during the public
,.eview process and further finding on the basis of the initial study and any
cornments received that there is no substantial evidence that the project will
have a significant effecc on the environment.
~~oW. THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby deny subject Petition for Conditional Use Permit, on
tk~e basis oE the aforementio~ed findings.
THE .FOREGOING RESOLUTION is signed and approved by me this 19th day
of August, 1985.
