THAT PETITION FOR RECLASSIFICATiON N0. 85-86-4 BE GRANTED
WHEREAS, the Anaheim City Planning Commission did receive a ve[.ified
petition fo[ Reclassification Erom ELTON C. SNAVELY AND MAE BELLE SNAVELY,
1259 North Batavia St[eet, Orange, California 92667, owners, and CHARLES A.
ROSS, 438 East Katella Avenue, Otange, California 92667, agent for certain
ceal proPerty situated in the City of Anaheim, County of Orange, State of
California, described as follows:

WHEREA5, th= City Planning Commission did hold a pub]ic hearinq at
the Civic Centec in the City of Anaheim on Augu~t 19, 1985 at 1:30 p.m.,
notice of said public hearin9 having been duly given as required by law and in
accocdance with tt,e pcovisions of the Anaheim t4unicipal Code. Chapter 18.03,
to hear anh consider evidence for and against said peoposed reclassification
and to investigate and make findings and recommendations in connection
therewith; and
WHERGFS, said Commission, after due inspeclion, investigation and
study made by itself and in its behalf, and after due considecation of all
evidence and teports oftered at said hearinq, does find and determine the
following facts:
L. That the petitioner proposes reclassification of subject
property feom the RS-A-43,000 (Residential, Agricu.ltural) Zone to the RM-1200
(Residential, Multiple-Family) or a less intense zone.
2. That the Anaheim General Plan designa~es subject property for
low density cesidential land uses.
3. That the proposed reclassiEical:ion of subject property is
necessacy and/or desirable for the orderly and ptoper development of the
community.
4. That the proposed rec:assification of subject propecty does
propecly relate to the zones and their permitted uses locally established in
close proximity to subject property and to the zones and their permitted uses
genetally established throughout the community.

5. That the proposed reclassification of subject property requires
the improvement of abutr.ing streets in accordance with the Circulation Element
of the General Plan, due to the anticipated increase in traffic which will be
yenerated by the int-ensification of land use.
6. That na one ~ndicated tneir presence at said public hearing in
opposition; and that no correspondence was received in oppoaition to subject
petition.
ENVIRONMENTAL IFiDACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal to ceclassify subject property from the
RS-A-43,OU0 (Residential, Agricultural) Zone to the RM-1200 (Residentiul,
biultiple-Family) ~one to construct a 23-unit apartment complex with waivers of
maximum structural height and maximum number of bachelor units on a
rectangulacly-shapea parcel of land consi~ting of approximately 0.70 acre,
having a frontage of approximately 239 feet on the south side of Ball Road,
and further described as 3G14 West Ball Road; and does hereby approve the
Negative Declaration upon finding that it has considered the Negatire
Declaration together with any comments received during the public review
process and further finding on the basis of th= initial ~tudy and any comments
received that there is no substantial evidence that the projec~ will have a
significant effect oh the environrtient.
NOW, TFIERNFGRE, BE iT RESOLVFD that the Anaheim City Planning
Commission does hereby grant subject Petition for Reclassification and, by so
doing, that Title ld-ZOning of Lhe Anahe'_m Municipal Coc7e be amended to
exc).ude the above-describefl property from the RS-A-43,000 (Residential,
Agricultural) Zone and to incorporate said described property into the RS-1200
(Residential, Multiple-Family) Zone upc:i the following conditions which are
heceby found to be a necessary p::erequisite to the proposed use of subject
property in occ?er to preserve the safety and general welfare of the Citizens
oL the City of Anahein:
1. That the owner oE subject property shall irrevocably offer. to
dedicate to Y.he City of Anaheim a strip of land 53 feet in width
from the cent~rline of the street along Ball Road for street
widening purooses.
That all enyineering requirements of the City cf Anaheim along Ball
Road, including preparat;on of improvement plans and installation of
all impxovements such a~ curbs and gutters, sidewalks, water
facilities, stteet grading and pavement, sewer and drainage
facilities, or other appurtenant work shall be complied with as
req~ired by the City Engfneer and in accordance with specifications
on file in the Office of the City Engineec; and that security in the
form of a bond, certificate of deposit, ~etter of credit, cr cash,
in an amount and Eorm satisEactory to the Cic.y o£ Anaheim, shall be
posted with the City to guarantee the satisfactory completion of
said improvements. Said securicy shall be posted with the City
prior to introduction of an ordinance rezoning subject property, to
guarantee the inshallation of the above-cequired improvements prior
to occupancy.

3. That skceet lighting facilities along Ball Road shall be installed
G~ required by the Utilities General Manager in accordance with
specifications on file in the Office of Utilitie~ General Manager,
and that security in the form of a bond, cer:ificate of deposit,
letter of credit, or cash, in an amount and form satisfactory to the
City of Anaheim, sha11 be posted with the City to guarantee the
satisfactory completion of the above-mentioned improvements. Said
security shall be poste~ with the City of Anaheim prioc to the
introduction of. an ordinance rezoning subjer.t property. The
above-cequirecl improvements shall Ue instal.led priot to occuptincy.
4. That pcior to the introduc~ion of an ordinance rezoning subject
property, Condition Nos. 1 through 3, above-mentioned, shall be
completed. The pro~~isions or rights granted by this resolution
sha.l.l become null and void by action of the Planning Commission
unless said conditions are compli~d with within one year from the
date of this resolution, or such further time as the Planning
Cammission may grant.
BE IT FURTHL•'R RESOLVED that the Anaheim City Planning Commission
does heceby find and determine that adopt:~n of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such condition, or any part theteof, be
declared invalid or unenEorceab~a by the final judgment of any court of
compel-ent jurisdiction, then this Resolution, and any appcovals herein
contained, shall be deemed null and void.
