WHEREAS, the City Pl~inniny Comml•;.ion did hold a public hearing at
che Cicic Center in the C1Cy u£ Anaheim on Septembec 4, ].985, at 1:30 p.m.,
notice of said public heuring having been duly given as cequired by law and in
accordance with the provisions of L•hc Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and againsL said proposed conditional use
~~ermit and to invesli9ate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of. ~il~
evidence and repocts offerr.d at said hearing, does find and determine /Lle
fol.lowing facts: v
1. That the proposed use is pcoperly one for which a conditional. use
permit is authorized by Anaheim Municipal. Code Section 18.21.050.290 to wit:
to permit an unmanned public utility remote switching station for Pacific Bell.

2. That the proposed use wil.l not adverseiy affect the adjoining
land uses and the growth and development oL the area in which it is proposed
to be located.
3. That the size and shape of the site proposed for the use is
ade~~ate to allow the full development ci the proposed use in a manner not
detrimental to the particular area nor to the peace, hea.lth, safety and
general welfare of the Citizens of the City of Anaheim.
4. That the granting of the Conditiona]. Use Permit under the
conditions imposed, if any, will not be detcimental to the peace, hea].th,
safety and general welfare of the Citizens of tl~e City of Anaheim.
5. That the traffic generated by the pcoposed use will not impose an
undue burden upon the stceets and highways designed and improved to carry the
tzaEfic in the area.
6. That one person indicated his presence at said pub].ic hearing in
opposition; and that no corcespondence was received in opposition to the
subject petition.
ENVIRON6IENTAL IMPACT r^INDING: That the Anaheim City Pl.anning
Commission has reviewed the proposal to permit an unmanned publ.ic utility
remote switching station for Pacific Bel.l on an irregularly-shaped parcel of
land consisting of appcoximately 1.16 acres, having a Erontage of
approximately 60 feet on the north side oE the northecly terminus of Col.umbue
Drive and furcher described as 7295 East Columbus Drive; and does hereby
approve the Negative Declaration upon finding that it has considered the
Piegative Decla[ation together with any comments received during the public
ceview process and fucthec finding on the basis of the initial study and any
comments received that there is no substantial evidence that the project will
have a significant effect on the envizonment.
NOW, THEREPORE, BE ZT RESOLVED that the Anaheim City Planning
Commission does hereby 9rant sub7ect Yetition ioc CondiCiuua2 Use Permit, upar.
the following conditions which are hereby found to be a necessary prerequisite
to the proposed use of the subject property in order to preserve the safety
and genecal welfare of the Citizens of the City of Anaheim:
1. That prior to issuance of a building permit, primary water main fees
shall be paid to the City of Anaheim, in an amount as determined by
the Office of the Utilities General Manager.
2. That prior to issuance of a buil6ing permit, special facilities fees
shall be paid to the Water Utility Division by the developer in
accordance with Rule 15B of the Water Utility Rate~, Ru.les and
Regulations.
3. That the vehicular access riyhts to Ser~ano Avenue shall be dedicated
to the City of Anaheim.
9. That a six (6)-foot high wrought iron fence shall be cunstructed and
maintained along the nurthwesterly property line adjacent to Serrano
Avenue and/or that a bond in an amonnt and form satisfactory to the
City of Anaheim shall be posted with the City to guarantee the
installation of said wall prior to the final. building inspections.

5. That the ownet of subject property shal.l pay to the Cit}~ of Anaheim a
fee for tree planting purposes along Columbus Drive in an amount as
determined by the City Councii.
6. That pcior to issuance of a buiJ.ding permit, the aporopriate traEfic
signal assessment fee shall be paid to the City of Anaheim in a~
amount as determined by the City Council for new commerciaJ. build;ngs.
7. That the owner of subject property shall dedicate to the City of
Anaheim a strip of land 25 feet in width from the centerl.ine of the
street alon9 Columbus Drive Por sL-reet widening purposes and a
standard cul-de-sac.
8. That al.l engineering requirements of the City of Anaheim a7.ong
Columbus Drive, including preparation of improvement pJ.ans and
installation of all imProvements such as curbs and gutters,
sidewalks, water facilities, street grading and pavement, sewer and
drainage facilities, or other appurtenant work shalJ. be complied with
as reyuired by the City Engineer and in accordance with
specificati.ons on Eile in the Office of the City Engineer; and that
secucity in the t~rm o: a bond, certificate oE deposit, letter of
credit, or cash, in an amo~nt and Porm satisfactory to the City of
Anaheim, shall be posted witn the City to guarantee the satisfactory
completion cf said impcovements. Said security shall be posted with
the City prior to approval of improvement plans, to guarantee the
insl-all.ation of the abovc-required improvements prior to occupancy.
9. That drainage of subject property ehall be disposed of in a manner
satisfactory to the City Engineer.
10. That in the event subject pcoperty is to be divided for the pucpose
of sale, lease, or Einancing, a parcel. map to record ~he approved
division of subject property shall be submitted to and apptoved by
the City of Anaheim and then be recorded in the Office of the Orange
County Recorder.
11. That street .lighting facilities alony Columbus Drive shall. be
installed as required by the Utilities General Manager in accordance
with speciEication:: on Eile in the Office of Uti].ities General.
Manager, and that security in the fo[m of a bond, certificate of
deposit, letter of credit, or cash, in an amounL• and form
satisEactory to the City of Anaheim, shall be posted with the City to
guarantee the satisfactory completion of the above-mentioned
improvements. Said security shal.l be posted with the City of Anaheim
prior to approval of improv?ment pJ.ans. The above-requ:red
improvements shall be installed priot to occupancy.
12. That subject property saall be served by underqround utilities.
13. That all air conditioning facil.ities shall be pro~erly shielded from
view, and 'che sound buffered from adjacent residential properties.
14. That subject property shall be developed substantially in accocdance
with plans and specifications on file with the City of Anaheim marked
Exhibit Nos. 1 through 4.

15. That prior to issuance of a building permit, or within a period of
one year fcom the date of this resolution, whichevec occurs first,
Condition Nos. l., 2, 3, 5, 6, 7, 8 and 11, above-mentioned, sha.ll be
complied with. Extensions for further time to compl.ete said
conditions may be granted in accordance with Section 18.03.090 of the
Anaheim Municipal Code.
16. That prior to final building and zoning inspections, Condition Nos.
4, 9, 12, 13 and 14, above-mentioned, shail be comp.lied with.
BE TT EUR7'HER RESOLVtll that the Anaheim City Planning Commission does
hereby fi~~d and determine that adoption of this ResoJ.ution is expressly
predicated upon applicant's ccmpliance with each and al.l. of the conditions
hereinabove set forth. Should any such conditions, or any part thereof, be
decl.ared invalid or unenforceable by the final judgment of any court of
competent jurisdic*_ion, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is signed and approved by me this 4th day of
