That the proposed use will not adversel,y affect the adjoining land uses and the growth and development of the area in which it is proposed to be lor_ated. 4. That the granting of the ~onditional Use Permit under the conditions imposed, if any, will not ha detrimental to the peace, health, safety and general welfare of l•he Citi~ens of the City of Anaheim. 6. That the traffic gene~ated by the proposed use will not impose an undue Gurden upon the streets ar,d higt~ways designed and improved to carry the traffic in the area. 7. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. F.NVIROtJMENTAL IMPACT FINDING: That the A7aheim City Planning Commiusion has reviewed the proposal to retain three automobile repair and automotive related businesses in tne P1L (Industrial, T:imited) Zone on an icregularly-shaped parcel of land consisting of approximately 4.1 acr.es located at the southwest corner of Orangethorpe Avenue and Placentia Avenue and further described as 1631 North Placentia Avenue, Units G, 0, P and R; and does hereby approve the Negative Declaration upon finding that it has ccnsidered the Negative Declaration to9ether with any comments received during the public review process and furthec finding on the basis of the initial study and any comment.s received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for ConditionaJ. Use Permit, upon the following conditions which are hereby found to be a necessaty prerequisite to tlie propo:~ed use of the subject prope:ty in otder to preserve the safety and general welfare of tha Citizens ot the City of Anaheim: 1. That due to the change in use and/or occupancy of the building, plans shall be submiCL•ed to the Buildinq Division showing compliance with the minimum standards of the Cit~~ of Anaheim, including the pniform euilding, Plumbing, Electrical, Mechanical and Fire Codes a~ adopted by the City of Ar.aheim. Th~~ appropriate permits shall be obtained for a~,y necessary work in each uni.t identified as G, 0, P and R. 2. That ,. Lr~ffi~ signal ~ssesswenc Lee (basPd on the square footage of the individual Unit~ G, 0, P and R) equz•ling the difference between the in~iustrial and commercial assessmenc fees shall be paid to the City ot Anaheim in an am~unt as determined by the City Council. 3. That each Unil- identified as G, 0, P and R shall comply with all signing requirements of the 61L Zone, unless a variance allowing sign waivers is approved by the Planning Commissioz n~ City Council. 4. That no outdoor stocage of or work c~, vehicles or v.~hicular parts shal]. be permitted in conjunctio~ with any of the subject businesses, identified as Units G, O, P ai~d R. 5. ihat subject pr~prrty shall be developed substantially in accordance H•itt, plans and specifzcatio:~s on file with the Ciryo uf Anaheim marked Exhibit Nos. 1 and '2. -2- PCB:,-205 I ~. ~ 6. That Conditicn Nos. 1 and 2, above-mentioned, shall be completed by subject businesses, identified as Units G, O, P and R within a period of ninety (90) days from the date of this resolution. 7. That prior to final building and zoning inspections for subject businesses, identified as Units G, 0, P and R, Condition Nos. 3, 4 and 5, above-mentioned, shall be complied with. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressSy pL~edicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such conditions, or any part thereof, be declaced invalid or unenforceable by the final judgment of any court of competent juxisdi.ction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
